Animals Not To Run At Large. Hereafter no cattle, hogs, horses, mules, sheep, goats or other animals (other than dogs which are covered in Section 205.010) shall be permitted to run at large in the City limits, and all cattle, hogs, horses, mules, sheep, goats and other animals found running at large within the City limits shall be taken up by the City Marshal or other authorized person and placed in some secure enclosure or animal shelter designated by the Board of Aldermen.
Animals — How Taken Up And Sold. Whenever any of the animals mentioned in the preceding Subsection (A) shall be taken up by the Marshal or the Animal Control Officer, it shall be his/her duty to provide for and feed the same and shall give written notice of such taking up to the owner, if the owner be known; and provided if the owner be not known, or if notified fails or refuses to reclaim and make compensation for the taking up, feeding and keeping of such animal, then the Marshal or Animal Control Officer shall, three (3) days after the taking up, advertise the same for sale and sell the same at public auction to the highest bidder for cash, first giving at least ten (10) days' notice of the time and place of sale, and a description of the property to be sold by at least three (3) written or printed handbills posted in three (3) public places in the City of Memphis. Each animal sold as herein provided shall be sold separately, and the cost of taking up, keeping and selling any animal, as herein provided, shall be paid out of the proceeds of such sale; and when any animal is claimed by the owner, it shall be delivered to such owner upon the payment to the City Marshal of all the cost accruing at the time of such ownership being proven. All monies arising from such sale, after deducting the costs, shall be paid to the owner of any animal sold, upon satisfactory proof of ownership being made to the City Marshal by the claimant; and should no claim be made within thirty (30) days for proceeds of any sale by the owner or another for him/her, the same shall be paid to the City Treasurer, the cost being deducted therefrom and retained by the City Marshal. The City Marshal shall, upon any sale being made under this Article, give to the purchaser, upon the payment of the amount bid, a bill of sale in which it shall be stated the amount of costs and charges attending the proceedings and the price paid with a fair description of the animal sold, and such bill be prima facie evidence of the regularity of the proceedings and ownership of the animal.
The running at large of any domestic fowls of the species of chickens, ducks, geese, turkeys and guineas within the corporate limits of the City of Memphis, Missouri, be and the same is hereby declared a nuisance, and it shall be unlawful for any of the fowls of the species before enumerated to run at large within the corporate limits of this City, and all such fowls so found running at large within the corporate limits of this City in violation of this Section shall be taken up by the Marshal or Animal Control Officer and placed in a secure pen or pound provided for that purpose.
When any such fowl or fowls of the species mentioned in Subsection (A) of this Section shall be taken up and impounded under this Chapter and not claimed or redeemed within twenty-four (24) hours thereafter, the City Marshal shall sell the same privately at one of the public markets of said City, deduct from the fund so received the cost and expenses of impounding and selling of such fowl or fowls, and pay the balance of such fund into the City Treasury, filing a written statement with the City Clerk showing the number and kind of fowls sold, the price received, and the costs and expenses incident thereto. The owner of such fowls may, by making application to the Board of Aldermen and providing ownership of the fowls so sold, be entitled to the proceeds of said sale, less the amount of fees, costs and expenses incurred by the impounding and sale.
Any owner of any of the species of fowls mentioned in Subsection (A) of this Section who shall willfully permit such fowls to run at large within the corporate limits of this City shall be deemed guilty of an ordinance violation.
