[HISTORY: Adopted by the Village Board of the Village of Hales Corners as Ch. 2 of the Municipal Code. Amendments noted where applicable.]
A. 
Except as otherwise specifically provided in this code, the statutory provisions in Chapters 340 to 348 of the Wisconsin Statutes, describing and defining regulations with respect to vehicles and traffic, exclusive of any provisions therein relating to penalties to be imposed and exclusive of any regulations for which the statutory penalty is a fine or term of imprisonment, are hereby adopted and by reference made a part of this code as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this code. Any further amendments, revisions, or modifications of the statutes incorporated herein are intended to be made part of this code in order to secure uniform statewide regulation of traffic on the highways, streets and alleys of the State of Wisconsin.
B. 
Other laws adopted. There are also hereby adopted by reference the following sections of the Wisconsin Statutes, but the prosecution of such offenses under this chapter shall be as provided in Chapters 340 to 348 of the Wisconsin Statutes, and the penalty for violation thereof shall be limited to a forfeiture as provided in § 420-20 of this chapter:
(1) 
Section 941.01, Negligent operation of vehicle.
A. 
Duty of Director of Public Works to erect and install uniform traffic control devices. Whenever traffic regulations created by this code, including a State of Wisconsin traffic regulation adopted by reference in § 420-1, require the erection of traffic control devices for enforcement, the Director of Public Works shall procure, erect and maintain uniform traffic control devices, conforming to the Uniform Traffic Control Device Manual promulgated by the Wisconsin Department of Transportation, giving notice of such traffic regulations to the users of the streets and highways on which such regulations apply. Whenever state law grants discretion to local authorities in erecting or placement of a uniform traffic control device, devices shall be erected in such locations and in such a manner as in the judgment of the Director of Public Works will carry out the purposes of this code and give adequate warning to users of the streets and highways of the Village of Hales Corners.
B. 
Code numbers to be affixed to official traffic control devices. The Director of Public Works shall cause to be placed on each official traffic control sign, guide board, mile post, signal or marker erected under Subsection A a code number assigned by the Wisconsin Department of Transportation and shall also place or direct the placing of code numbers on all existing official traffic control devices as required by the laws of the State of Wisconsin.
C. 
Official Traffic Map.
(1) 
Official Traffic Map established. There is hereby established an Official Traffic Map for the Village of Hales Corners upon which shall be indicated no-parking areas, restricted parking areas, stop signs, arterial intersections, yield signs, special speed limits, one-way highways, school crossings, and all other restrictions or limitations contained in this code, as from time to time amended or modified by the Village Board, when the laws of the State of Wisconsin require the erection or use of official traffic control devices to enforce such restrictions or limitations.
(2) 
Violations prohibited. When official traffic control devices giving notice of the restrictions, prohibitions and limitations shown on the Official Traffic Map are erected and maintained in accordance with the provisions of this section, a violation of the restriction, prohibition or limitation shown on the Official Traffic Map shall be a violation of the provisions of this code.
(3) 
Map to be maintained. A copy of the Official Traffic Map shall be maintained and displayed in the office of the Police Department and Municipal Judge.
(4) 
Additions to map. The Village Board may from time to time make additions to or deletions from the Official Traffic Map, and the Chief of Police shall keep such Official Traffic Map current.
D. 
Prohibited signs and markers on highways. No person other than an officer authorized by this code to erect and maintain official traffic control devices or his or her designee shall place within the limits of any street or highway maintained by the Village of Hales Corners any sign, signal, marker, mark or monument unless permission is first obtained from the Village Board. Any sign, signal, marker, mark or monument placed or maintained in violation of this subsection shall be subject to removal as provided in Subsection E.
E. 
Removal of unofficial signs, markers, signals and traffic control devices. The Director of Public Works or designee may remove any sign, signal, marking or other device which is placed, maintained or displayed in violation of this code or state law.

