The position of Fire Chief for the Sharpsburg Volunteer Fire
Department shall be filled by appointment made by Borough Council
on a candidate nominated by the active members of the Sharpsburg Volunteer
Fire Department.
The nomination shall be made by a majority vote of the active
members of the Sharpsburg Volunteer Fire Department pursuant to the
bylaws of the Sharpsburg Volunteer Fire Department. The candidate's
name shall then be presented to Borough Council for appointment.
The Borough Council shall, by resolution, appoint the candidate nominated pursuant to the procedure set forth in §
7-302.
The Fire Chief, once appointed, shall have all the power, so far as the Borough has power to grant same, to enact rules and regulations to fulfill his function as Fire Chief. Neither this grant of power nor the appointment set forth in §
7-303 shall be construed as constituting the Fire Chief or the Sharpsburg Volunteer Fire Department as an agent, department or employee of the Borough of Sharpsburg.
The Fire Chief, once appointed, shall serve a term of two years
and is subject to removal at the discretion of Council; the Fire Chief
is also subject to removal by Council following a majority vote of
the active members of the Sharpsburg Volunteer Fire Department requesting
removal of the Fire Chief. The request for removal by the Sharpsburg
Volunteer Fire Department must by conveyed to Council, in writing,
prior to any action taken by Borough Council.
