It shall be unlawful for any person, either as principal or
agent, or their servants or employees, to operate any business in
the City without first having procured a license from the City Clerk.
For purposes of this article, business is defined as any property
established for the conduct or operation of any trade, occupation,
work, commerce, or other activity owned or operated for profit by
any person within the City of Cushing.

Nothing in this article shall apply to the sale of agricultural
products raised in the state which are sold directly to the consumer
or to the merchants of the City by the person producing such agricultural
products.

Every person required by this article to be licensed shall apply
to the City Clerk for the license. The City Clerk shall cause the
application to be reviewed for compliance with all applicable zoning,
development, and other local, state and federal laws and regulations.
Upon satisfactory review, the City Clerk shall issue the license upon
payment of the required license tax.

A.
The
license taxes which shall be paid to the City pursuant to the provisions
of this article shall be as established by resolution.
B.
The
owner of any device taxed under this section and the person owning
or controlling the premises upon which it is placed shall be jointly
and severally liable for the tax.

All licenses required under this article shall expire on April
30 following their issuance.

A.
An
application for a business license may be denied for noncompliance
with applicable laws, ordinances and regulations.
B.
Violations
of applicable laws, ordinances or regulations may result in revocation
of a business license. Prior to any such revocation, the licensee
shall be provided with not less than 10 days' written notice
of the alleged violation and establishing a date for a hearing before
the City Manager to determine whether a violation has occurred and
to determine whether such license should be revoked. Such notice shall
be mailed, postage prepaid, to the licensee, at the licensee's
last known address.
C.
Any
person aggrieved in connection with the denial or revocation of a
license shall have the right to appeal to the Board of Commissioners.
Such appeal shall be taken by filing with the City Clerk, within 14
days after notice of the decision by the City Manager has been mailed
to such licensee's last known address, a written statement setting
forth the grounds for appeal. The Board of Commissioners shall set
the time and place for a hearing of such appeal and notice of such
hearing shall be given to the licensee in the same manner as provided
in this section for notice of hearing on revocation.
