As used in this article:
BULKY WASTE
Includes heating boilers, hot water heaters, stoves, washing
machines, bath tubs, refrigerators, clothes dryers, freezers, television
sets, bed springs, large furniture, household construction debris
and similar materials.
COLLECTION UNIT
Each dwelling unit or nonresidential premises receiving refuse
collection services from the Township.
CONSTRUCTION DEBRIS
Waste resulting from the destruction or demolition of structures
or buildings and shall include materials such as concrete blocks,
broken concrete, wire and wood lathe, timbers and wood building products
and other similar nonputrescible materials.
GARBAGE
Includes all solid waste generated by a premises inclusive
of bulky waste and exclusive of recyclable materials, medical waste,
industrial waste, hazardous materials and construction debris.
GARBAGE CAN
Includes any light gauge steel, plastic, or galvanized receptacle,
closed at one end and open at the other, furnished with a top or lid,
and of a capacity not exceeding 30 gallons and not weighing more than
60 pounds when full. It shall also mean plastic bags or liners of
0.0125 gauge or heavier, securely tied at the top and not exceeding
30 pounds gross weight.
HAZARDOUS MATERIALS
Waste products that are hazardous by reason of their pathological,
explosive, radiological or toxic characteristics.
INDUSTRIAL WASTE
Solid waste resulting from industrial processes and/or manufacturing
operations.
MEDICAL WASTE
Any waste generated during the treatment of a patient. Sources
of medical waste shall include, but not be limited to, offices of
physicians, dentists and veterinarians, medical laboratories, animal
hospitals, nursing homes, hospices and hospitals.
NONRESIDENTIAL PREMISES
Includes the following:
A.
Premises which do not contain dwelling units;
B.
Premises which generate medical waste;
C.
Premises which contain mixed residential and commercial units,
however, only the commercial units shall be deemed nonresidential.
D.
Premises which are used for "farming" as defined under Chapter
600, Land Use, §
600-4.
RECYCLABLE MATERIALS
Includes used newspapers, glass, aluminum cans, corrugated paper (other than residential cardboard), office paper, and yard waste as defined in §
486-11, Definitions, of the Revised Ordinances of the Township of Denville.

A. Residential. Effective April 1, 1989, every residential dwelling
unit in the Township of Denville shall receive refuse collection services
through the Township of Denville. The owner of the residential premises
shall be charged and shall pay a fee for each dwelling unit as established
hereinafter.
B. Exceptions. The following classes of residential dwelling units are
specifically excluded from this article:
(1) Residential dwelling units which are located on a Township border,
provided that the owner or lessee of said residential dwelling unit
submits proofs to the Division of Health establishing that refuse
collection is provided by the neighboring municipality.
(2) Residential dwelling units which do not front on a public street,
provided that the owner or lessee of said residential dwelling units
submits proofs to the Division of Health establishing that refuse
collection is provided by an alternate source.
(3) A qualified private community as defined by the Municipal Services
Act, N.J.S.A. 40:67-23.2 et seq., that elects to provide its own refuse
collection services. A qualified private community may elect to provide
its own collection services for garbage only and to use the Township
collection services for recycling in which case the homeowner's association
for the qualified private community will be charged a fee equal to
the fee charged to the municipality by the contract hauler for the
recycling pickup at the community.
C. Nonresidential premises. The owners of all nonresidential premises
in the Township of Denville shall be required to make adequate provision
for disposal of garbage and recyclables generated in their premises.
Upon request by the Division of Health, the owner shall submit proofs
to the Division of Health to establish that this provision has been
met. Where approved by the Division of Health, the owner may provide
for these services through the Township of Denville by payment of
the refuse collection fee. The Division of Health shall determine
whether these services can be provided by the Township based on whether
the premises can properly be serviced by curbside garbage can collection.
In making this determination, the Division of Health shall evaluate
the entire premises, including any separate tenancies of the premises.
D. Collection of garbage, recycling, or other refuse from all premises
shall take place between the hours of 6:00 a.m. and 8:00 p.m. on Monday
through Saturday. Collection at any time outside of the prescribed
hours and days is prohibited. Officers; employees, and agents of the
Township Police Department, DPW, Health Department, and the Zoning
Officer and/or Property Maintenance Code Official are authorized to
enforce this subsection against any hauler that violates its provisions.

The owners of any premises receiving refuse collection services
from the Township may place, no earlier than 4:00 p.m. one day before
the scheduled collection day, up to two garbage cans, which cans must
have tight-fitting lids, within five feet of the street or traveled
way in front of the premises or at such location as designated by
the Division of Health. All cans must be removed no later than 8:00
a.m. on the day after collection has occurred. The owners shall comply
with rules and regulations promulgated by the Division of Health scheduling
and regulating curbside garbage can collection and bulky waste collection.

The fee for refuse collection per collection unit shall be $115.50
per quarter. Interest charges shall be payable at the legal rate of
interest and shall accrue as of the date that payment is due.

A. Any person, firm or corporation who shall violate or fail to comply with any provision of this article shall be subject, upon conviction, to the penalties provided in Chapter
1, Article
II, General Penalty, of the Township Code.
B. Minimum penalty. Any person, firm or corporation which are owners
of nonresidential premises shall be subject to a minimum fine of $100
for failure to make adequate provision for disposal of garbage.
