BICYCLE
Every device propelled by human power upon which any person may ride, having two tandem wheels.
PERSON
Any natural person, partnership, association, firm or corporation.
In this Part, the singular shall include the plural, the plural shall include the singular, and the masculine shall include the feminine and the neuter.

1. 
It shall be unlawful:
A. 
For any person residing in the Township of East Pennsboro to ride or use any bicycle within the Township without first having registered such bicycle with the Police Department of the Township and without having attached to such bicycle the license plate obtained from the Police Department as evidence of such registration.
B. 
For any person operating or conducting a bicycle rental agency at any place within the limits of the Township to fail to register every bicycle available for rental from such agency with the Police Department of the Township and without having attached to every such bicycle the license plate obtained from the Police Department as evidence of such registration.
C. 
For any person to sell or transfer to another person ownership of any bicycle that Department that shall have been registered with the Police Department as provided in Subsection 1A or B of this section, without having reported such sale or transfer to the Police Department within 48 hours after such sale or transfer.
D. 
For any person residing within the Township of East Pennsboro to acquire ownership from any person, by gift, sale or any other means, any bicycle that shall have been registered with the Police Department as provided in Subsection 1A or B of this section, without having reported such acquisition to the Police Department within 48 hours after such acquisition.
E. 
For any person to take out of service, junk or dismantle any bicycle that shall have been registered with the Police Department as provided in Subsection 1A or B of this section, without having reported such action to the Police Department within 48 hours after such taking out of service, junking or dismantling.

1. 
It shall be the duty of the Police Department:
A. 
To register all bicycles required by the § 3-102 of this Part to be registered, to keep a record of all such bicycles registered in such a way as to provide maximum aid to the Police Department to ascertain ownership of bicycles used or found within the limits of the Township and the person registering the bicycle for the first time shall pay a fee therefor in an amount as established from time to time by resolution of the Board of Commissioners; all re-registrations of said bicycle required by change of ownership may be made by payment of a fee also in an amount as established from time to time by resolution of the Board of Commissioners.
B. 
To keep records of transfer of ownership of bicycles, and of the taking out of service, dismantling and junking thereof.
C. 
To impound, in the place designated by the Board of Township Commissioners for the purpose, all bicycles found on the streets, alleys, parks or other public places, or abandoned on vacant lots or private property other than the residence or place of business of the registered owner of such bicycle, and to restore any such impounded bicycle to the owner thereof, upon receipt of proper proof of ownership.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.

1. 
A bicycle held for the owner by the Township and unclaimed by the owner for more than 90 days from the date it first became demandable or distributable shall be presumed abandoned and unclaimed.
2. 
Bicycles held pursuant to Subsection 1 hereof shall be donated to a charitable organization by resolution of the Board of Commissioners.
