The Fire Chief shall maintain a written log of all fire alarms
received and equipment and/or personnel dispatched in response to
a fire alarm, noting the date and time of each said alarm. In the
case of a false burglar alarm, the investigating officer shall complete
a report noting all circumstances.
During each consecutive twelve-month period, it shall be unlawful
for any person, firm or corporation that maintains a fire or burglar
alarm system in the Township of Mine Hill to transmit more than one
false alarm in connection with the maintenance and operation of said
alarm system. All such persons, firms or corporations shall diligently
maintain their fire or burglar system alarm so as to avoid the transmission
of such false alarms.
The following penalties shall be imposed for the transmission
of false automatic fire or burglar alarms in excess of one false alarm:
A. There shall be a fine of $50 for the second false alarm during any
consecutive twelve-month period.
B. For all false alarms in excess of two but not in excess of four within
a consecutive twelve-month period, there shall be a fine of $100 for
each false alarm in excess of two during any such consecutive twelve-month
period.
C. For all false alarms in excess of four but not in excess of eight
within a consecutive twelve-month period, there shall be a fine of
$500 for each false alarm in excess of four during any such consecutive
twelve-month period.
D. For all false alarms in excess of eight false alarms within a consecutive
twelve-month period, there shall be a fine of not less than $500 nor
more than $2,000 and/or imprisonment for not more than 90 days and/or
90 days' community service, all in the discretion of the court,
for each false alarm in excess of eight during any such consecutive
twelve-month period.
Testing of alarms required by the Uniform Fire Code without
prior notice to the Police Department and the Fire Department shall
be considered false alarms.
