A Police Department is hereby established in and for the Township of East Pennsboro. The Chief of Police shall be the chief executive of the Police Department. He shall, under the direction of the Township Commissioners, be in charge of the police force and have supervision over its members, in the exercise of their powers, duties and authority.

Subordinate to the Chief of Police, in the Police Department, the following classifications are hereby established:
A. 
Patrol Division.
B. 
Criminal Division.

The number of persons to serve in each of the subordinate classifications as set forth above shall be as set forth above. The compensation for each shall be determined by the Township Commissioners from time to time.

Editor's Note: Ord. 425-83, 1/18/1983, in § 2 thereof, provided that each police officer at the time of adoption of Ord. 425-83 in the classification of Lieutenant or Sergeant be reassigned to the next lowest job classification and to be compensated at the rate of pay of the lower classification. Section 3 of Ord. 425-83 directed the Township Manager to reduce the number of paid employees of the police force, in accordance with the provisions of the First Class Township Code, 53 P.S. § 55644, to the number established by § 1 of Ord. 425-83. The provisions of §§ 2 and 3 of Ord. 425-83 were carried out shortly following the adoption of Ord. 425-83 and are not of current legislative effect.

Police officers employed by the East Pennsboro Township Police Department shall, upon the police officer's personal view, have the right to arrest without warrant upon probable cause where there is ongoing conduct that imperils the personal security of any person or endangers private or public property for any of the following offenses, when such offense constitutes a summary offense pursuant to the Pennsylvania Crimes Code, 18 Pa.C.S.A. § 101 et seq.:
A. 
18 Pa.C.S.A. § 5503 (relating to disorderly conduct).
B. 
28 Pa.C.S.A. § 5505 (relating to public drunkenness).
C. 
18 Pa.C.S.A. § 6308 (relating to purchase, consumption; possession or transportation of liquor or malt or brewed beverages by a minor).
D. 
18 Pa.C.S.A. § 5507 (relating to obstructing highways and other public passages).

Any officer effecting a warrantless arrest under this Part shall identify himself/herself as a police officer by exhibiting a recognized sign of authority, which shall consist of either an official police uniform of the Department or an authorized official police badge or police identification.

All warrantless arrests authorized by this Part shall be made in accordance with standards for other types of warrantless arrest as set forth in any other statute or law of the Commonwealth of Pennsylvania as well as case law concerning the particular conduct or offense. In the event that any statute or law of the commonwealth provides for more stringent standards or requirements, such more stringent standards or requirements shall be followed and shall be deemed to supersede the standards or requirements set forth in this Part. No change in the law on warrantless arrest, either by statute or by the development of case law, shall be deemed or constructed to invalidate this section. Rather, any such change in the law on warrantless arrests shall be considered to automatically amend this Part by becoming the standards authorized pursuant to this section and this Part.

All warrantless arrests shall also be made in accordance with the Police Code of Conduct provisions and guidelines promulgated by the Chief of Police which is incorporated by reference hereto and not attached as an exhibit to this Part and is hereby adopted and promulgated by the Commissioners of the Township of East Pennsboro as the applicable guidelines to be followed by police officers when making warrantless arrests pursuant to 42 Pa.C.S.A. § 8902.
