All owners of property within the Borough of Sharpsburg having thereon either a commercial or residential dumpster, or both, shall locate said dumpster to the interior of a building or structure concealing same. If it is not feasible to locate said dumpster inside a building or structure, all said owners of property shall have installed around said dumpster screening materials hereinafter set forth below in this part in order to adequately and permanently enclose and conceal said dumpster from the view from any public streets and/or all adjacent residential areas. All dumpster enclosures, when not in use, shall be gated and locked. Further, all dumpsters shall be erected upon a concrete pad or asphalt surface.
The screening erected around a dumpster shall be constructed such that the fencing is at least two feet above the height of the top of the dumpster. The screening shall be made of durable construction materials, such as vinyl screening, to be installed in conformity with § 10-501 of this part.
All dumpsters must be located upon the property of the owner thereof and within the boundary lines of said property.
All owners of property shall install such screening around said dumpsters within 60 days of the effective date of this part.

All owners of property shall apply for a permit for a dumpster enclosure with the Borough Secretary of the Borough of Sharpsburg within 30 days of the effective date of this part. On January 1, 2000 and on every January 1 of every year thereafter, all owners shall apply to the Borough Secretary for an annual permit for a dumpster enclosure. No permit shall be issued until payment to the Borough Secretary in an amount established from time to time by resolution of Borough Council has been received and the Building Inspector approves in writing the application for a permit. The permit fee as stated herein shall not be prorated during the calendar year.
Any owners of property for whom compliance with the provisions of this part would create an undue hardship or burden may appeal to Borough Council for waiver from such requirements.

Any person, firm or corporation who shall violate any provision of this part shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this part continues or each section of this part which shall be found to have been violated shall constitute a separate offense.
