§ 15-401 Vehicles to Be Parked Within Marked Spaces.

Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this Part for any person to park a vehicle or allow it to remain parked otherwise.

§ 15-402 Parking Prohibited at All Times in Certain Locations.

§ 15-403 Parking Prohibited in Certain Locations, Certain Days and Hours.

§ 15-404 Parking of Large Trucks and Buses Restricted.

It shall be unlawful to park on any street or alley in the Township any truck or other vehicle or tractor having a registered gross weight or combination weight for the purposes of determining the fee for annual registration under § 1916 of the Vehicle Code, 75 Pa.C.S.A. § 1916, in excess of 11,000 pounds, except temporarily for the purpose of delivering or picking up any goods, wares, merchandise or material in the normal course and conduct of the business use of any such vehicle.

It shall be unlawful to park on any street or alley in the Township a bus designed to carry 10 or more passengers, except temporarily for the purpose of picking up or discharging passengers in the normal course and conduct of the business use of any such vehicle.

Any person, firm or corporation who shall violate any provision of this section, upon conviction thereof, shall be sentenced to a fine of $50 and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days.

§ 15-405 Parking Time Limited in Certain Locations, Certain Days and Hours.

No person shall park a vehicle, or allow it to remain parked, for longer than the time indicated, in any of the following locations, at any time on the days and between the hours indicated:

§ 15-406 Special Purpose Parking Zones Established; Parking Otherwise Prohibited.

The following are established as special purpose parking zones, and it shall be unlawful for any person to park a vehicle or to allow it to remain parked in any such zone except as specifically provided for that zone:

Violation and Penalty.

Except as provided in paragraph .B, below, any person violating any provision of this section, upon conviction thereof, shall be sentenced in accordance with § 15-411.

Any person parking a vehicle not bearing a person with a disability or severely disabled veteran plate or displaying a person with a disability or severely disabled veteran parking placard as provided by the Vehicle Code, 75 Pa.C.S.A. § 101 et seq., upon conviction thereof, shall be sentenced to a fine of not less than $50 nor more than $200 plus costs, in addition to towing of the vehicle in violation, in accordance with the provisions of § 3354 of the Vehicle Code, 75 Pa.C.S.A. § 3354.

§ 15-407 Standing or Parking on Roadway for Loading or Unloading.

It shall be unlawful for any person to stop, stand or park a vehicle (other than a pedalcycle) on the roadway side of any vehicle stopped or parked at the edge or curb of any street, except that standing or parking for the purpose of loading or unloading persons or property shall be permitted on the following named streets on Monday through Saturday, between the hours of 9:00 a.m. and 11:30 a.m. and between the hours of 1:30 p.m. and 4:00 p.m., and for no longer than necessary for the loading or unloading.

§ 15-408 Parking of Vehicles Without Current Registration Tag or Inspection Sticker.

It shall be unlawful to park any vehicle upon any of the streets or alleys in the Township, or to allow any vehicle to remain parked thereon, which does not bear the current registration plates of the Commonwealth of Pennsylvania, or any other state, commonwealth, province, or territory, or if a vehicles registered in Pennsylvania, which does not bear the current inspection sticker.

Any person, firm or corporation who or which violates any provision of this section, upon conviction thereof, shall be sentenced to a fine of $50 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day on which a violation of this section shall occur shall be deemed a separate offense.

§ 15-409 Residential Permit Parking.

Findings and Purpose. The Township of East Pennsboro (hereinafter referred to as "Township") finds that:

Certain residential areas in the Township are subjected to nonresidential vehicle parking and therefore depriving the residents of those areas of spaces within which to park their own vehicles.

Those residential streets are also subjected to a high degree of nonresidential traffic which substantially reduces the quality of ambient air level.

Those residential streets, being subject to the said high degree of nonresidential traffic, adversely affects the quality of life of the residents residing on said streets.

The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference.

