1. 
Duty of Owners; Frontal Property. On every street which now is or hereinafter designated by Council shall be laid out and opened and dedicated to public use in the Borough, it shall be and is the duty of the several owners of the lots or parcels of the land abutting thereon, and they are hereby enjoined and required, at their own expense, to construct and maintain safe and convenient sidewalks in front of and adjoining their respective lots or parcels of land and to keep the same in good and safe condition for the use of pedestrians.
2. 
Duty of Owners; Corner Property. It shall be the duty of the owner or owners of corner lots or parcels of land, or lots or parcels of land adjoining more than one street either on the sides or in the back and front, and they are hereby enjoined and required, at their on expense, to construct, reconstruct and maintain convenient sidewalks in front and on all sides of said lots or parcels which abut a publicly used road and to keep the same in good and safe condition for the use of pedestrians.
3. 
Exemptions. Sidewalks shall be constructed on both sides of all improved Borough streets where they do not presently exist as rapidly as financial and practical considerations permit through an annual sidewalk program in accordance with provisions of § 21-202 of this Part and § 21-209 of this Part; provided, however, the Council may exempt one side of a street upon a finding by the Council that the construction of a sidewalk on the exempted side of said street would involve construction financially impractical. The Council may also exempt streets having only one outlet or unpaved streets.

1. 
Council Action. The annual sidewalk program for construction of new walks shall be determined in the spring of each year by the Council. The Streets Committee shall obtain advice and information from the Borough Manager, then present a plan to Council that designates the sidewalks to be completed that year. After approval of the plan by the Council, notification shall be given to the owners of the affected properties.
2. 
Procedure. Said notice shall be served upon the owner or owners of said lots or parcels to which said notice refers not less than 10 days prior to the date fixed for the commencement of the work. If owner or agent is not a resident of the Borough, then such notice shall be given by registered letter. This letter shall be deposited in Borough Post Office not less than 14 days prior to the time fixed for commencement of such work.
3. 
Time to Construct. Every owner of property in the Borough of Edinboro which has properly been notified to construct, reconstruct or repair said sidewalk must commence such work within 30 days of receiving notice. Property owners must arrange for the construction work to be done according to Borough specifications.
4. 
Grievances. Said notice shall inform owners of their right to a grievance as provided by law and designate where work and material specifications for work to be completed within the Borough may be obtained as described by this Part.

Repair of Sidewalks. As provided in § 21-201, it is the duty of property owners to keep sidewalks in a safe condition. At any time, owners may obtain the specifications for the sidewalks from the Borough Office and commence repair work in accordance with the proper procedures.
2. 
Notice to Repair. After inspection of unsafe or improper sidewalks, the Borough Manager may serve notice upon a property owner or owners to require them to repair their sidewalk. The notice shall be given at least 10 days prior to the date set for the work to begin and shall provide a period of 30 days in which to complete the repair work.
3. 
Preparation.
A. 
All persons must secure and pay for all necessary permits for the construction of public walks.
B. 
All existing damaged/cracked/spalled or defaced sections and debris must be removed and hauled from site.
C. 
A proper subgrade must be prepared with a foundation base of cinders, slag, gravel or other material as the character of the soil and drainage may render necessary.
D. 
All forms of such sidewalks, curbs or driveways shall be inspected by an authorized employee of the Borough prior to the pouring of any cement.
E. 
If in the judgment of the Code Enforcement Officer soil and site conditions render additional moisture and frost prohibitors, they shall be in accordance with regularly used building standards as set by the local building codes.
4. 
Material Requirements. The following materials must be used unless otherwise notified by the proper authority:
A. 
Portland Cement. Mix 1:2:3, Type A, fine crushed stone, having element factor of 5.3 sacks per cubic yard, with four-inch job slump. A certified central mix will be acceptable if a compressive strength of not less than 2,000 points per square inch is achieved with 28 days.
B. 
Calcium Chloride. For cold weather concrete, two pints for each bag of cement.
C. 
Expansion Joint Filler. One-half inch thick, premolded asphalt or nonbituminous fiber filler material.
D. 
Crushed stone, gravel or cinder base to comply with the state's specifications.
E. 
Reinforcing. Welded wire mesh 6/6-10x10.
5. 
Installation. The following rules and regulations are to be followed unless otherwise notified by proper authority:
A. 
Slope. Set screeds or forms to allow for slope from property line towards street at a rate of 1/2-inch per foot and maintain that no horizontal plane of the sidewalk be lower than the normal height of the curb adjoining the property where said sidewalk is being installed.
B. 
Cut. Existing concrete surfaces not to be replaced, shall be evenly cut, to form a straight scored joint between new and existing concrete work which is left undisturbed.
C. 
Thickness. Sidewalks shall be no less than four inches thick and must be six inches thick across driveways.
D. 
Expansion. Expansion joints shall be spaced at a maximum of twenty-five-foot intervals and shall be the same width as the concrete depth with scored dummy joints saw cuts spaced at five-foot intervals.
E. 
Width. Sidewalks shall be no less than five feet wide except when using wells to save trees, these wells shall not reduce the width of the sidewalk more than 12 inches.
F. 
Longitudinal Grade. Longitudinal grade shall be determined in accordance with street grade and should be uniform with adjoining properties.
G. 
Curing. Curing shall be accomplished by keeping the new surfaces damp and covered for a period of not less than 48 hours, if during cold weather.
H. 
Finish. Finish shall be with a wood or magnesium float or a fine broom with no holes, indentations or slices greater than 1/64 of an inch deep.
I. 
Corners. All exposed external corners shall be of rounded bullnose type.
J. 
Grade Determination. The Borough Engineer will establish the proper grade for each street assigned for sidewalk repair or replacement.
6. 
Cause for Replacement. Any sidewalk block or portion of sidewalk which has any of the following faults shall be deemed a safety hazard and shall be replaced or repaired by the owner or owners upon proper notification from the Borough.
A. 
Heaved Portions. Any portion of the sidewalk which has an edge protruding 1/2 inch or more above the adjoining sections shall be corrected.
B. 
Depressed Portions. Any portion of the sidewalk which is one inch or more below the adjoining sections shall be corrected.
C. 
Broken or Cracked Sections. Any sections with cracks over three-eighths-inch wide and not on construction or dummy joints shall be replaced.
D. 
Misalignment. Any section which has a vertical longitudinal misalignment of 3/4 of an inch or more shall be corrected.
E. 
Transverse Gradient. Any sections or portions of the sidewalk which slope transversely in the wrong directions should be replaced if any of the above items exist.
F. 
Poor Surface Conditions. Any section or portion of the sidewalk with spalling or chipping covering 50% or more of that section or portion and is over 1/4-inch deep shall be replaced or repaired.

