[Code 1974 § 20-45; Code 1985 § 24-146;
Code 2005 § 106-221]
A. Any person driving a vehicle on a highway shall drive the vehicle
at a careful and prudent speed not greater than nor less than is reasonable
and proper, having due regard to the traffic, surface and width of
the highway and any other conditions then existing, and no person
shall drive any vehicle upon a highway at a speed greater than will
permit him to bring it to a stop within the assured clear distance
ahead.
B. No person shall drive any vehicle or combination of vehicles with
solid rubber or metal tires at a speed greater than the 10 miles per
hour.
C. The driver of every vehicle shall, consistent with the requirements of Subsection
A of this section, drive at an appropriate reduced speed when approaching and crossing an intersection or railway grade crossing, when approaching and going around a curve, when approaching a hillcrest, when driving upon any narrow or winding roadway, and when special hazard exists with respect to pedestrians or other traffic, or by reason of weather or highway conditions.
[Code 1974 § 20-45(b); Code 1985 § 24-147;
Code 2005 § 106-222]
Except when a special hazard exists that requires lower speed
for compliance with law or ordinance, the limits specified in this
chapter, or established as authorized in this chapter shall be maximum
lawful speeds, and no person shall drive a vehicle on a highway at
a speed in excess of such maximum limits as follows:
(1) Vehicles shall not be driven at a greater speed than 30 miles per
hour upon any street or highway within the limits of the City, except
when it is declared and determined upon the basis of traffic investigation
in the ordinances of the City, that certain speed regulations shall
be applicable upon specific streets or in certain areas, in which
event it shall be unlawful for any person to drive a vehicle at a
speed in excess of any speed so declared by proper authority when
signs are in place giving notice thereof.
(2) Vehicles shall not be driven in any school zone in excess of 20 miles
per hour between the hours of 8:00 a.m. and 4:30 p.m. each and every
day school is in session, unless otherwise posted.
[Code 1985 § 24-148; Code 2005 § 106-223]
No person shall operate a vehicle in an alley at a speed in
excess of 15 miles per hour.
[Code 1985 § 24-149; Code 2005 § 106-224]
A. No person shall drive a motor vehicle at such a slow speed as to
impede the normal and reasonable movement of traffic except when reduced
speed is necessary for safe operation or in compliance with law.
B. Whenever the state, the City or other local authority has determined
on the basis of an engineering and traffic investigation that slow
speeds on any part of a highway consistently impede the normal and
reasonable movement of traffic, no person shall drive a vehicle below
such speed except when necessary for safe operation or in compliance
with law.
[Code 1985 § 24-150; Code 2005 § 106-225]
A. No person shall operate any motor-driven cycle or any motor scooter, at any time, at a speed greater than 35 miles per hour. However, all motor-driven cycles and motor scooters shall at all times conform to §
19-65A.
B. As used in this section, the term "motor-driven cycle" shall mean
every bicycle with motor attached, and every motor scooter with wheel
diameters 12 inches or less, measured from one side of the rim to
the other.
[Code 1985 § 24-151; Code 2005 § 106-226]
A. No person shall drive a vehicle over any bridge or other elevated
structure constituting a part of a highway at a speed which is greater
than the maximum speed which can be maintained with safety to the
bridge or structure, when the structure is signposted as provided
in this section.
B. Where any state or federal highway shall be under construction or
repair or a detour shall have been designated by reason of construction
or repairs in progress and the state department of transportation
shall have determined a maximum safe, careful and prudent speed on
the highway or detour during the period of the construction or repairs
and shall have plainly posted at each terminus thereof and at not
less than each half mile along the route thereof the determined maximum
speed, no person shall drive any vehicle upon the portion of the highway
or upon the detour at a speed in excess of the speed so determined
and posted. Violation of the posted speed limit in the maintenance
or construction zone shall result in the doubling of the appropriate
fine. For purposes of this section, the term "maintenance or construction
zone" means any location where maintenance or construction work is
actually in progress and workers present.
C. Upon the trial of any person charged with a violation of this section, proof of the determination of the maximum speed by the state department of transportation and the existence of the signs shall constitute conclusive evidence of the maximum speed which can be maintained with safety as provided in Subsection
B of this section.
