[Adopted 4-30-1996 ATM by Art. 40 (Art. 34 of the 1922 Bylaws)]
The following definitions shall apply in this article:
COMMERCIAL ESTABLISHMENT
Any nonresidential building, including, but not limited to those used for retail, wholesale, industrial, manufacturing, dining, offices, professional services, automobile service, hotels and motels, restaurants or shipping and receiving areas.
NONPROFIT ORGANIZATION
An established organization or foundation dedicated to public service or culture, including, but not limited to, religious, educational, and health care functions.
OCCUPIER OF LAND
Any owner, lessee, occupier, user or tenant of any residential dwelling, town-owned building or public properties, or any nonprofit organization.
RECREATIONAL LAND USER
Any person who uses public land or other facilities in Easton for picnics, sports, political or private events or other gatherings.
RECYCLABLE MATERIALS
The following materials and such other materials as the Department of Public Works, Massachusetts Department of Environmental Protection or the Easton Board of Health may designate in the future.
A. 
For delivery to the Easton Recycling Center:
(1) 
Clean newspapers: newspapers which are uncontaminated by any chemical/waste product.
(2) 
Corrugated brown cardboard and brown grocery bags.
(3) 
Glass: all unbroken bottles and jars. No broken glass, window glass, dishes or crockery.
(4) 
Metal cans: tin, steel or aluminum; no pressurized aerosol cans; no cans which contained petroleum products.
(5) 
Plastics: all plastic containers/products designated by the Department of Public Works; no container which contained petroleum products.
(6) 
Ferrous metal and metal white goods (i.e., household appliances, pipes, metal doors, other metal doors, other large metal items).
(7) 
Tires, waste oil, automotive batteries and oil-based paint.
(8) 
Yard waste: leaves, grass clippings and shrub prunings; no tree branches, limbs or sticks.
RESIDENTIAL DWELLING
Any residential building, including single-family homes, apartment buildings, buildings containing cooperatives and condominiums, group houses, rooming houses or boardinghouses.
Each occupier of land in Easton must, before taking refuse to the Landfill, separate recyclable materials from the refuse and deliver those recyclable materials to the Recycling Center for collection in accordance with the requirements of the Department of Public Works and the Massachusetts Department of Environmental Protection. Any refuse brought to the landfill is subject to inspection to verify contents.
Anyone who fails to separate recyclable materials or otherwise fails to comply with the provisions of this article shall be subject to Chapter 50, Noncriminal Disposition of Violations, Article I, and shall be subject to a fine of $25 for the first violation, $50 for the second violation, and $100 for any subsequent violations.
For the purpose of this article, the "enforcing person" shall mean the Director of Public Works or his or her Designee(s).
If any section of this article is found to be invalid or unenforceable for any reason, the remainder of said article shall not be affected thereby but shall remain in full force and effect.
