The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
COMBUSTIBLE WASTE MATERIAL
Any material, including lawn trimmings, trees, shrubs, brush, boxes, paper, straw, leaves, sawdust, tire, plastics, solvents, flammable liquids, and all rubbish and refuse that will ignite through contact with flames of ordinary temperatures.
OPEN BURNING
The burning of combustible waste material which is kindled and maintained in whole or in part in the open air.
It is the purpose of this chapter to regulate open burning within the Village so as to protect the integrity of the air and promote the health, welfare and safety of the citizens of the Village.

The prohibitions of this chapter shall not apply to:
A. 
The burning of wood, charcoal or any other accepted fuel for the preparation of food in any form in an approved container or utensil manufactured for the purpose of food preparation while such container or utensil is being used in a safe and sanitary manner.
B. 
The use of approved gaseous or liquid-fired salamanders commonly employed in conjunction with building and construction operations while being used in accordance with accepted safety standards.
C. 
Roofers, tinners, plumbers or other mechanics pursuing a business requiring the use of fire or for the purpose of boiling tar, pitch, or oil used in the regular course of an appropriate business or trade and while being used in a safe and sanitary manner and conforming to all other applicable codes.
D. 
Ceremonial bonfires to be conducted at least 100 feet from any building.
E. 
Recreational burning. The burning of wood in an approved container made of noncombustible material that does not exceed three feet by three feet in size. The approved container must be placed at least 10 feet from any building structure, fence and/or property line. Flame height shall not exceed 24 inches at any time. All fires must be attended by an adult 18 years of age or older. Any fire that either annoys, disturbs, injures, or endangers the comfort, repose, health, peace, or safety of others is prohibited.
A. 
Required. Permits will be required for all burning under § 176-4D.
B. 
Application. Permit applications for § 176-4D must be obtained from the Village Manager's office at Village Hall and submitted 14 days prior to the planned event.
C. 
Investigation; report. The Village Manager will have appropriate departments investigate applications and report the findings to the applicant seven days prior to the planned event.
D. 
Fee. No fee will be charged for permits.

A violation of any section of this chapter is a misdemeanor punishable as provided in § 1-6 of the Village Code.
