Any person in physical possession
and control of any animal shall remove excreta or other solid waste
deposited by the animal in any public or private area not designated
to receive such wastes including, but not limited to, streets, sidewalks,
parking lots, public parks or recreation areas and private property.
The provisions of this Section shall not apply to a guide dog accompanying
any blind person.
A person commits the offense of keeping
a dangerous wild animal if he or she keeps any lion, tiger, leopard,
ocelot, jaguar, cheetah, margay, mountain lion, Canada lynx, bobcat,
jaguarundi, hyena, wolf, bear, nonhuman primate, coyote, any deadly,
dangerous, or poisonous reptile, or any deadly or dangerous reptile
over eight (8) feet long, in any place other than a properly maintained
zoological park, circus, scientific, or educational institution, research
laboratory, veterinary hospital, or animal refuge.

It shall be unlawful for persons
to interfere with, resist, hinder or obstruct any member of the police
force or other designated individuals in the discharge of any duty
imposed upon them by this Chapter.

The City Clerk shall settle for all
money received by him/her under this Chapter in the same manner and
at the same time that said Clerk accounts for other money received
by him/her. All monies received under the provisions of this Chapter
shall be deposited in the General Fund of the City of Gallatin.

The parent or guardian of a minor
child, who is under the age of eighteen (18), is responsible for the
adequate care of any animal owned by or in the control of or harbored
by that minor child.

A. Any person, firm or corporation violating
any of the terms of this Chapter shall be deemed guilty of an ordinance
violation and shall be fined not more than five hundred dollars ($500.00)
or imprisoned for not more than ninety (90) days, or both such fine
and imprisonment.
B. Additional Penalties. If a person is adjudicated
guilty of the offense of animal neglect or animal abuse and the court
having jurisdiction is satisfied that an animal owned or controlled
by such person would in the future be subject to such neglect or abuse,
such animal shall not be returned to or allowed to remain with such
person, but its disposition shall be determined by the court.
