As used in this article, the following terms shall have the
meanings indicated:
LITTERING
Throwing, placing or allowing to be placed solid waste materials
in the highways of the Town or on other Town property other than the
Town Transfer Station/Recycling Center located at 22 Bacon Pond Road
or similar disposal area designated by the Board of Selectmen.

SOLID WASTE
Any garbage, refuse, sludge, and other unwanted or discarded
material, including solid, liquid, semisolid or contained gaseous
material, but does not include solid or dissolved material in domestic
sewage or hazardous waste.
Solid waste in the Town shall be disposed of only in accordance
with this article and the regulations adopted hereunder by the Board
of Selectmen.
No private solid waste disposal areas shall be permitted without
the prior written approval of the Board of Selectmen, which shall
refuse approval wherever any private solid waste disposal area, in
its judgment, may endanger the health, safety or welfare of the inhabitants
of the Town.
Littering is prohibited. Any person violating this section shall
be fined for each violation, not less than $10 but not more than the
maximum permitted by the General Statutes of Connecticut, as amended.
No person may bring solid waste into the Town refuse disposal
area or any similar disposal area approved by the Board of Selectmen
from outside the Town.
All refuse loads must be suitably covered while in transit within
the Town.
No hazardous wastes or materials, as defined by state or federal
laws or regulations, may be disposed of in the Town. It shall be the
responsibility of the generator of such wastes or materials to provide
for the disposal of the same in accordance with the applicable state
and federal laws and regulations.
No person shall engage in the business of collecting or disposing
of solid waste without first obtaining a license from the Board of
Selectmen. The Board of Selectmen may prescribe rules and regulations
as to the collection, handling and disposal of solid waste by such
persons and may revoke such license upon the failure to comply with
such rules and regulations of this section. Any person who shall engage
in such business without a license and any person who shall not comply
with this section or the rules and regulations adopted hereunder shall
be fined not less than $25 for each offense.
The Board of Selectmen shall have the authority to establish
such rules and regulations as it deems necessary for the public health,
safety and welfare concerning the separation, collection, removal,
storage and disposition of refuse, garbage, trash, commercial and
industrial waste, and all other solid waste, and all salvageable material,
including, without limitation, the operation of the Town refuse disposal
area. Such rules and regulations may include licensing, fines, identification,
fees and charges, hours of operations, the quantity and character
of refuse, and private and public collection.

Except as otherwise provided in the Charter of the Town, all
regulations and any amendments thereto shall be adopted as follows:
The regulations shall be adopted by the Board of Selectmen at a regular
or special meeting of the Board of Selectmen at which there is a quorum
of at least two members of the Board of Selectmen; and all such regulations
adopted shall be by majority vote; provided, however, no such regulations
shall be acted upon by the Board of Selectmen unless a public hearing
on such proposed regulations shall have been held by the Board of
Selectmen. Notice of such public hearing shall be given at least seven
days in advance by publication in a newspaper having general circulation
in the Town and by posting such notice on the Town signpost. Copies
of such proposed regulations shall be made available by the Board
of Selectmen for public inspection at the Town Clerk's office at least
seven days in advance of said public hearing. Every regulation, after
approval by the Board of Selectmen, shall be filed with the Town Clerk,
who shall then record and, with the advice of Town Counsel, compile
the same as required by the General Statutes of Connecticut. Each
regulation so passed shall be published at the direction of the Town
Clerk in its entirety in a newspaper having general circulation in
the Town within 10 days after adoption by the Board of Selectmen.
Each regulation shall take effect 15 days after publication unless
such regulation shall specify a later effective date.
Except as otherwise provided, any person who shall violate any
provision of this article or the regulations adopted hereunder shall
be fined not more than $100 for each violation, or if greater, not
more than the maximum permitted by the General Statutes of Connecticut,
as amended. Each day such violation shall exist shall constitute a
separate violation and offense under this article.
