For the purposes of this article, the following words and terms shall have the meaning ascribed to them herein:
ENFORCEMENT OFFICER
The Nottingham Township Zoning Officer and/or any individual as designated by the Board of Supervisors shall be designated Enforcement Officers under this article.
PARKING
The stopping of a motor vehicle at any one place for a period in excess of one hour, except as provided for in § 390-4.
PUBLIC ROAD
A road surface, and/or berm of the road surface, if any; any road surveyed, laid out, opened, and used, under authority of law; or any road not of record which has been used for public travel and is maintained, kept and repaired by the expenditure of Township funds.
SNOW
Any precipitation depositing any accumulation on the streets, including snow, sleet, hail, ice, and freezing rain.
SNOW REMOVAL EMERGENCY
A state of street conditions that is hazardous and dangerous to vehicular and pedestrian traffic, as declared by the Board of Supervisors of Nottingham Township or such person designated by the Board of Supervisors.
A. 
Declaration of snow removal conditions. A snow removal emergency is hereby declared to exist in Nottingham Township whenever snow falls during any period of 24 hours or less to an accumulated depth of one inch or more, or requires plowing of snow, or at any other time when in the opinion of the Board of Supervisors of Nottingham Township, or such person designated by the Board of Supervisors, the street conditions are hazardous and dangerous to vehicular and pedestrian traffic because of snow accumulation. The Board of Supervisors of Nottingham Township, or such persons designated by the Board of Supervisors, shall have the authority, but are not required to, declare a snow removal emergency, notice of which shall immediately be issued to local radio and news services. In either instance, a snow removal emergency is presumed to continue for a period of 24 hours following the accumulation of snow or for a period of time as designated by the Board of Supervisors or their designee.
B. 
Unattended vehicles prohibited during emergency. During such time as a snow removal emergency is in effect, it shall be a violation of this article for any person, firm, organization or entity to park, abandon or leave unattended any vehicle on public roads and their adjacent right-of-ways within the boundaries of Nottingham Township.
C. 
Prohibition against blowing or dumping snow onto a public street. Blowing or dumping snow onto a public road by any person, firm, organization or entity is hereby prohibited.
The parking of any vehicle on any road within the legal boundaries of the Township of Nottingham is hereby prohibited during the hours of 2:00 a.m. to 6:00 a.m.
The parking of any vehicle at any time on any road within the legal limits of the Township of Nottingham that obstructs or interferes with the flow of vehicular traffic is prohibited.
A. 
Civil enforcement proceeding. The Nottingham Township Zoning Enforcement Officer may initiate by complaint or by such other means as provided by the Pennsylvania Rules of Civil Procedure a civil enforcement proceeding before a Magisterial District Judge and seek civil penalties for a violation of this article, which civil penalties imposed shall not be more than $600 per violation, plus court costs and reasonable attorneys fees incurred by the Township in the enforcement proceedings. Pursuant to 53 P.S. § 66601(c.1)(1), the Township shall be exempt from the payment of costs in any civil case brought to enforce this article.

B. 
Any vehicle left unattended on public roads and their adjacent rights-of-way within the boundaries of the Township of Nottingham may be towed at the discretion of the Enforcement Officer at the owner's expense.
C. 
Equitable and other remedies. No penalty herein shall prevent the Township from enforcing this article by equitable, injunctive and other remedies.
The provisions of this article shall be severable and if any provision hereof shall be declared unconstitutional, illegal or invalid, such decision shall not affect the validity of any of the remaining provisions of this article. It is hereby declared as a legislative intent of the Township that this article would have been amended as if such unconstitutional, illegal or invalid provision or provisions had not been included herein.
