This Part may be known and may be cited as the "East Pennsboro Township Snow and Ice Ordinance."

The word "sidewalk," when used in this Part, shall mean any improved pavement or part thereof fronting or alongside of a street or highway within the curb line and the property line of said street or highway, or between the property line and the vehicular driveway.

The owner and/or occupant of every property fronting upon or along side of any of the streets or highways of the Township of East Pennsboro is hereby required to remove or cause to be removed all snow, ice, slush, or any combination thereof from all of the sidewalks in front or along side of such property including that portion of the driveway where the sidewalk crosses the driveway, for a minimum width of three feet measured from the curb line toward the property line if there is no grassplot separating the curb from an improved pavement, or for a minimum width of three feet measured from the line of the improved pavement located along the grassplot toward the property line if there is a grassplot separating the curb from an improved pavement, but in no case exceeding the width of the sidewalk, within 24 hours after said snow, ice, slush, or any combination thereof shall have ceased to fall, form or accumulate on such sidewalks, unless said snow, ice, slush, or any combination thereof be so hardened or frozen that it cannot be so removed without injury to the sidewalk, in which latter event the owner and/or occupant is hereby required to place salt, sand, or other abrasive material upon said snow, ice, slush, or any combination thereof within the time above provided.

In any case where the owner and/or occupant as aforesaid, shall fail, neglect, or refuse to comply with any of the provisions of this Part or within the time limit prescribed therein, the Township of East Pennsboro may, in its discretion, proceed immediately to clear the snow, ice, slush, or any combination thereof from the sidewalk of such delinquent or to place salt, sand or other abrasive material upon the snow, ice, slush, or any combination thereof on the sidewalk of such delinquent, and to collect the expenses thereof, with any additional amount allowed by law, from such owner and/or occupant, as the case may be, which may be in addition to any fine or penalty imposed under § 21-305 of this Part.

Any owner and/or occupant who fails to remove any snow, ice, slush, or any combination thereof from any sidewalk or to place salt sand, or other abrasive material upon such snow, ice, slush, or any combination thereof on any sidewalk as required by this Part, upon conviction thereof, shall be sentenced to pay a fine or penalty of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense. Such fine or penalty and costs of suit may be in addition to any expenses and additional amounts authorized by law, imposed as provided by this Part. Each successive 24 hours of failure to remove said snow, ice, slush, or any combination thereof or to place salt, sand, or other abrasive material upon such snow, ice, slush, or any combination thereof as required by this ordinance shall constitute a separate offense punishable by a like fine or penalty.

Any owner and/or occupant or other person who removes, snow, ice, slush, or any combination thereof from the sidewalks or from any other places within the Township of East Pennsboro or anywhere else shall not place the same on any public street, road, highway, or thoroughfare when such snow, ice, slush, or any combination thereof is removed after such time as the public street, road, highway or thoroughfare has been plowed or cleared for the purpose of allowing free and safe passage of vehicular traffic thereon. Any owner and/or occupant or person violating the terms and provisions of this Part, upon conviction thereof, shall be sentenced to pay a fine or penalty of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
