A. It is the intent and purpose of this Article to establish minimum
requirements for the design and construction for off-street parking
and loading areas:
1.
Plans And Approval Required. Plans detailing the proposed layout
and design of all required off-street parking and loading areas shall
be submitted to the Zoning Officer as part of the application process
for a zoning action as described in the Zoning Order or Subdivision
Regulations.
2.
Amortization Of Certain Off-Street Parking Requirements. Off-street
parking spaces that serve sales display lots which are not improved
to the standards of these regulations, shall be brought into compliance
no later than January 1, 2009, under conditions noted below for surfacing
design.
3.
Off-street parking and loading space shall be provided for all
new buildings and structures; and in additions to existing buildings
or structures in non-residential districts. Off-street parking and
loading space shall be required for any existing building or structure
which is altered in any manner so as to enlarge or increase capacity
by adding or creating dwelling units, guest rooms, floor area, or
seats. Existing parking area previously required shall not be used
to satisfy required off-street parking for any new structures or additions
to existing buildings, structures, or uses of land. Such existing
parking space shall be maintained and shall not be reduced so long
as the main building, structure or use remains, unless an equivalent
number of such spaces are provided elsewhere as provided in this Article.
4.
Exceptions By Special Use Permit. In order to provide off-street
parking areas, the County Commission may, after public notice and
hearing, grant a Special Use Permit for the establishment of parking
areas in any zoning district under the provisions set forth in the
Article providing for Special Use Permits. The Planning Board shall
recommend the improvements needed to protect adjacent property owners
and the public interest, and to comply with the provisions of this
Article.
5.
Violations of any of the regulations of this Article are regulated
as defined in the Zoning Administration Article of this Zoning Order.

A. The following specific requirements shall be required for new installations
of parking:
1.
Parking shall not be permitted closer to any side property line
than one-half (1/2) the distance of the required side yard.
2.
Off-street parking shall be considered as an accessory use to
the principal land use for which the parking is provided. Parking
not located on the same tract on which the main use is located must
be located within the zoning district in which parking or storage
lots are permitted as a main use; or located in accordance with the
provisions of this Article relating to off-street parking exceptions.
3.
Off-street parking required by this Article shall be located
no more than three hundred (300) feet, as measured along lines of
public access, from the use which it serves.
4.
Standard off-street parking spaces shall be at least nine (9)
feet in width and at least twenty (20) feet in length, exclusive of
access drives or aisles, ramps, columns, office or work areas. Spaces
which serve those with disabilities shall be as required in the American's
With Disabilities Act as currently amended, in terms of size, construction
and identification.
5.
Each required off-street parking space shall open directly upon
an aisle or driveway of such width and design as to provide safe and
efficient means of vehicular access to such parking space.
6.
Off-street parking spaces shall comply with such design standards
relating to curb lengths, stall depth, driveway width, island width,
barriers, and ingress and egress as described in this Zoning Order
or the Subdivision Regulations, or as may be established from time
to time by the County Commission.
7.
All open off-street parking and loading areas, including open
sales lot areas devoted to the sale, display, and rental of automobiles,
trucks, trailers or manufactured home sales and rental lots, shall
be graded and paved with a hard surface of asphalt or concrete in
conformance with the current American Public Works Association standards
and specifications and the requirements of the Federal Clean Water
Act regarding storm water pollution standards. Where conditions and
regulations permit, design standards utilizing pervious surfaces through
Best Management Practices acceptable to the County may be applied
at the discretion of the County.
8.
Any lighting used to illuminate off-street parking and loading
areas shall be minimal and not create a negative light pollution impact
on any adjacent residential properties and be directed away from the
residential use. Lighting installed as part of new construction shall
not create light pollution on adjacent residentially designated areas.
9.
No motor vehicle repair work or service of any kind shall be
permitted in association with any off-street parking facilities.
10.
Storage of supplies, materials, waste materials, or products
of the principal use shall not be stored in parking areas, or loading
areas for longer than the minimum period required to load or unload
service vehicles.
11.
Where loading areas are adjacent to other uses, or residential
where such operations create a negative impact on those adjacent uses,
as determined by the County, the loading area shall be provided with
a visual screening barrier to mediate the impact to the satisfaction
of the County.

