[1] Editor's Note: The "whereas" clauses of Ord. 02.02.10 are as follows:

"WHEREAS, the General Assembly of the Commonwealth of Pennsylvania and the Governor of said commonwealth approved, by date of January 24, 1966, P.L. 1535, Act 537, known as the "Pennsylvania Sewage Facilities Act," which Act, was subsequently amended, is referred to hereafter as the "Act"; and

"WHEREAS, the Act provides that no person shall install an individual or community sewage disposal system or construct any building in which an individual or community sewage disposal system is to be installed without first obtaining a permit to do so; and

"WHEREAS, Hepburn Township, by ordinance, named the Lycoming Sanitary Committee as its Sewage Enforcement Officer, and further named Lycoming Sanitary Committee, by Ord. 12.2.08.01, to administer the proper installation, maintenance and inspection of Small Flow Facilities (SFSTF) within the Township.

"WHEREAS, the Township, pursuant to Pa. Code, Title 25, § 11.72, is charged with assuming long term proper operation and maintenance of non-municipal sewage facilities that are permitted by the Department of Environmental Protection[.]"

§ 1-501 Sewage Enforcement Officer.

1. The Township, at its discretion, by resolution, may change and/or appoint a new Sewage Enforcement Officer.

2. The Township may, at its discretion, by resolution, change its fee schedule for the permitting process of a sewage disposal system and repairs without the need for an ordinance or amendment of an ordinance.

3. The Sewage Enforcement Officer shall, at the direction and discretion of the Township, accept applications, collect applicable fees, process the same, investigate reports, revoke, issue and deny permits within the Township, including small flow sewage treatment facilities.
