There is hereby created the office of Animal Control Officer. The Animal Control Officer shall be under the supervision of the City Business Manager and shall be responsible for administration and enforcement of all animal control provisions, and other duties as assigned.

ANIMAL
Any dog or cat.
AT LARGE
Shall be construed to mean off the premises of the owner and not under the control of the owner or other responsible person, either by leash, cord, chain or otherwise.

Effective September 1, 2012, all dogs and cats, six months of age or older, within the City limits should be implanted with a microchip and their owner should register the animal's microchip information, including name, address and telephone number with the City. Owners who decline to microchip their animals must pay an annual licensing fee of $25 for every unneutered or unspayed animal or $15 for every spayed or neutered animal. Such licensing fee is due by January 31 of every year. Persons who license their animals after January 31 of every year shall pay double the applicable amount. Persons who move into the City or obtain new animals during the year shall pay a pro-rated fee for the first year.

It shall be unlawful for any person to allow a dog or an unspayed/unneutered cat to run at large within the City limits.

A. 
The Animal Control Officer may take into custody any dog or cat found running at large within the City limits and to place such animal into any facility designated by the City.
B. 
The Animal Control Officer will scan the dog or cat for a microchip and contact the owner for redemption. If the animal is not microchipped, the Animal Control Officer should use any other identifying information to contact the probable owner, if available.
C. 
All animals shall be held a minimum of five days for redemption. The day the animal is captured shall count as the first day.
D. 
Owners wishing to redeem their animals shall pay the appropriate redemption fee as set forth in § 6.04.07. No animal may be redeemed unless that animal has been microchipped or licensed with the City, and has a valid rabies vaccination.
E. 
After five days in City possession, the Animal Control Officer is authorized to place an animal for adoption, to euthanize the animal, or to otherwise dispose of the animal in a humane manner.

A. 
For the first redemption of an animal, the owner shall be charged a redemption fee of $10 for a neutered animal, and $25 for an unneutered animal.
B. 
For a second redemption in a twelve-month period, the owner shall be charged a redemption fee of $20 for a neutered animal, and $50 for an unneutered animal.
C. 
For a third redemption in a twelve-month period, the owner shall be charged a redemption fee of $40 for a neutered animal, and $100 for an unneutered animal.
D. 
For a fourth redemption in a twelve-month period, the owner shall be charged a redemption fee of $60 for a neutered animal, and $150 for an unneutered animal.
E. 
The fee for microchipping an animal by the City is $25.

Any person desiring to keep more than five dogs and/or cats at any single premises shall be required to obtain a business privilege license as a kennel, pursuant to Lincoln Municipal Code Chapter 4.24. A kennel license is only available in areas zoned R-A.

Any person who violates any provision of Chapter 6.04 shall be guilty of a violation and fined an amount not less than $25 nor more than $100 per offense. Every day of violation shall constitute a separate offense.