A. Off-street parking spaces shall be provided in quantities, and with
required handicapped parking access and locations, as required by
the Building Codes currently adopted by the County, the Americans
with Disabilities Act and as follows. Commercial and Industrial Zoning
designations will generally require that parking and loading design
standards be established prior to any zoning action.
1.
Dwelling And Lodging Uses.
a.
Boarding Or Lodging Houses: One (1) parking space per occupant.
b.
Dormitories, Fraternities, Sororities: Two (2) parking spaces
for each three (3) occupants based on the maximum capacity of the
building as described by the Building Codes as adopted by the County.
c.
Hotels And Motels: One (1) space per each rental unit plus one
(1) space per each two (2) employees in the largest working shift;
and such spaces as are required for restaurants, assembly rooms, and
other facilities provided as part of the principal use.
d.
Manufactured Home Parks: One (1) parking space per each manufactured
home.
e.
Nursing Homes, Residential Care Facilities: One (1) parking
space per each two (2) beds based on the maximum capacity of the building
as described by the Building Codes as adopted by the County, plus
one (1) parking space for each employee.
f.
Single-Family And Two-Family: Two (2) spaces per dwelling unit.
g.
Multiple-Family: Two (2) spaces per dwelling unit.
2.
Business, Commercial, And Industrial Uses.
a.
Automobile, Truck, Trailer And Manufactured Home Sales And Rental
Lots: One (1) parking space for each three thousand (3,000) square
feet of open sales lot area devoted to the sale, display, and rental
of said vehicles, plus one (1) parking space for each service bay
and one (1) for each employee.
b.
Wrecking Yards: One (1) parking space for each employee, plus
one (1) parking space for each ten thousand (10,000) square feet of
storage area.
c.
Banks, Post Office, And Business And Professional Office: One
(1) parking space for each three hundred (300) square feet of gross
floor area.
d.
Medical And Dental Clinics Or Offices: One (1) parking space
for each one hundred (100) square feet of gross floor area.
e.
Funeral Homes And Mortuaries: One (1) parking space for each
ten (10) seats based upon the maximum capacity of the building as
described by the Building Codes as adopted by the County, plus one
(1) additional parking space for each employee and one (1) for each
vehicle maintained on the premises.
f.
Furniture And Appliance Stores, Household Equipment Or Furniture
Repair Shops: One (1) parking space for each four hundred (400) square
feet of floor area.
g.
Laundromats: One (1) space for each two (2) washing machines.
h.
Bowling Alleys: Four (4) parking spaces for each bowling lane.
i.
Cartage, Express, Parcel Delivery, And Freight Terminal Establishments:
One (1) parking space for each two (2) employees in the largest working
shift in a twenty-four (24) hour period, plus one (1) parking space
for each vehicle maintained on the premises.
j.
Car Wash: Three (3) holding spaces for each car-washing stall
plus two (2) drying spaces for each car-washing stall.
k.
Manufacturing, Production, Processing, Assembly, Disassembly,
Cleaning, Servicing, Testing Or Repairing Of Goods, Materials Or Products:
One (1) parking space per three (3) employees based upon the largest
working shift in any twenty-four (24) hour time period.
l.
Restaurants And Lounges: One (1) parking space for each two
and one-half (2.5) seats based on the maximum capacity of the building
as described by the Building Codes as adopted by the County; provided,
however, that drive-in restaurants shall have a minimum of at least
ten (10) parking spaces.
m.
Retail Stores And Shops: One (1) parking space per two hundred
(200) square feet of floor area.
n.
Theaters, Auditoriums, And Places Of Assembly With Fixed Seats:
One (1) space for each three and one-half (3.5) seats.
o.
Theaters, Auditoriums, And Places Of Assembly Without Fixed
Seats: One (1) parking space for each three (3) people based upon
the maximum capacity of the building as described by the Building
Codes as adopted by the County.
p.
Service Stations. One (1) parking space for each employee plus
two (2) spaces for each service bay.
q.
Warehouse, Storage, And Wholesale Establishments: One (1) parking
space for each two (2) employees based upon the largest working shift
in any twenty-four (24) hour period.
r.
All other business and commercial establishments not specified
above: One (1) parking space for each three hundred (300) square feet
of floor area.
3.
Other Uses.
a.
Churches: One (1) parking space for each (4) four seats based
upon the maximum designed seating capacity including choir lofts.
b.
Elementary, Junior High, And Equivalent Parochial And Private
Schools: Two (2) for each classroom.
c.
High Schools, Colleges, Universities, And Other Similar Public
Or Private Institutions Of Higher Learning: Eight (8) parking spaces
for each classroom, plus one (1) space for each two (2) employees.
d.
Hospitals: One (1) parking space for each two (2) beds plus
one (1) parking space for each resident or staff doctor plus one (1)
space for each two (2) employees based on the largest working shift
in any twenty-four (24) hour period.
e.
Nursery Schools And Day Care Centers, Public Or Private: One
(1) parking space for each employee.
f.
Private Clubs, Lodges, And Union Headquarters: One (1) parking
space for each three (3) seats based upon the maximum designed seating
capacity.
g.
Swimming Pools and Clubs: One (1) parking space for each one
hundred (100) square feet of water area.
h.
Trade And Commercial Schools: One (1) parking space for each
student and employee.

A. Loading and unloading space shall be provided off-street and on the
same premises with every building, structure or part thereof, hereafter
erected, established, or enlarged and occupied for retail operation,
hotel, mortuary, laundry, dry cleaning, office uses, warehousing,
manufacturing, and other uses, involving the receipt or distribution
of materials or merchandise. The loading and unloading space or spaces
shall be so located to avoid undue interference with public use of
streets, alleys, and walkways.

For each additional one hundred thousand (100,000) square feet
of gross floor area or any fraction thereof over one hundred thousand

shall be provided. Each such additional space shall be at least ten
(10) feet in width by seventy (70) feet in length.
