No person, partnership, association or corporation shall make use of water supplied by the Catawissa Water Authority by means of a garden hose without such hose being equipped with a self-closing nozzle.
A water emergency shall exist whenever the Mayor, upon being advised by the Catawissa Water Authority that the existing water supply, taking into consideration the current rate of consumption thereof and the rate at which it can be replenished, may prove to be inadequate to supply the needs of the residents of the Borough, declares the same to exist.
The water emergency regulations set forth in § 333-4 of this article shall become effective 24 hours following the publication in a newspaper of general circulation within the Borough of notice that a water emergency exists and that certain specified uses of water are prohibited during the duration of the water emergency.
During a water emergency, the Mayor may prohibit the use of water supplied by the Catawissa Water Authority for any nonessential purpose, including, but not limited to, filling of swimming pools; watering of lawns and gardens; and washing of vehicles, houses, pavements and driveways.
A water emergency and the water emergency regulations set forth in § 333-4 shall continue in full force and effect until the Mayor, upon advice of the Catawissa Water Authority, declares the water emergency to be over and gives notice thereof in the manner provided in § 333-3 and/or by issuing a press release to local radio stations.

Any person who violates or permits a violation of this article shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the Borough correctional facility for a period not exceeding 10 days or to the county correctional facility for a period not exceeding 30 days. Each day that such violation exists shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this article in equity in the Court of Common Pleas of Columbia County.
The Borough of Catawissa shall not be liable for any damage or inconvenience suffered by any consumer of water supplied by the Catawissa Water Authority as a result of the implementation of any water emergency regulation promulgated hereunder.
