The Council of the Borough of Sharpsburg finds that the possession of alcoholic beverages in open containers in public places and the consumption of alcoholic beverages in public places is detrimental to the health, safety and welfare of the Borough of Sharpsburg, its citizens and its residents and contributes to the creation of nuisances.
As used in this Part 2, the following terms shall have the meanings indicated:
PUBLIC PLACE
Includes any public sidewalk, street, lane, highway, building, park, recreation area, parking lot or any other public property, or in any vehicle in or upon such area.
It shall be unlawful for any person to have, carry, transport or possess any beer, liquor, wine or any other alcoholic beverages in an open bottle or other open container in or upon any public place within the Borough of Sharpsburg.
It shall be unlawful for any person to drink, ingest or otherwise consume any beer, liquor, wine or any other alcoholic beverage in or upon any public place within the Borough of Sharpsburg.
No person shall discard any wine, liquor, beer or other alcoholic beverage containers upon any public place without express written permission of the Borough of Sharpsburg.
Upon receipt of a written request from any person or organization, Borough Council by official action may permit the possession and consumption of alcoholic beverages in a public place.

Any person, firm or corporation who shall violate any provision of this part shall, upon conviction thereof, be sentenced to pay a fine of not less than $50 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this part continues or each section of this part which shall be found to have been violated shall constitute a separate offense.
