There is hereby authorized and created a Volunteer Fire Department for the Borough of Liberty, Allegheny County, Pennsylvania which Fire Department shall consist of such volunteer company or companies as may be approved and accepted as members of the said Volunteer Fire Department by the Council of said Borough.

Each volunteer fire company shall organize by electing a President, Secretary and Treasurer, who shall have charge of the business meeting of the company. Each company shall also elect a Captain and two Lieutenants, who shall be in command of the said company at, going to, or returning from all fires; and at all times the said company may parade or drill.

Each application for membership in any volunteer company shall at his election by said company subscribe to and accept the constitution, by-laws, rules and regulations of this company which said constitution and by-laws shall embody this Part, and no company shall be or become a member of said Volunteer Fire Department until it shall have organized, as herein provided, and shall have been accepted and approved as a volunteer fire company by the Council of the said Borough, upon presentation to the said Council a copy of its constitution and by-laws, together with a list of its members and officers.

There is hereby authorized and created an office of Chief of the Volunteer Fire Department of the Borough of Liberty, Allegheny County, Pennsylvania, which office shall be filled by the election by the Fire Department of a resident and citizen of the said Borough upon the recommendation of the Fire Committee of said Council and election to be approved by Council and no person shall be eligible to said office without first having accepted and subscribed to the provisions of this Part and the rules and regulations governing the Volunteer Fire Department of the said Borough and having taken oath to obey, uphold and maintain the Constitution and laws of the United States and the Commonwealth of Pennsylvania, the Part, by-laws and regulations of the Borough of Liberty, and having filed bond with the Secretary of the Council of said Borough in such sum as the Fire Committee of Council may determine, said bond to be approved by the Council of the Borough of Liberty.

All property of whatever kind or nature, which shall come into the possession, use or disposition of said fire companies, shall be held for and only for public use, for the purpose of fighting fire, and the titles thereto shall remain in the Borough of Liberty and subject to the control of the Council of said Borough under the provisions of this Part.

All officers and employees of the Police Department shall during the time of fire and at the site of the fire be subject to the orders of the Chief of the Volunteer Fire Department of the said Borough, and any person or persons interfering with or in any wise injuring or delaying the Volunteer Fire Department or any member thereof in the execution of its proper duties in the suppression of fire, or any member of the Volunteer Fire Department or employee of the Police Department refusing to obey the orders of the Chief of the Volunteer Fire Department or the officers of any company thereof at and during the time of fires, within the said Borough, may be arrested and upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

Any fire company or companies answering the alarm of fire shall have the right-of-way over the streets, alleys and highways of the Borough and every pedestrian, automobile, or any other vehicle of any kind, shall upon the approach of the said company with its apparatus, immediately draw to the side of the said road, street or alley and stop until the passage of the fire apparatus and any person failing so to do is guilty of a violation of this Part.

The alarm of fire shall be the ringing of such bell or blowing of such whistle as may from time to time be designated by the Chief of the Volunteer Fire Department, in the manner designated and determined upon by him and any person who shall willfully or maliciously make or cause to be made a false alarm of fire may be arrested and upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

The following association is hereby recognized as actively engaged in providing fire protection and/or emergency services in the Borough of Liberty.
Liberty Borough Volunteer Firemen's Relief Association
The above-named association has been formed for the benefit of its members and their families in case of death, sickness, temporary or permanent disability or accident suffered in the line of duty.

The above-named Association of the Borough of Liberty is designated the proper association to receive such funds as are due and payable to the Borough Treasurer by the Treasurer of the State of Pennsylvania from the tax on premiums from foreign fire insurance companies.

The Borough Council shall annually certify to the Auditor General of the Commonwealth, the name(s) of the active associations and the percentage of service they contribute to the protection of the Borough. Such certification shall be on forms prescribed by the Auditor General.

There is annually appropriated from the Borough Treasury all such sums of money that may hereafter be paid into the Borough Treasury by the Treasurer of the State of Pennsylvania on account of taxes paid on premiums of foreign fire insurance companies in pursuance of 1984 Act of December 18, No. 205, § 701 et seq., as hereafter amended, supplemented, modified or reenacted by the General Assembly of Pennsylvania. Such monies received by the Borough Treasurer from the State Treasurer shall be distributed to the duly recognized association within 60 days of receipt. The funds shall be distributed on the basis of the percentage of service established in the certification to the Auditor General and with other provisions of the Act.