The Village Board of the Village of Hales Corners hereby determines that the statutory speed limits on the following streets or portions thereof are unreasonable, unsafe, and imprudent, and modifies such speed limits as follows:
A. 
Speed limits increased. Speed limits are increased as follows upon the following designated streets or portions thereof:
(1) 
Thirty miles per hour:
(a) 
On West Grange Avenue between South 92nd Street and South 124th Street.
(2) 
Thirty-five miles per hour:

B. 
Speed limits on State Trunk Highway 24. The speed limits on State Trunk Highway 24 shall be as follows:
(1) 
Thirty-five miles per hour from Waukesha-Milwaukee County Line easterly to West Grange Avenue.
(2) 
Forty miles per hour from West Grange Avenue northeasterly to the east limits of the Village.
C. 
Speed limits on State Trunk Highway 100. The speed limits on State Trunk Highway 100 shall be as follows:
(1) 
Thirty-five miles per hour from a point 0.25 mile south of its intersection with West Forest Home Avenue north to its intersection with West Edgerton Avenue.
(2) 
Forty-five miles per hour from its intersection with West Edgerton Avenue north to the Village limits.
(3) 
Forty-five miles per hour from south Village limits north to a point 0.25 mile south of its intersection with West Forest Home Avenue.
D. 
Speed limits on County Trunk Highway OO. The speed limits on County Trunk Highway OO shall be as follows:

Thirty-five miles per hour.

F.

G. 
Operators to obey traffic control devices. Every operator of a vehicle approaching an intersection at which an official traffic control device is erected in accordance with this section shall obey the direction of such official traffic control device as required by the Wisconsin Statutes incorporated by reference in § 420-1 of this chapter. Operators of vehicles approaching a stop sign shall stop before entering a highway as required by § 346.46, Wis. Stats. Operators approaching intersections at which a yield sign has been installed shall yield the right-of-way to other vehicles as required by § 346.18(6), Wis. Stats.
A. 
Streets designated Class "B" highways. All highways within the Village of Hales Corners, Wisconsin, are hereby designated Class "B" highways subject to the weight limitations imposed on Class "B" highways by the Wisconsin Statutes adopted by reference in § 420-1 of this chapter except the following enumerated highways or parts of highways:
(1) 
State Trunk Highway 24.
(2) 
State Trunk Highway 100.
(3) 
County Trunk Highway OO.
B. 
Special and season weight limitations. The Director of Public Works shall have the authority to impose special or seasonal weight limits on any highway, bridge or culvert maintained by the Village of Hales Corners to prevent injury to the roadway or for the safety of the users of such highway, bridge or culvert and shall be responsible for erecting uniform traffic control devices giving notice thereof in accordance with the provisions of § 420-2 of this chapter.
C. 
Heavy traffic routes; restrictions on use of streets by heavy traffic. No person shall operate or move a vehicle, except a motor bus, which is not equipped with pneumatic tires or has a combined vehicle load weight exceeding 6,000 pounds on any street or alley not part of the state trunk highway or county highway system within the Village, except for the purpose of obtaining orders for, moving or delivering supplies or commodities to or from a place of business or residence facing thereon, provided that in no event shall the weight of vehicle and load on any street not defined or designated as a "heavy traffic route" exceed the limitations of the Wisconsin Statutes adopted by reference in § 420-1 of this chapter pertaining to Class "A" highways or deliveries on Class "B" highways.

Night parking restrictions.
(1) 
When signs have been erected at or reasonably near the corporate limits of the Village of Hales Corners as provided in § 349.13, Wis. Stats., no person shall park any vehicle for a period of time longer than 1/2 hour between the hours of 2:30 a.m. and 6:00 a.m.
(2) 
Determination of prohibited area. Any vehicle may be parked during such hours, provided it is completely off the paved roadway for a minimum distance of three feet, is parked within the publicly dedicated right-of-way, and is allowed to remain in such location at the sole risk of the owner or operator of the vehicle. The Village assumes no responsibility for any damages arising from such parking.
F. 
Miscellaneous parking restrictions.
(1) 
Parking in driveways. No person shall park or leave standing any motor vehicle in any private driveway without the permission of the owner or lessee of the property upon which such driveway is located, whether or not such driveway is posted to limit or restrict parking.
(2) 
Parking heavy vehicles in residential districts. No operator of a motor truck, truck-tractor, trailer, or semitrailer or any other vehicle or combination of vehicles other than motorbuses weighing more than 6,000 pounds shall park such vehicles on any highway other than a routed state trunk highway in any residential district except for such time as is reasonably necessary to facilitate the loading or unloading of the vehicle.
(3) 
Snow emergency parking restrictions. Whenever the Village President shall, by reason of heavy snowstorm or blizzard, proclaim a snow emergency pursuant to § 323.11, Wis. Stats., no person shall park, stop or leave standing any vehicle upon the streets or any portion of the streets during the hours set forth in said proclamation.
(4) 
No parking in fire lanes.
(a) 
No person shall park, stop or leave standing any vehicle, whether attended or unattended, at any time within a fire lane consisting of the following:
[1] 
The driveway between the front doors of the Village Fire Station and the public street.
[2] 
In such places properly designated and marked as ordered by the Fire Chief by authority granted in § 233-38 of the Code of the Village of Hales Corners.
(b) 
See § 233-13C prohibiting certain motor vehicle operation upon the Fire Department access drive.