Therefore, the Township considers it to be in the best interest of the citizens of the Township, as well as for the promotion of general health and welfare of its citizens, to provide for the establishment of a residential permit parking program to insure primary access to available parking spaces by neighborhood residents.

Definitions. For the purpose of this section, words and terms listed in this subsection shall have the following meanings:

NONRESIDENTIAL VEHICLE

A motor vehicle parked in a residential area by a person not a resident of that residential area.

PROPRIETOR

A person who owns or leases real estate within a residential area in which he or she is not a resident.

RESIDENTIAL VEHICLE

A person who owns or leases real property within a residential area and who maintains either a voting residence, or bona fide occupancy, or both, at that address and who owns a motor vehicle.

Criteria. The residential areas designated in this section are those deemed impacted and hence eligible for residential parking.

In determining that a specific area identified as being impacted and eligible for residential permit parking, the following factors are taken into consideration:

(1)

The local needs with respect to clean air and environment, as well as the general health and welfare of its residents.

(2)

The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards.

(3)

The desire and need for residents for residential parking.

(4)

The availability of private parking areas for vehicles of nonresidents which areas are proximately located to the residential areas.

Designation of Residential Permit Parking Areas. The following are designated as residential permit parking areas:

Applications for Permit. Applications for residential parking permits shall be made to the East Pennsboro Township Police Department between the hours of 8:00 a.m. and 4:00 p.m., Monday through Friday. The applicant shall be the owner or operator of a motor vehicle which is registered to an address as identified in Subsection 3. Separate applications shall be required for each motor vehicle. The application shall be on a form provided by the Police Department. The application shall contain, at least, the following information: name of the operator/owner of the motor vehicle, make, model, color, and registration number of the vehicle in question for which permit is requested. The Police Department will require the applicant to present his/her driver's license and vehicle registration reflecting house numbers as identified in Subsection 3.

Issuance of Permits. If the Police Department determines the application to be valid, the Department shall issue the appropriate residential permit which shall be valid unless revoked by the Police Department for just cause.

Visitor Permits. Each residence as identified in Subsection 4B may also make application for one visitor permit. This permit, as provided by the Police Department, must be displayed on the left front dashboard of the visitor vehicle visiting at one of the identified house numbers in Subsection 4B. Failure to display the visitor permit shall not be a defense to prosecution under this section. Only one visitor permit can be issued for each identified house number in Subsection 4B. Such permits may only be used by visitors to the specific house number identified in Subsection 4B. Visitor permits cannot be transferred to any other house numbers identified in Subsection 4B. Visitor permits cannot be displayed on vehicles registered to house numbers identified in Subsection 4B. Visitor permits are limited to "visitors" only. This subsection is not applicable to Subsection 4A.

Responsibility of Permit Holder.

The holder of a residential parking permit shall be permitted to park or stand a motor vehicle owned by his/her in the designated residential parking area defined in Subsection 4. The permit, as provided by the Police Department, shall be affixed to the left rear corner of the vehicle to which the permit was issued. However, a residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area. Further, failure to display the permit as required shall not be a defense to prosecution under this section.

The residential permit parking holder shall not be exempt from the observance of all traffic or parking regulations other than the designated residential permit parking regulation pertaining to the area wherein the permit holder resides.

No person other than the permit holder whose name appears on the permit shall use such permit or display same on a vehicle other than the vehicle identified in the application.

It shall constitute a violation of this section for any person to represent himself/herself as eligible for a residential parking permit or to furnish false information in an application in order to secure a parking permit.

The Police Department shall have the authority to revoke the parking permit of any permit holder found to be in violation of any of the provisions of this section. Upon written notification of violation, the permit holder must remove any issued parking permit from all vehicles to which such was issued and further shall be required to surrender the visitor's permit to the Police Department.

The Township and the Police Department shall in no manner be liable for vehicle damages caused by the placement or removal of the permit parking sticker.

