A. 
State traffic laws. Except as otherwise specifically provided in this Code, the statutory provisions in Chapters 340 to 348, Wis. Stats., describing and defining regulations with respect to vehicles and traffic, exclusive of any provisions therein relating to penalties to be imposed and exclusive of any regulations for which the statutory penalty is a fine or term of imprisonment, are adopted by reference and made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this chapter. Any future amendments, revisions, or modifications of the statutes incorporated herein are intended to be made part of this chapter in order to secure uniform statewide regulation of traffic on the highways, streets, and alleys of the state.
B. 
State standards for motor vehicle equipment. The administrative provisions describing and defining standards for motor vehicle equipment in , Ch. Trans 305, Wis. Adm. Code, exclusive of any provision therein relating to the penalties to be imposed, are hereby adopted by reference and made a part of this chapter as if fully set forth in this section.
The statutory provisions in Chapter 350, Wis. Stats., describing and defining regulations with respect to the operation of snowmobiles, exclusive of any provisions therein relating to penalties to be imposed and exclusive of any regulations for which the statutory penalty is a fine or term of imprisonment, are adopted and by reference made a part of this section as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this section. Any further amendments, revisions, or modifications of the statutes incorporated herein are intended to be made a part of this section in order to secure uniform statewide regulation of snowmobile operation and maintenance on the highways, streets, avenues, and alleys of the Village. Each section number adopted by reference herein shall bear the same section number as the section of the Wisconsin Statutes adopted herein by reference.

Any forfeiture for violation of the Wisconsin Statutes adopted by reference in this chapter shall conform to the forfeiture permitted to be imposed for violation of such statutes as set forth in the Uniform Deposit and Misdemeanor Bail Schedule of the Wisconsin Judicial Conference, including any variations or increases for subsequent offenses, which schedule is adopted by reference.

Also hereby adopted by reference are the following sections of the Wisconsin Statutes but the prosecution of such offenses under this section shall be as provided in Chapters 340 to 348, Wis. Stats., and the penalty for violation thereof shall be limited to a forfeiture:
A. 
Section 941.01(1), Negligence Operation of Vehicle Off Highway.

No person shall within the Village:
A. 
Intentionally cause, by either rapid acceleration or deceleration, turning, swerving, cornering, or by any other means than the reasonable and prudent manner of operation, the tires of a motor vehicle to slide, skid or squeal;
B. 
Intentionally cause unnecessary acceleration, racing or revving of the motor of a vehicle or any other device to which a motor is attached while either parked, standing or moving so as to disturb or annoy the good order and quiet of the Village;
C. 
Intentionally use a horn otherwise than as a reasonable warning or make any unnecessary or unreasonably loud or harsh sound by means of a horn or other warning device.

No person shall operate a tractor or any other vehicle that has lugs on it, or any tracked vehicle, on any street or highway that has been treated with oil, or surfaced with asphalt, or with any material having in it asphalt or oil or any similar material.

Section 346.48(2)(b)2, Wis. Stats., adopted by reference by § 310-1 is hereby modified by this section pursuant to the authority granted by § 349.21, Wis. Stats.
B. 
Flashing red warning lights shall be used by school bus operators in a residence or business district of the Village when pupils or other authorized passengers are to be loaded or unloaded at a location at which there are no traffic signals and such persons must cross the street or highway before being loaded or after being unloaded, irrespective of whether or not there is a sidewalk and curb laid on both sides of the street or highway.

When official traffic signs and/or official yellow curb markings are placed so as to give notice thereof, no person shall park a vehicle for more than 10 minutes on the west side of Depot Street within the 200 block and within any officially designated parking space identified by means of such signs or markings during the hours when the lobby of the post office is open.
C. 
When official traffic signs and/or official yellow curb markings are placed so as to give notice of the limitation on parking provided for in this Subsection C and subject to the limitation on parking near the post office set forth in Subsection B, above, no person shall park, stop or leave standing any vehicle for more than 24 hours on the east side or west side of Depot Street between Railroad Street and Centre Street.