(5) 
Parking near bus stops. No person shall park, stop or leave standing any vehicle, for any purpose, for a distance of 80 feet from any public bus stop sign.
(6) 
Parking restrictions near fire hydrant. No person shall stop or leave any vehicle standing with 10 feet of a fire hydrant which is on the City of Milwaukee water supply system, unless a greater distance is indicated by an official traffic sign, except temporarily for the purpose and while actually engaged in loading or unloading or in receiving or discharging passengers and while the vehicle is attended by a licensed operator so that it may promptly be removed in case of an emergency or to avoid obstruction of traffic.
(7) 
Parking near alley, private road or driveway. Parking is prohibited within four feet of the entrance to an alley or a private road or driveway.

(8) 
Parking near crosswalk. Parking is prohibited closer than 15 feet to the near limits of a crosswalk.

(9) 
Stopping, standing or parking prohibited in parking spaces reserved for vehicles displaying special registration plates or special identification cards.

(a) 
Handicap parking. Except for a motor vehicle used by a physically disabled person as defined under § 346.503(1), Wis. Stats., no person may park, stop or leave standing any vehicle, whether attended or unattended and whether temporarily or otherwise, upon any portion of a street, highway or parking facility reserved, by official traffic signs indicating the restriction, for vehicles displaying special registration plates issued under § 341.14(1), (1a), (1e), (1m), or (1q), Wis. Stats., or a special identification card issued under § 343.51, Wis. Stats., or vehicles registered in another jurisdiction and displaying a registration plate, card or emblem issued by the other jurisdiction which designates the vehicle as a vehicle used by a physically disabled person.
(b) 
Obstruct, block or limit use of handicap parking. No person may park, stop or leave standing any vehicle, whether attended or unattended and whether temporarily or otherwise, upon any portion of a street, highway or parking facility so as to obstruct, block or otherwise limit the use of any portion of a street, highway or parking facility reserved, by official traffic signs indicating the restriction, for vehicles displaying special registration plates issued under § 341.14(1), (1a), (1e), (1m), or (1q), Wis. Stats., or a special identification card issued under § 343.51, Wis. Stats., or vehicles registered in another jurisdiction and displaying a registration plate, card or emblem issued by the other jurisdiction which designates the vehicle as a vehicle used by a physically disabled person.
(c) 
Handicap access aisle. Notwithstanding Subsection F(9)(b), no person may park, stop or leave standing any vehicle, whether attended or unattended and whether temporarily or otherwise, upon any portion of a street, highway or parking facility that is clearly marked as and intended to be an access aisle to provide entry to and exit from vehicles by persons with physical disabilities and which is immediately adjacent to any portion of a street, highway or parking facility reserved, by official traffic signs indicating the restriction, for vehicles displaying special registration plates issued under §  341.14(1), (1a), (1e), (1m), or (1q), Wis. Stats., or a special identification card issued under § 343.51, Wis. Stats., or vehicles registered in another jurisdiction and displaying a registration plate, card or emblem issued by the other jurisdiction which designates the vehicle as a vehicle used by a person with a physical disability.
(10) 
Library parking lot restriction. Parking of vehicles in the library parking lot is restricted to library patrons only during normal operating hours.

G. 
Unlawful removal of parking citation. No person other than the owner or operator thereof shall remove a municipal parking violation citation from a motor vehicle.
H. 
Removal of illegally parked vehicles. Any vehicle parked or left standing upon a highway, street or alley or other public grounds in violation of any of the provisions of this code is declared a nuisance and a hazard to traffic and public safety. Such vehicle shall be removed by the operator, upon request of any police officer, to a position where parking, stopping or standing is not prohibited. Any police officer after issuing a citation for illegal parking, stopping or standing of an unattended vehicle in violation of this code is authorized to remove such vehicle to a position where parking is not prohibited. The officer may order a motor carrier holding a permit to perform vehicle towing services, a licensed motor vehicle salvage dealer or a licensed motor vehicle dealer who performs vehicle towing services to remove and store such vehicle in any storage garage or rental parking grounds or any facility of the person providing the towing services. In addition to other penalties provided by § 420-20 of this chapter, the owner or operator of a vehicle so removed shall pay the cost of towing and storage.

