This Part shall be known as and may be cited as the "Edinboro Boat Control Ordinance."

For the purpose of this Part the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number and the words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
BOAT
Any watercraft, including seaplanes when not airborne, docked or moored at in any natural or man-made waterway within the boundaries of the Borough of Edinboro.
BOROUGH
The Borough of Edinboro and includes so much of what is known as Edinboro Lake or Lake Conneautee that lies above and on land owned by the Borough of Edinboro.
TEMPORARY HOUSING
Any tent, trailer, mobile home or any other structure used for human shelter which is designed to be transportable and which is not attached to the ground, to another structure or to any utility system on the same premises for more then 30 consecutive days.
WATERWAY
Any water, waterway, lake, river, tributary, canal, lagoon or connecting waters including, but not limited to, water known as Edinboro Lake or Lake Conneautee above and over land owned by the Borough of Edinboro.

No person shall operate a boat unless licensed as required by the applicable state and federal laws and regulations.

No person shall operate a boat which does not meet all applicable equipment requirements of the United States Coast Guard for such boat being used on navigable waters.

No person shall operate a boat in a reckless manner or at an excessive rate of speed so as to endanger or be likely to endanger the life or property of any person having due regard for the presence of other boats or persons, or other objects in or on a waterway, nor shall any such person operate any boat at a rate of speed which causes waves to damage docks or seawalls or boats moored to docks or wharves along a waterway.

No person shall operate a boat while under the influence of intoxicating liquor, narcotic drugs or opiates.

No person shall operate a boat in such a manner as to unjustifiably or necessarily annoy or frighten or endanger the occupants of any other boat or throw up a dangerous wake when approaching another boat.

No person operating a boat shall use searchlights indiscriminately or in such manner as to annoy or disturb other persons or boats.

Every boat in a waterway which is abandoned or which becomes a menace to navigation, or unseaworthy, or sinks, grounds or becomes otherwise disabled is hereby declared to be a nuisance and the person in charge thereof shall abate such nuisance within three days' notice from the Borough Manager.

The members of the Police Department of the Borough or any recognized police officer of the state, county or adjoining Township shall have authority to board any boat in violation of this Part, and move or cause it to be moved to another location and shall have the right to hold such boat for the payment of costs incurred in its removal or storage.

No person shall moor a boat to a private seawall or dock or beach it upon private property within the Borough without the permission of the owner thereof.

Persons in charge of or occupying boats docked at or moored to land, docks, piers or wharves abutting waterways, shall observe all the health and sanitary regulations of the Borough and all ordinances of the Borough relating to the conduct of persons and prohibiting acts contrary to public health, morals, safety or public peace.

Persons in charge or occupying boats shall at all times keep the docks, seawalls and premises adjacent to such watercraft in a neat and orderly manner and free from trash, rubbish, repair parts, machinery, equipment and debris of all kinds.

No person in charge of or occupying a boat shall dump or throw garbage, paper, bottles, cans, refuse or debris into waterways.

No boat shall be used or occupied as a house boat for permanent or temporary place of abode or residence.

No person shall run or operate any boat engine for the purpose of charging batteries, running auxiliary equipment or testing between the hours of 11:00 p.m. and 6:00 a.m. prevailing time.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.

Regulations for public beaches.

1. 
It shall be unlawful for any person, firm or corporation using such beaches to either perform or permit to be performed any of the following acts:
A. 
Disturb the peace or use of any profane, obscene or blasphemous language.
B. 
Carry, possess or drink any alcoholic liquor at any beach.
C. 
Violate any rule for the use of the beaches, made or approved by the Borough Council.

All the recreation parks and beaches to open at 8:00 a.m. and close at dusk; except that the Borough Manager may close the parks or beaches at any time and for any interval of time either temporarily or at regular stated intervals.
