The Borough of Sharpsburg Zoning Hearing Board, assuming all duties and commitments of the board of adjustment, as defined in Chapter 27, § 27-1101.3 of this Code, and consisting of five persons, shall be appointed by Council; of which one member shall be appointed for an initial period of five years, one member shall be appointed for an initial period of four years, one member shall be appointed for an initial period of three years, one member shall be appointed for an initial period of two years; and one member shall be appointed for an initial period of one year. Thereafter, the term shall be five years.
All members of the Zoning Hearing Board shall be appointed by the appointing authority of the Borough of Sharpsburg in a manner consistent with the ordinances of the Borough of Sharpsburg, the Borough Code and the Pennsylvania Municipalities Planning Code. All such appointments shall be approved by the governing body, except where the governing body is the appointing authority. The Zoning Hearing Board or its Chairman shall notify the Borough of Sharpsburg of any vacancies in the Zoning Hearing Board, and such vacancies shall be filled for the unexpired term.
All past practices of the board of adjustment regarding membership, compensation, conflicts with other elected offices, removal, internal rule-making and the election of board officers are incorporated herein within this section.
The powers and duties of the Zoning Hearing Board shall be those covered in Chapter 27, § 27-1101.3, of this Code of Ordinances of the Borough of Sharpsburg, and those granted to zoning hearing boards by the Pennsylvania Municipalities Planning Code.[1]