I. 
Registration record of vehicles as evidence. When any vehicle is found upon a street or highway in violation of any provisions of this code regulating the parking, stopping or standing of vehicles and the identity of the operator cannot be determined, the owner as shown by the ownership registration of the vehicle supplied by the Wisconsin Department of Transportation, or a comparable authority of any other state, shall be subject to appropriate penalty.
J. 
Penalties for parking violations.
(1) 
Notice to appear; submission of admission. Any person to whom a police notice or summons has been issued to appear at the police station for violating the provisions of this section or the provisions of any other ordinance regulating the stopping, standing, and parking on any street or alley may, within seven days after 6:00 p.m. on the day of the violation, deliver by mail or in person to the police station of the Village of Hales Corners a written admission and consent to judgment (hereinafter called "admission") signed by such person of the charges set forth in the notice or summons, together with his check, money order, or cash for $30, except that the amount for a violation of Subsection F(9) shall be $200. No violator of this section or such other ordinance shall be tried in court until after the time allowed the violator by this subsection for filing such admission has expired, unless the admission is signed by the defendant and filed as herein provided, in which case the trial shall be had as soon as possible. When a case is tried upon such admission, no witnesses shall be sworn for the prosecution or the defense. If after signing the admission the defendant at the time of trial insists that witnesses be sworn for the defense, the case shall immediately be adjourned to a day certain, and witnesses may be subpoenaed on behalf of the prosecution and the defense. The trial of the case shall then proceed in the usual manner, and the provisions of this chapter shall not apply.

(2) 
Failure to pay when due. Any person who fails to pay the stipulated forfeit penalty of $30 within seven days after 6:00 p.m. on the day of violation shall pay a stipulated forfeit penalty of $55 for a parking violation as hereinabove provided. Any person who fails to pay the stipulated forfeit penalty of $30 within 30 days after 6:00 p.m. on the day of violation shall pay a stipulated forfeit penalty of $75, which includes court costs, for a parking violation as hereinabove provided.

(3) 
Privilege of stipulation denied to repeated violators. The privilege of stipulation granted to violators by this chapter shall not be available to any person found guilty by stipulation or otherwise of four or more traffic violations during the 12 months preceding his last arrest.
The provisions of Chapter 423, Vehicle Storage, Sale, Repair and Abandonment, of this Code shall control the disposition of abandoned vehicles.

The operator of any vehicle involved in an accident resulting in injury to or death of any person, or property damage to an apparent total extent of $1,000 or more, shall within 10 days after such accident file with the Village of Hales Corners Police Department a copy of the report required by § 346.70, Wis. Stats. If the operator is unable to make such report, any occupant of the vehicle at the time of the accident capable of making such report shall have the duty to comply with this section. Such reports shall be subject to the provisions and limitations in §§ 346.70(4)(f) and 346.73, Wis. Stats.
A. 
Unlicensed operators prohibited. No person who does not hold a valid operator's license shall operate a vehicle in any public parking lot or in any private parking lot held out for the use of parking for the general public.
B. 
Traffic regulations applicable. All provisions of § 420-1 of this chapter and of the Wisconsin Statutes and laws incorporated herein by reference shall be applicable on any public parking lot and on any private lot held out for the use of the general public for parking or vehicular travel.
C. 
Motor vehicle registration. No person may park, operate or knowingly permit the parking or operation of a motor vehicle if the registration for that vehicle is expired, suspended, revoked or canceled.

D. 
Limitation on backing. The operator of a vehicle shall not back the same unless such movement can be made with reasonable safety.

E. 
Inattentive driving. No person while driving a motor vehicle may be engaged or occupied with an activity, other than driving the vehicle, that interferes or reasonably appears to interfere with the person's ability to drive the vehicle safely.

F. 
Stop signs in parking lots. Except when directed to proceed by a traffic officer, every operator of a vehicle approaching a stop sign in a parking lot shall cause such vehicle to stop before continuing past the stop sign and shall yield the right-of-way to other vehicles.

