A.
Subject to limitations imposed under state law, if any, a violation of any provision of this chapter shall be punishable by a fine of not more than $500 for the first offense, not more than $750 for the second offense and not more than $1,000 for the third or subsequent offense committed within one year. As per Subsection B, such fines may be increased by the court in the court's discretion upon conviction following a failure to appear in response to an appearance ticket or summons. In addition, punishment by imprisonment for not more than 30 days may be imposed for any violation.

Notwithstanding the limitations and discretion imposed by Subsection A the penalty for a violation of Babylon Village Code § 343-20A(2)(a) shall be a minimum of $250 for the first offense, and shall be a minimum of $500 for the second offense committed within one year. For any subsequent violation, the fine shall be at the discretion of the Court.
B.
Subject to limitations imposed under state law, if any, the registered owner or operator who fails to answer an appearance ticket or summons, as the case may be, on or prior to the assigned court return date as set forth in the appearance ticket or summons shall be subject to increased penalties.
(1)
Failure to answer an appearance ticket within 30 days of the date of the offense will result in the fine being doubled.
(2)
Failure to answer an appearance ticket within 60 days of the date of the offense will result in added penalties in addition to the doubled fine.
(3)
Failure to answer an appearance ticket within 90 days of the date of the offense will result in additional maximum penalties being added to the doubled fine.

In addition, failure to answer an appearance ticket or summons may result in one or more of the following:

In addition to other provisions of this chapter, the state, county or local police or law enforcement agencies who shall enforce the provisions herein, including those specified in Chapter 343, Article XII, § 343-82D, may immediately impound any vehicle being operated or found to be illegally parked, abandoned, or unattended in a place in violation of this chapter. Such impounded vehicles shall be stored as directed by the Village of Babylon. No vehicle impounded under this chapter shall be released to the owner or operator without the satisfaction of outstanding summonses, impound fees and storage fees.
D.
The provisions of this chapter shall be enforced by the Village of Babylon special service attendants and/or by the Code Enforcement Officer and/or by the Suffolk County Police Department.