A. 
Weather emergency. The Village Board declares that certain weather-related events that require the removal of snow, ice, hail, sleet or other material which could compromise the safety of the motoring public and or pedestrians within the Village limits will prompt a declaration of a weather emergency. When a weather emergency is declared, all vehicles of any type must be removed from all streets within the Village within one hour from the time the weather emergency is announced. Notification to the public of a weather emergency will be as described in Subsection C. The emergency will exist for 24 hours, unless extended or cancelled sooner by the Director of Public Works, or their designee. The regulations of this section shall be controlling over any other ordinance which might be in any way conflicting.
B. 
Conditions triggering a weather emergency. A weather emergency may be declared by the Director of Public Works, or their designee, when it is determined that one or more of the following conditions exists:
(1) 
A snowfall has occurred of at least two inches in depth at a site to be determined by the Director of Public Works;
(2) 
Accumulation of slush, ice or other winter-weather related conditions that, at the discretion of the Director of Public Works, requires the declaration of a weather emergency;
(3) 
A declaration by the National Weather Service of any weather warning for the Village of Footville and its immediate vicinity, the result of which could compromise the safety of the motoring public and/or pedestrians.
C. 
Notice of declaration of weather emergency. When the Director of Public Works declares a Weather Emergency as defined in Subsection B above, the Director, or their designee, shall give notice to the public in the following manner:
(1) 
Place the date and time of the declaration on the public information web page of WCLO in Janesville.
(2) 
At the discretion of the Director of Public Works or their designee, the same information may also be distributed to other social media outlets controlled by the Village and/or Village Departments.
D. 
Vehicle removal. In case any vehicles are parked or left standing on any street in violation of this section, they shall be removed by or under the direction of the Village President after a reasonable effort has been made to notify the owner to remove such vehicle and it has not been removed. If the Village President is not available to try to reach the owner of any such vehicle within a reasonable time after the declaration of a weather emergency, then the Police Chief may direct the removal of such vehicle after making a reasonable effort to notify the owner to remove the vehicle and it has not been removed. In case such vehicle is removed by or at the direction of the Village President or Police Chief, the expense of such removal shall be charged against the owner of the vehicle. The removal of a car by or under the direction of the Village President or Police Chief shall not prevent prosecution for a violation of this section.

C. 
Failure to pay forfeiture within five days. If the alleged violator does not mail or file the amount of the forfeiture indicated on the citation within five days of the offense, a summons or warrant may be issued for him in the Footville Municipal Court.
D. 
Moving vehicle illegally parked. Whenever a vehicle is found standing upon a street in the Village in violation of any prohibition, limitation or restriction on parking, the Police Department is authorized to move such vehicle or to have such vehicle moved to a position where parking is not prohibited.
E. 
Parking citations. Citations for all nonmoving traffic violations in the Village of Footville shall conform to § 345.28, Wis. Stats., and shall permit direct mail payment or personal delivery payment of the applicable minimum forfeiture to the Police Department office within five days of the issuance of the citation in lieu of further court appearance. The issuing officer shall specify the amount of the applicable forfeiture as provided in this section.
F. 
Nonmoving violation procedure. The provisions of § 345.28, Wis. Stats., relating to the procedure to be followed for nonmoving traffic violations is hereby adopted and incorporated herein by reference as the procedure to be followed in the Footville Municipal Court.
G. 
Participation in Wisconsin DOT registration program. Pursuant to the provisions of § 345.28(4), Wis. Stats., the Village elects to participate in the nonmoving traffic violation and registration program of the Wisconsin Department of Transportation and to pay the costs established by the Department under § 85.13, Wis. Stats. Such costs shall, in turn, be assessed against persons charged with nonmoving traffic violations. The Clerk of the municipal court shall be responsible for complying with the requirements set forth in § 345.28(4), Wis. Stats.