No person shall operate a snowmobile upon any street, highway or alley within the Village of Hales Corners in violation of the provisions of Ch. 350 or §§ 346.04, 346.05, 346.11, 346.14(1m), 346.18, 346.19, 346.20, 246.21, 346.26, 346.27, 346.33, 346.35, 346.37, 346.39, 346.40, 346.44, 346.46, 346.47, 346.48, 346.50(1)(b), 346.51, 346.52, 346.53, 346.54, 346.55, 346.87, 346.88, 346.89, 346.90, 346.91, 346.92(1) and 346.94(1) and (9), Wis. Stats.
A. 
Administrative regulations adopted. The administrative rules and regulations adopted by the Secretary of the Wisconsin Department of Transportation and published in Chapter Trans 305 of the Wisconsin Administrative Code, exclusive of any provisions therein relating to the penalties to be imposed, are hereby adopted by reference and made part of the code as if fully set forth herein.
B. 
Noncompliance prohibited. No person shall operate or allow to be operated on any highway, street or alley within the Village of Hales Corners a vehicle that is not in conformity with the requirements of Subsection A or the equipment provisions of Ch. 347, Wis. Stats., incorporated by reference in § 420-1 of this chapter.
C. 
Owner's liability. Any owner of a vehicle not equipped as required by this section who knowingly causes or permits such vehicle to be operated on a highway in violation of this section is guilty of the violation the same as if he or she had operated the vehicle. The provisions of § 347.04, Wis. Stats., relating to nonapplicability of demerit points, shall apply to owners convicted of violation of this section.
D. 
Safety checks.
(1) 
Operators to submit to inspection. When directed to do so by any law enforcement officer, the operator of any motor vehicle shall stop and submit such vehicle to an inspection and such tests as are necessary to determine whether the vehicle meets the requirements of this section, or that the vehicle's equipment is in proper adjustment or repair. No person, when operating a motor vehicle, shall fail to stop and submit such vehicle to inspection when directed to do so by any enforcement officer as herein provided.
(2) 
Authority of officer. Any law enforcement officer of the Village of Hales Corners is hereby empowered whenever he or she shall have reason to believe that any provision of this section is being violated to order the operator of the vehicle to stop and to submit such vehicle to an inspection with respect to brakes, lights, turn signals, steering, horns and warning devices, glass, mirrors, exhaust systems, windshield wipers, tires and other items of equipment.
(3) 
Vehicle to be removed from highway. Whenever, after inspection as provided by this section, a law enforcement officer determines that a vehicle is unsafe for operation, he or she may order it removed from the highway and not operated, except for purposes of removal and repair, until the vehicle has been repaired as directed in a repair order. Repair orders may be in the form prescribed by the Secretary of the Department of Transportation under § 110.075(5), Wis. Stats., and shall require the vehicle owner or operator to obtain such repairs as are required.
No person shall make unnecessary and annoying noises with a motor vehicle by squealing tires, excessive acceleration of engine, or by emitting unnecessary and loud muffler noises.[1]

