Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this section for any person to park a vehicle or allow it to remain parked otherwise.

It shall be unlawful for any person to park, or to allow to remain parked, any vehicle exceeding a 3/4 ton' capacity on any streets or parts of any streets.

1. 
Electric vehicle means a vehicle powered, at least in part, by electricity and capable of charging by being plugged into an electric vehicle charging station.
2. 
It shall be unlawful for any vehicle that is not capable of utilizing an electric vehicle charging station to park in a space designated by signage as for electric vehicle charging.
3. 
At all times, electric vehicles may only park in electric vehicle charging station parking spaces when actively charging and for 15 minutes after the completion of charging.
4. 
Payment is required for use of an electric vehicle charging station and the related parking space. Payment may be bundled into a single rate and shall be made via the electric vehicle station kiosk at the rates designated on the kiosk via payment mechanism made available on the kiosk.
5. 
Electric vehicle charging rates are established in the Borough Fee Schedule and may be adjusted periodically by resolution of Borough Council.
6. 
It shall be unlawful to defraud the electric vehicle charging station payment mechanism.

1. 
Name and purpose. The Borough approves the renaming of the previously approved Handicapped Sign Committee, to be known as the "Accessible Parking Committee."The Accessible Parking Committee shall be comprised of no more than three members of the Borough Council, the Borough Manager and the Chief of Police, or their designee, and shall oversee and administer the rules and regulations of this section.
2. 
Application and eligibility. Any person with a disability or severely disabled veteran who desires to have the Borough erect on the highway as close as possible to their place of residence a sign indicating that such place is reserved for the person with a disability or severely disabled veteran shall make application for the erection of such sign to the Borough on a form provided by the Borough, and shall, at a minimum, meet the following eligibility criteria:
A. 
The applicant must be a resident of Sharpsburg Borough and demonstrate residency in a manner prescribed by the Borough.
B. 
The vehicle must be registered to the person with a disability or severely disabled veteran or a the vehicle must be driven by the person with a disability or severely disabled veteran or a family member who also resides at the same address and demonstrates residency in a manner prescribed by the Borough. If the person with a disability or severely disabled veteran is a minor or is otherwise restricted from operating a motor vehicle, then the vehicle must be registered to a parent or legal guardian of the person with a disability or severely disabled veteran.
C. 
A copy of the current special registration plate for one passenger car or other vehicle with a registered gross weight of not more than 9,000 pounds, designating the vehicle so licensed as being used by the person with a disability or severely disabled veteran pursuant to § 1338(a) of the Pennsylvania Motor Vehicle Code, 75 Pa. C.S.A. § 1338(a).
3. 
Review. In considering whether to grant new applications for the erection of a sign or signs from a person with a disability or severely disabled veteran under the provisions of this section, the Accessible Parking Committee shall consider:
A. 
The completeness and accuracy of the application;
B. 
The number of assigned accessible parking spaces within a one-block radius of the applicant's address at the time of the application;
C. 
The applicant's access to off-street parking, including, but not limited to, a garage, driveway, parking pad, or any other lawful parking area available for the applicant's use; and
D. 
Any other reasonable considerations that the Accessible Parking Committee deems appropriate that impact the health, safety and welfare of the Borough.
4. 
Approval. The Accessible Parking Committee will notify the applicant of approval of the application in writing. Once approved, the Borough will erect an accessible parking sign on the highway as close as possible to the address listed on the application indicating that the parking place is reserved for a person with a disability or severely disabled veteran, that no parking is allowed by others, and that any unauthorized person parking there shall be subject to a $50 fine or may be towed, pursuant to the provisions of § 3354(d) of the Pennsylvania Motor Vehicle Code, 75 Pa. C.S.A. § 3354(d). If the Accessible Parking Committee deems it appropriate, the sign may be erected to limit parking to the registered vehicle of applicant only.
5. 
Denial. The Accessible Parking Committee shall have the authority to deny applications after review and evaluation of the criteria under Subsection 3. The Committee shall send a denial letter to the applicant at the address listed on the application explaining the reason for the denial. The application will be deemed denied and no further action will be taken by the Borough.
6. 
Appeals. Any applicant who receives a denial letter or revocation letter from the Accessible Parking Committee may request an appeal of the denial. An appeal must be submitted, in writing, to the Borough Manager and must clearly state the reasons why the applicant disagrees with the denial. The written appeal shall be reviewed by the Accessible Parking Committee and all members of the Borough Council. Upon review, the Borough Council will vote to either grant the appeal and approve the application or deny the appeal and maintain the denial of the application. Appeals are limited to one per application only.
7. 
Change in eligibility. In the event there is a material improvement in the physical condition of the resident with an approved accessible parking sign to the extent that the resident would no longer qualify under the criteria set forth herein, the resident must notify the Borough, in writing, within 30 days of the change in condition. The Borough will remove the accessible parking sign and designated parking area, and all privileges associated with said sign will be deemed revoked.
8. 
Audit rights.
A. 
The Accessible Parking Committee shall have the right to audit any and all accessible parking spaces in the Borough at any time. An audit may include, but is not limited to:
(1) 
Investigating reports of misuse of an accessible parking space;
(2) 
Review of previously approved applications to determine changes in eligibility;
(3) 
Inventory accounting of all accessible spaces in the Borough; and
(4) 
Any other criteria that the Committee deems appropriate to oversee and administer the rules and regulations of this section.
B. 
At the conclusion of any audit, the Accessible Parking Committee may, at its discretion, revoke any accessible parking space based on the criteria above. The Committee shall send a revocation letter to the resident at the address listed on the application explaining the reason for the revocation. The resident will have 30 days from receipt of the letter to file an appeal pursuant to Subsection 6 of this section. Upon review of the appeal, the Borough Council will vote to either grant the appeal and retain the accessible parking space or deny the appeal and revoke the accessible parking space. Appeals are limited to one per revocation letter only.
It shall be unlawful for any person to stop, stand or park a vehicle (other than a pedalcycle) on the roadway side of any vehicle stopped or parked at the edge or curb of any street, except that standing or parking for the purpose of loading or unloading persons or property shall be permitted on Monday through Saturday for no longer than is necessary for the loading or unloading.
No angle parking shall be permitted on any Borough street.