A. 
Riding on roadways. No person shall ride on an electric personal assistive mobility device on any roadway within the Village of Footville having a speed limit of more than 25 miles per hour.
B. 
Riding on sidewalks.
(1) 
No person shall ride on an electric personal assistive mobility device on the following sidewalks within the Village or on the designated portions thereof:

Official signs shall be erected giving notice that riding on an electric personal assistive mobility device on such sidewalks, or portions thereof, is prohibited.
C. 
Regulations. Electric personal assistive mobility devices shall be operated within the Village in accordance with the provisions of Chapters 340 to 348, Wis. Stats., adopted by reference as part of this Municipal Code.
D. 
Use by disabled persons exempt. Use of an electric personal assistive mobility device by a person with a disability that limits or impairs the ability to walk, as defined in § 340.01(43g), Wis. Stats., is exempt from the requirements of this section.
E. 
Penalty. Any person who violates any provision of this section shall, upon conviction thereof, be subject to a forfeiture in the amount of $10 and the costs of prosecution.

A. 
Purpose. The purpose of this section is to establish All-Terrain Vehicle ("ATV") and Utility Terrain Vehicle ("UTV") routes in the Village and to regulate the operation of ATV/UTVs in the Village.
B. 
Authority. The Village Board of the Village of Footville, Rock County, Wisconsin, has the specific authority to adopt this ATV/UTV Routes and Regulations Ordinance under § 23.33(8)(b) and (11), Wis. Stats. The Village Board retains the right to close any Village road to ATV/UTV operation for any reason, including but not limited to special events, unlawful use, and road construction or repair. Said closures of Village roads to ATV/UTV use may occur without prior notice. The Village accepts no liability for the operation of ATV/UTVs on any Village road under the provisions of this section. Operation of ATV/UTVs is at the operator's own risk. ATV/UTV operators within the Village shall abide by all state, county, and local laws, and the applicable provisions of § 23.33, Wis. Stats., regulating ATV/UTV operations are adopted by reference and made part of this section.
C. 
Routes. The Village designates all Village-maintained streets within the Village as ATV/UTV routes except the following roads:
(1) 
All county roadways located in the Village are hereby designated as ATV/UTV routes only if approved by the Rock County Board of Supervisors, and all state highways in the Village are designated as ATV/UTV routes only if approved by the Wisconsin Department of Transportation.
(2) 
All authorized ATV/UTV routes shall be signed in accordance with § 23.33(8)(e), Wis. Stats. The Village, or its designee, shall maintain all route signs within the Village. Any restrictions on authorized routes shall be designated by majority vote of the Village Board and shall be marked/signed accordingly.
D. 
Operation of ATV/UTVs. All ATV/UTV operators on Village routes must comply with the following conditions of operation:
(1) 
ATV/UTV operators shall observe the lesser of posted roadway speed limits or 25 mph in the lane of travel.
(2) 
ATV/UTV operators shall ride single file.
(3) 
ATV/UTV operators are prohibited from riding on the shoulder of the road or in the ditch.
(4) 
ATV/UTV operators born on or after January 1, 1988, must have a valid ATV safety certificate and be at least 16 years of age.
(5) 
ATV operators between the ages of 12 and 15 must have a valid ATV safety certificate and be accompanied by a parent or guardian.
(6) 
ATV/UTV operators and riders under the age of 18 must wear a helmet.
(7) 
ATV/UTV operators cannot ride on any route from 12:00 midnight to 5:00 a.m., unless they are engaged in snow plowing.
(8) 
ATV/UTVs shall have headlights, taillights, and brake lights on while operating on any Village route and must operate with a muffler that falls within the legal decibel limits.
(9) 
ATV/UTV operators shall use hand signals if their machines are not equipped with turn signals.
(10) 
ATV/UTVs shall be registered with the Wisconsin Department of Natural Resources and have up-to-date stickers and license plates.
E. 
Enforcement. This section shall be enforced by any law enforcement officer authorized to enforce the ordinances of the Village of Footville and the laws of Rock County and/or the State of Wisconsin.
(1) 
Consistent with § 23.33(11)(b), Wis. Stats., the Village Clerk shall immediately send a copy of this section to the Department of Natural Resources, the Wisconsin State Patrol, the Rock County Sheriff's Department, and the Village of Footville Police Department.