A. 
Skateboards and roller skis.
(1) 
No person shall operate or ride a skateboard or roller skis:
(a) 
On any roadway.
(b) 
On any Village sidewalk or alley in any business district. For the purposes of this section, the business district shall be those areas zoned and used for business purposes.
(c) 
In any public parking ramp or public parking lot.
(d) 
On any public property where signs prohibit it.
(e) 
On any private property unless permission has been received from the owner, lessee or person in charge of that property.
(2) 
It shall be lawful for operators or riders of skateboards or roller skis to use this equipment on nonbusiness sidewalks and alleys, provided they yield the right-of-way to pedestrians using Village sidewalks and do not otherwise endanger or interfere with pedestrian traffic on those sidewalks and yield the right-of-way to vehicles using the alleys. Notwithstanding any other provision herein, it shall be unlawful for any operator or rider of such skateboard or roller skis to use a skateboard or roller skis on any public property, street, alley, sidewalk or other public right-of-way later than 1/2 hour after sunset or 1/2 hour before sunrise.
A. 
Findings and purpose. It is hereby found that a threat to the public health, safety and welfare arises from the congestion created by the repetitive unnecessary driving of motor vehicles, also known as "cruising," at certain times on certain highways within the Village of Hales Corners. The purpose of this section is to reduce the dangerous traffic congestion, as well as the noise, air pollution, obstruction of streets, sidewalks and parking lots, impediment of access to shopping centers or other buildings open to the public, interference with use of property or conduct of business resulting from cruising, and to ensure access for emergency vehicles to and through the said highways.
B. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
CRUISING
Driving a motor vehicle past a traffic control point on a highway in the designated area more than twice in any two-hour period between the hours of 8:00 p.m. and 5:00 a.m. Passing a designated control point a third time under the aforesaid conditions shall constitute unnecessary repetitive driving and cruising and, therefore, a violation of this section.
DESIGNATED AREA
South 108th Street from the north Village limits to the south Village limits; West Forest Home Avenue from the east Village limits to the south Village limits; and West Janesville Road from South 108th Street to the west Village limits.
TRAFFIC CONTROL POINT
A reference point within or adjacent to a designated area selected by a police officer for the purpose of enforcing this section.
C. 
Cruising prohibited. It shall be unlawful for anyone to engage in cruising. For the purposes of this section, the person having control or ownership of a motor vehicle shall be considered the person cruising, without regard as to whether that person was actually driving the motor vehicle each time it passed the traffic control point. Having control or ownership of a motor vehicle shall mean either the owner of said vehicle, if present in the vehicle at the time of the violation, or, if the owner is not present, the person operating the vehicle at the time of violation.[1]

D. 
Exclusions. This section shall not apply to:
(1) 
Any publicly owned vehicle of any city, county, state, federal or other governmental unit, while such vehicle is being used for the official purposes of said governmental unit.
(2) 
Any authorized emergency vehicle.
(3) 
Any taxicabs for hire, buses, or other vehicles being driven for business purposes.
E. 
Penalty. The penalties provided herein shall supersede the provisions of § 420-20 of this chapter, in the event of any conflict. Any person violating the provisions of this section shall forfeit:
(1) 
The sum of $50 upon the first conviction under this section within a one-year period.
(2) 
The sum of $100 upon the second conviction under this section within a one-year period.
(3) 
The sum of $200 upon the third and each subsequent conviction under this section within a one-year period.
The operator of a vehicle shall not turn his vehicle so as to proceed in the opposite direction upon a highway at any of the following places:
A. 
At all places set forth in § 346.33, Wis. Stats., with the addition of the following places where the Village expressly exercises its authority over a street within its corporate limits:
(1) 
On midblock or at any intersection on the roadway between the hours of 8:00 p.m. and 5:00 a.m.:
(a) 
On South 108th Street from the north Village limits to the south Village limits.
(b) 
On West Forest Home Avenue from the east Village limits to the south Village limits.
(c) 
On West Janesville Road from South 108th Street to the west Village limits.
A. 
Statutes specifically incorporated by reference. Whenever this code incorporates by reference specific sections of the Wisconsin Statutes, such reference shall mean the Wisconsin Statutes as of the adoption of this Code, as amended or renumbered from time to time.

B. 
General references. General references in this code to Wisconsin statutory sections or chapters describing or defining procedures or authority for enactment or enforcement of local traffic regulations shall be deemed to refer to the most recent enactments of the Wisconsin Legislature describing or defining such procedures or authorities.
This code shall be enforced in accordance with the applicable provisions of the Wisconsin Statutes and this section.
A. 
Applicable court procedures. Except where otherwise specifically provided by the laws of the State of Wisconsin or this code, the traffic regulations in this code shall be enforced in the Municipal Court of the Village of Hales Corners in accordance with the provisions of Ch. 800 and § 345.20(2)(b), Wis. Stats.
B. 
Citations.
(1) 
Uniform citation and complaint. The Wisconsin uniform traffic citation and complaint described and defined in the Wisconsin Statutes shall be used for enforcement of all provisions of this code except those provisions which describe or define nonmoving traffic violations and violations of §§ 346.71 through 346.73, Wis. Stats. Violations of §§ 346.71 through 346.73, Wis. Stats., shall be reported to the District Attorney, and the Wisconsin uniform traffic citation shall not be used in such cases except upon written request of the District Attorney.
(2) 
Parking citations. The Village Attorney shall recommend a citation for use in enforcing the nonmoving traffic regulations of this code. When approved by the Village Board of Trustees, such citation shall be used in enforcing the nonmoving traffic regulations created or adopted by this code, including violations of nonmoving traffic regulations defined and described in the Wisconsin Statutes adopted by reference in § 420-1 and all provisions of §§ 420-6, 420-9 and 420-10. The citation for nonmoving traffic violations shall contain a notice that the person cited may discharge the forfeiture for violation of a nonmoving traffic regulation and penalty thereof by complying with Subsection C(2) of this section. Nonmoving traffic citations may be issued by law enforcement officers or by civilian employees of the Police Department.