1. 
Resident parking permit. A resident of the Borough of Sharpsburg in possession of a valid driver's license will, upon application to the Borough and proof of residency, be issued a resident parking permit by the Borough. No fee shall be charged for this permit. Parking permits may be issued to all residents of the Borough of Sharpsburg and are not limited to those residents residing within a restricted permit zone.
2. 
Visitor parking permit. Residents of the Borough of Sharpsburg who have been issued a residential parking permit may, upon request, be issued a visitor parking permit at no charge. No more than two visitor parking permits may be issued to a residential unit. Visitor permits may not be used by residents of the Borough and may not be used by any vehicle for greater than three consecutive days.
3. 
Restricted permit zones. The following parking restrictions apply at the designated locations. No person without a valid permit shall park in those areas designated by the Borough as restricted permit zones, unless otherwise stated below:

Enforcement of restricted permit zones will be 6:00 a.m. to 6:00 p.m. Monday through Friday, excluding federal holidays.
4. 
Borough official parking permit. A parking permit shall be issued to Borough officials. A vehicle displaying a valid Borough official parking permit shall be permitted to park in any legal parking location while on official Borough business. "Borough officials" shall include the Mayor, Borough Council members, the Borough Manager, the Borough Solicitor, the Borough Zoning Officer/Building Inspector, the Borough Secretary, the Borough Engineer and/or Borough police officers.
5. 
Restricted permit zones and hours of enforcement may be changed from time to time by resolution of Sharpsburg Borough Council.
6. 
Enforcement of parking restrictions and regulations. Police officers and parking enforcement personnel of the Borough of Sharpsburg shall be authorized to enforce all parking restrictions and regulations within the Borough, acting in accordance with the directions of the Chief of Police.
It shall be unlawful for any person to park a vehicle or to allow the same to remain parked at any time between April 1 and December 1 on any of the following portions of the highways of the Borough of Sharpsburg on the days hereby respectively designated for street sweeping purposes:

1. 
General rule. Except when necessary to avoid conflict with other traffic or to protect the safety of any person or vehicle or in compliance with law or the directions of a police officer or official traffic-control device, no person shall:
A. 
Stop, stand or park a vehicle:
(1) 
On the roadway side of any vehicle stopped or parked at the edge or curb of a street, except that:
(a) 
Standing or parking for the purpose of loading or unloading persons or property may be authorized by local ordinance, but the ordinance shall not authorize standing or parking on state-designated highways except during off-peak traffic-flow hours as determined by Department regulations.
(2) 
Within an intersection.
(3) 
On a crosswalk.
(4) 
Between a safety zone and the adjacent curb within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by official traffic-control devices.
(5) 
Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.
(6) 
Upon any bridge or other elevated structure upon a highway or within a highway tunnel.
(7) 
On any railroad tracks.
(8) 
In the area between roadways of a divided highway, including crossovers.
(9) 
At any place where official signs prohibit stopping.
B. 
Stand or park a vehicle:
(1) 
In front of a public or private driveway or within three feet of a driveway entrance.
(2) 
Within 15 feet of a fire hydrant.
(3) 
Within 20 feet of a crosswalk.
(4) 
Within 30 feet upon the approach to any flashing signal, stop sign, yield sign or traffic-control signal located at the site of a roadway.
(5) 
Within 20 feet of the driveway entrance to any fire station or, when properly sign-posted, on the side of a street opposite the entrance to any fire station within 75 feet of the entrance.
(6) 
Where the vehicle would prevent the free movement of a streetcar.
(7) 
On a limited-access highway unless authorized by official traffic-control devices.
(8) 
At any place where official signs prohibit standing.
C. 
Park a vehicle:
(1) 
Within 50 feet of the nearest rail of a railroad crossing.
(2) 
At any place where official signs prohibit parking.
2. 
Additional parking regulations.
A. 
Two-way highways. Except as otherwise provided in this section, every vehicle standing or parked upon a two-way highway shall be positioned parallel to and with the right-hand wheels within 12 inches of the right-hand curb or, in the absence of a curb, as close as practicable to the right edge of the right-hand shoulder.
B. 
One-way highways. Except as otherwise provided in this section, every vehicle standing or parked upon a one-way highway shall be positioned parallel to the curb or edge of the highway in the direction of authorized traffic movement with its right-hand wheels within 12 inches of the right-hand curb or, in the absence of a curb, as close as practicable to the right edge of the right-hand shoulder, or with its left-hand wheels within 12 inches of the left-hand curb or, in the absence of a curb, as close as practicable to the left edge of the left-hand shoulder.
3. 
Exceptions.
A. 
By resolution, the Borough Council may temporarily suspend the provisions of this Part requiring coin deposit in meters and establishing a maximum parking time at meters.
B. 
The Borough of Sharpsburg shall have authority to establish no-parking or special purpose parking zones within any parking meter zone and to remove parking meters from those areas as previously installed there, and the provisions of this Part shall not apply in those areas where no-parking or special purpose parking is in effect.
4. 
No-parking or special purpose parking zones.
A.

The Borough of Sharpsburg shall have the right to amend the list of no-parking or specific purpose parking zones specified in Subsection 4A from time to time via resolution of Borough Council.
No person shall park or leave unattended a vehicle along a highway or on public property without a valid registration plate and/or current certificate of inspection/inspection sticker.

The following fines shall be imposed for violations of this part:
1. 
As to metered parking, anyone who receives a ticket for a violation of metered parking, if paid within five business days of the date of the ticket, shall pay a total of $10 per violation. If not paid within five business days, but paid prior to the issuance of a citation, a $5 late fee will additionally be assessed. Upon issuance of a citation, the fine shall be $15 plus court costs.
2. 
As to any other violation within this part other than metered parking, any person who receives a ticket shall pay the sum of $20 if paid within five business days of the date of the ticket. If not paid within five business days, but prior to the issuance of a citation, a $5 late fee will additionally be assessed. If a citation is issued, the fine shall be in the amount of $20, plus court costs.
3. 
Provided it shall be the duty of the police officers and of parking enforcement personnel of the Borough of Sharpsburg to report to the appropriate official all violations of any provision of this part, indicating, in each case, the section violated; the license number of the vehicle involved in the violation; the location where the violation took place; and any other facts that might be necessary in order to secure a clear understanding of the circumstances attending the violation. The police officer or other person making the report shall also attach to or place upon every such vehicle a notice stating that the vehicle was parked in violation of this part. A separate offense shall arise for each hour or portion thereof in which a violation of this part is found to exist or each section of this part found to have been violated. Said fine may be amended from time to time by resolution of Borough Council.