F. 
Penalties. Wisconsin state ATV/UTV penalties as found in § 23.33(13)(a), Wis. Stats., are adopted by reference and made part of this section.

A. 
Seventy-two-hour limitation. No person, firm, or corporation shall park or leave standing any automobile, truck, tractor, trailer, or vehicle of any description on any public street or public parking lot in the Village for a period of 72 or more consecutive hours in the same location at any time, except that where more restrictive parking limits have been established, the more restrictive limits shall apply. When any law enforcement officer shall find a vehicle standing upon a public street or parking lot in violation of the provisions of this section, he is authorized to move such a vehicle or to require the operator in charge thereof to move such vehicle to a position permitted under this chapter. The law enforcement officer may cause said vehicle to be removed to a proper impoundment and storage area within the Village where storage space is available, and in such case the owner shall pay the costs of removing said vehicle and the storage fees on said vehicle before he may recover the possession thereof.
B. 
Posted limitations.
(1) 
In addition to the regulations set forth in § 310-10, the Village Board may designate certain streets or portions of streets as no parking or no stopping or standing zones or as zones for parking by physically handicapped persons and may limit the hours in which the restrictions apply. The Village shall mark, by appropriate signs, each zone so designated in accordance with the provisions of § 349.13, Wis. Stats.
(2) 
Except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device, no person shall stop or park a vehicle in an established no stopping or standing zone when stopping or standing is prohibited. No vehicle shall be parked in a no parking zone during hours when parking is prohibited except physicians on emergency calls or as permitted by state law or elsewhere by this code.
(3) 
The Chief of Police is hereby granted the authority, within the reasonable exercise of police power, to prohibit, limit the time, or otherwise restrict the stopping, standing, or parking of vehicles beyond the provisions of Ch. 246, Wis. Stats. The Chief of Police shall have the authority to restrict the turning or movement of heavy traffic and to impose special weight limitations on any highway or portions thereof which, because of the weakness of the roadbed due to deterioration or climatic conditions or other special or temporary conditions, would likely be seriously damaged or destroyed in the absence of any restrictions on heavy traffic movement or special weight limitations.
(4) 
No prohibition, restriction, or limitation on parking or restriction on movement or turning of heavy traffic and imposition of special weight limits is effective unless official traffic control devices have been placed or erected indicating the particular prohibition, restriction, or limitation.
(5) 
After the parking limitations on any given street have expired, any change of location of not more than one stall following expiration of the parking period allowed shall be and constitute a violation of this chapter.
C. 
Upon streets where stopping or parking is authorized or permitted, a vehicle is not lawfully stopped or parked unless it complies with the following requirements:

(1) 
Upon a street where traffic is permitted to move in both directions simultaneously and where angle parking is not clearly designated by official traffic signs or pavement markings, a vehicle must be parked parallel to the edge of the street, headed in the direction of traffic on the right side of the street.
(2) 
Upon a one-way street or divided street where parking on the left side of the road is clearly authorized by official traffic signs or pavement markings, vehicles may be parked only as indicated by the signs or pavement markings.
(3) 
Upon streets where angle parking is clearly authorized by official traffic signs or pavement markings, vehicles shall be parked at the angle and within the spaces indicated.
(4) 
In a parallel parking area, a motorcycle or moped may park at an angle. If parallel parking spaces are not indicated by pavement markings, no motorcycle or moped may be parked within two feet of another vehicle. Where a parallel parking space is indicated by pavement markings or where angle parking is authorized, up to three motorcycles or mopeds may park in the space.
(5) 
In parallel parking, a vehicle shall be parked facing in the direction of traffic with the right wheels within 12 inches of the curb or edge of the street when parked on the right side and with the left wheels within 12 inches of the curb or edge of the street when parked on the left side. In parallel parking, a vehicle shall be parked with its front end at least two feet from the vehicle in front and with its rear end at least two feet from the vehicle in the rear, unless a different system of parallel parking is clearly indicated by official traffic signs or pavement markings.
