A. 
The office of Borough Manager is hereby created.
B. 
The Borough Council retains the right to abolish the office of Borough Manager by ordinance at any time, by the affirmative vote of a majority of all of the members of Borough Council.
C. 
While said office exists, the Borough Council shall, from time to time and whenever there is a vacancy, elect by a vote of the majority of all of the members one person to fill said office.
The office of Borough Manager shall be filled on the first Monday of January in even-numbered years, at such time that the Borough Council is organized, and the Borough Manager shall serve, subject to dismissal provisions as set forth herein, until the Borough Council next organizes.
The Borough Manager must be a citizen of the United States of America and the Borough of Franklin Park. If the Borough Manager is not a resident of the Borough of Franklin Park at the time of appointment, he must become a resident within two years from the date of appointment. Residency in the Borough of Franklin Park shall be deemed a condition of continued employment. Failure to maintain residency within the Borough of Franklin Park shall subject the Borough Manager to dismissal. Council may waive the residency requirement upon good cause shown.
The salary of the Borough Manager shall be fixed by the Borough Council at the time and in the manner that salaries of other Borough employees are fixed and in accordance with the Table of Organization.[1]

Before entering upon the duties of Borough Manager, the Manager shall be bonded by the Borough, with a bonding company as surety to be approved by the Borough Council, in the sum of $50,000 or any other sum determined by Borough Council, conditioned on the faithful performance of his duties. The premium for this bond shall be paid by the Borough.
The Borough Manager shall be the chief administrative officer of the Borough and shall be responsible to the Borough Council for the proper administration of all of the affairs of the Borough and of the execution of all of the laws and ordinances of the Borough.
The duties and powers of the Borough Manager shall relate to the general management of all of the Borough business not expressly, by statute, imposed or conferred upon other Borough officers or representatives.
The Borough Manager shall be an individual with such technical and executive abilities and experience as to enable the Borough Manager to perform the duties imposed upon the office of Borough Manager in a successful and businesslike manner.
Subject to recall at any time by the Borough Council, the powers and duties of the Borough Manager shall include the following:
A. 
Execution and enforcement of the laws of the commonwealth and ordinances, resolutions and bylaws of the Borough Council.
B. 
Attendance at all meetings of the Borough Council and recommendations of such measures as the Borough Manager deems expedient. Attendance at all committee meetings when requested by the committee chairman.
C. 
A monthly report to the Borough Council, and at such other times as the Borough Council may direct, upon the affairs of the Borough, and the Borough Manager shall keep the Borough Council fully advised of the Borough's financial condition and its financial needs.
D. 
The preparation and submission of a preliminary budget to the Finance Committee at such time or times as directed by the Borough Council.
E. 
The preparation and submission to the Borough Council, before the end of any calendar year, of a proposed budget for the following calendar year.
F. 
Attendance to the securing of bids for the letting of contracts in due form of law and supervising the performance and faithful execution of the same, except insofar as such duties are expressly imposed upon some other Borough officer by statute.
G. 
Purchase of all supplies and equipment for the use of the office of Borough Manager and various departments and offices of the Borough. All expenditures made by the Borough Manager must be part of and included in the adopted annual budget. The Borough Manager is authorized to make emergency expenditures. The Borough Manager is also authorized to make unbudgeted but necessary expenditures below the base amount set by Section 1402 of the Borough Code[1] for which written or telephonic price quotations are not required. Any such expenditure shall be reported to Borough Council at the next regularly scheduled meeting.

H. 
Annually present to the Borough Council, not more than 30 days following the close of each calendar year, a correct and detailed statement and report of the preceding year's work of the Borough Manager's office and a detailed statement of all moneys received and expended.
I. 
Perform such duties as may be, from time to time by resolution or ordinance, conferred upon the Borough Manager.
J. 
Be responsible for the operation, repair and maintenance of the Borough's vehicles.
K. 
Be responsible for the maintenance, repair and upkeep of the physical equipment of the Borough.
L. 
Cooperate with the Borough Council, at all times, in all matters, so that the best interest of the Borough and the general public may be served and maintained.
Except for the purposes of inquiry, individual members of the Borough Council shall deal with the administrative services policy through the Borough Manager.
The supervisor of each operating department of the Borough shall be responsible to the Borough Manager. The operating departments of the Borough government shall include, but not be limited to:
A. 
Department of Police, general administration as it relates to purchasing and bidding for the Police Department but not involving the operation of the Department, except as directed by the Mayor.
B. 
General administrative offices.
C. 
Department of Building and Zoning.
D. 
Fire inspections.
E. 
Department of Parks and Recreation.
F. 
Golf course.
G. 
Treasurer's Office.
H. 
Department of Public Works.
I. 
Wage tax and other local tax collections.
The Borough Council shall have the right, at any time, to amend, modify or repeal the provisions of this chapter, or any part hereof, by ordinance, which shall be enacted by the affirmative vote of a majority of all of the members of the Borough Council.
The Borough Manager shall be responsible for the hiring of all nonsupervisory employees and shall make recommendations to the Borough Council for all other employees. Further, the Borough Manager will be responsible for the recommendation of dismissal for all employees responsible to him, when deemed necessary.