C. 
Deposits and stipulations.
(1) 
Uniform traffic offenses.
(a) 
Who may make. Persons arrested or cited for violation of moving traffic regulations created by this code shall be permitted to make deposits and stipulations of no contest or released by the arresting officer in accordance with the applicable provisions of the Wisconsin Statutes.

(b) 
Delivery or mailing of deposit and stipulation. The deposit and stipulation shall be delivered personally by the person cited or mailed to the office of the Hales Corners Police Department.
(c) 
Receipt required. The official or person receiving the deposit shall furnish and deliver or mail an original receipt for such deposit to the alleged violator and shall deliver the deposit and stipulation and a copy of the receipt within five days to the Village Treasurer.
(2) 
Nonmoving traffic offenses.
(a) 
Direct payment of penalty permitted. Persons cited for violation of nonmoving traffic regulations described and defined in this code may discharge the penalty thereof and avoid court prosecution by forwarding, within 10 days of the issuance of the citation, to the Police Department the minimum penalty specified for the violation. When payment is made as provided in this subsection, no court costs shall be charged.

(b) 
Court prosecution. If the alleged violator does not deliver or mail a deposit as provided in Subsection C(2)(a) within 10 days of the date of citation, the Chief of Police shall forward a copy of the citation to the Village Attorney for prosecution pursuant to law.
(c) 
Deposits returned to Treasurer. Officers receiving deposits for nonmoving traffic violations under this subsection shall pay over such deposits to the Village Treasurer within seven days of receipt. Such payment shall be accompanied by an itemized statement for each deposit of the offense charged and the name of the depositor.
A. 
Forfeiture penalty. The penalty for violation of any provision of this code shall be a forfeiture as hereinafter provided, together with the costs of prosecution and the penalty assessment imposed by § 757.05, Wis. Stats., where applicable. Payment of the judgment may be suspended by the sentencing judge for not more than 60 days. Any person who fails to pay the amount of the forfeiture, costs of prosecution and penalty imposed for violation of any provision of this code may, upon order of the court entering judgment therefor and having jurisdiction in the case, be imprisoned until such forfeiture, costs and assessment are paid, but not exceeding 90 days.
B. 
Other sanctions. Nothing herein shall preclude or affect the power of the sentencing court to exercise additional authorities granted by the Wisconsin Statutes to suspend or revoke the operating privileges of the defendant or to order the defendant to submit to assessment and rehabilitation programs or attend traffic safety school in addition to payment of a monetary penalty or in lieu of imprisonment.

C. 
Forfeitures for uniform traffic offenses. Forfeitures for violations of any traffic regulation set forth in the Wisconsin Statutes adopted by reference in § 420-1 of this chapter shall conform to the forfeiture penalty permitted to be imposed for violations of the comparable state statute, including any variations or increases for subsequent offenses; provided, however, that this subsection shall not permit prosecution under this code for any offense for which an imprisonment penalty or fine may be imposed upon the defendant.
D. 
Special local regulations. The forfeiture for violation of §§ 420-9, 420-10, 420-11, 420-12, 420-13 and 420-14 of this chapter shall be not less than $5 nor more than $200 for the first offense and not less than $10 nor more than $400 for the second offense within two years.
E. 
Other violations. The forfeiture for violation of any provision of § 420-1B of this chapter shall not be less than $50 nor more than $400. Violations of this chapter for which no other penalty is prescribed shall be subject to the penalty provided in § 1-4 of this Code.

F. 
Parking. The forfeiture for violation of parking regulations is in § 420-6J of this chapter.
G. 
Minimum forfeiture. Minimum forfeitures for violations of this code shall conform to and correspond to the Uniform State Traffic Deposit Schedule issued pursuant to § 345.26(2)(a), Wis. Stats., by the Wisconsin Judicial Conference, notwithstanding the provisions of this section.