Violation. It shall constitute a violation for any person to park a motor vehicle in any area designated as a "Residential Permit Parking Area," as defined in Subsection 4, without displaying a valid permit parking sticker or a visitor permit as prescribed by this section.

Penalties. For violation of any provision of this section, the permit holder and/or violator(s) shall pay a penalty in the sum of $15 within 48 hours of notice of violation. If the violator(s) fail to remit payment to the Police Department within the said 48 hours, the violator(s) will be subject to a fine of $50, and, in default of payment of fine and costs, imprisonment for not more than 10 days.

§ 15-410 Parking Prohibited on Portions of Certain Highways During Street Sweeping Hours.

It shall be unlawful for any person to park a vehicle or to allow the same to remain parked, at any time between [ ] and [ ] on any of the following portions of the highways of the Township on the days hereby respectively designated for street sweeping purposes:

§ 15-411 Specialty Vehicle Permit Parking.

Findings and Purpose. The Township of East Pennsboro finds that:

Numerous complaints have been received from citizens of the Township that mobile home, motor home, trailer, truck camper, boat trailer or utility trailer have been parked on many of the residential streets of the Township.

Traffic and engineering studies have been conducted by the Police Department of East Pennsboro Township.

The Commissioners of the Township find that parking mobile home, motor home, trailer, truck camper, boat trailer or utility trailer creates a hazardous condition for the citizens of the Township including, but not limited to, obstructing traffic lanes, pollution, and noise when starting up, providing an attractive nuisance to children, interfering with sight distances and interfering with snow removal and street cleaning.

It shall be unlawful for any person to park a mobile home, motor home, trailer, truck camper, boat trailer or utility trailer on any street or portion of a street, alley, roadway, highway, berm (paved or unpaved), shoulder, traffic way, public right-of-way or public property, except that this section shall not prohibit parking of said vehicles for a period of time, not exceeding 48 consecutive hours. A permit must be obtained from the Township Police Department and be attached to the vehicle during the temporary parking period.

At least three portable emergency warning devices must be displayed upon the roadway to the approach to the vehicle.

At no time shall any of the aforementioned vehicles be permitted to park on any "snow emergency route," as may be designated by the Township during the period from December 1 through and including April 1, annually.[1]

A maximum of 10 permits per year will be issued for the same vehicle. A period of five days is required between permits.

Notice of parking restrictions shall be provided by any of the following means: posted traffic control devices, certified letter, personal service, or by placing a notice on the windshield or other readily visible location on the vehicle. In the absence of a posted traffic control device, this section shall not be enforced by citation unless a notice of violation has been issued to the owner or operator of the vehicle by any means previously enumerated prior to the date and time enforcement is initiated.

§ 15-412 Parking Prohibited on Portions of Certain Highways, Roads, Alleys, Streets, Parking Lots and Improved Surfaces Designated as "Fire Lanes."

It shall be unlawful for any person to stop, stand or park a vehicle within the area designated as a fire lane when such an area is clearly marked.

Signs shall be erected along areas designated as "fire lanes" indicating that said area is a "fire lane" and that stopping, standing, or parking is prohibited.

§ 15-413 Penalties.

Any person who violates any provision of this Part, upon conviction, shall be sentenced to pay a fine of not more than $50 and costs. Provided, it shall be the duty of the police officers and of parking enforcement personnel of the Township to report to the appropriate official all violations of any provision of this Part indicating, in each case, the section violated; the license number of the vehicle involved in the violation; the location where the violation took place; and any other facts that might be necessary in order to secure a clear understanding of the circumstances attending the violation. The police officer or other person making the report shall also attach to or place upon every such vehicle a notice stating that the vehicle was parked in violation of this Part. The notice shall contain instructions to the owner or driver of the vehicle that if he will report to the office of the Chief of Police and pay the sum annotated on said ticket within five days after the time of the notice, or place the sum annotated enclosed within the envelope provided and mail said envelope within five days after time of the notice, that act will save the violator from prosecution and from payment of the fine and costs prescribed in this section.