Grievance Procedure. In case of an aggrieved party, said party shall submit his grievance in writing to the Borough Manager who will refer it to the Edinboro Streets Committee. A "show cause" must be specified in the grievance and backed with just and reasonable facts. The Committee shall, within 20 days, meet with the aggrieved party and review the complaint and within 30 days tender its decision in writing to the aggrieved party.

Barricading. All openings, excavations and obstructions shall be properly and substantially barricaded and railed off, and at night shall be provided with red warning lights. Warning lights perpendicular to the flow of traffic shall not be more than three feet apart, and parallel to the flow of traffic not over 15 feet apart.

Lien and Penalty. Whenever any owner or owners, agent to persons in possession of said premises shall after notice given as provided by this Part shall neglect or refuse to construct, reconstruct or repair said sidewalk, said Borough Council, may and is hereby authorized to do or cause said work to be done at the expense of the owner or owners of said property and the amount of said work together with such interest and penalties shall be collected from the owners thereof by lien or otherwise as provided by law.

Residence Areas. As used in this section, means "Residential Districts," as established and defined in the Zoning Ordinance [Chapter 27].
2. 
New Walks. In all residence areas of the Borough, where no previous concrete sidewalk shall have been laid along the way of any street in any block or any portion of a street between two intersecting streets, the owners of property facing such street may be permitted to lay a concrete sidewalk in accordance with the terms and provisions of this Part upon securing of a proper permit, therefore, from the Code Enforcement Officer.
3. 
Permit Fee for Constructing Sidewalk. All persons must secure a permit for the construction of cement sidewalks in accordance with the Edinboro Zoning Ordinance [Chapter 27].
4. 
Deviations. It is expressly declared to be the intention of this section that all future sidewalk construction in residence areas where sidewalks presently exist shall be limited to the requirements specified in this Part and be uniform throughout the length of the block or along the street between such intersections, unless permission to deviate from uniformity is first obtained in writing from the Borough Council.

Responsibilities. The occupant of every lot or parcel of land adjoining any sidewalk, or the owner of such lot or parcel of land, if not occupied, shall clear all ice and snow from sidewalks adjoining such lot or parcel of land within the time herein required. When any snow shall fall or drift upon any sidewalk, the said owner or occupant of the lot or parcel of land adjacent to said sidewalk, shall remove such snow as shall have fallen or accumulated during the night time, by 12:00 noon; snow tailing or drifting during the day shall be removed before 12:00 noon of the following day. When any ice shall form on any sidewalk, the owner or occupant of the lot or parcel of land adjoining such sidewalk shall, if practicable, immediately remove the said ice and when immediate removal is impracticable, shall immediately cause sand or salt to spread upon the ice in such manner and in such quantity as to prevent the sidewalk from being slippery dangerous to pedestrians and shall remove the said ice as soon thereafter as shall be practicable.
2. 
Failure to Clear. If any occupant or owner shall neglect or fail to clear ice or snow from the sidewalk adjoining his lot or parcel of land within the time limited and herein required, or shall otherwise permit ice or snow to accumulate on such sidewalk, he shall be guilty of a violation of this Part and in addition, the Manager may cause such ice or snow to be cleared and the expense of removal shall become a debt to the Borough from the occupant or owner of such lot or parcel of land and may be collected as a single lot assessment.

Streets Committee Designation. Organized program for construction and reconstruction of sidewalks. During the first quarter of each calendar year, the Edinboro Streets Committee shall review the sidewalk situation and catalogue feasible listing of streets in which construction or reconstruction of sidewalks shall take place during that calendar year. Property notices will then be prepared and sent to the subject parties involved.
