For the purposes of this Article, the following words and phrases are defined as follows:
GUARDIAN
Guardian appointed by court of competent jurisdiction.
MINOR
Any person under the age of seventeen (17).
PARENT
The natural or adoptive father or mother, legal guardian or any other person having the care or custody of a minor child.
PARENTAL NEGLECT
Any act or omission by which a parent fails to exercise customary and effective control over a minor so as to contribute to, cause or tend to cause a minor to commit any offense.

A. 
Except as provided in Subsection (C) below, it shall be unlawful for any person under the age of sixteen (16) years to be in or upon any sidewalk, street, alley or public place in the City between the hours of 11:00 P.M. on Friday and Saturday and 5:00 A.M. on the day immediately following.
B. 
Except as provided in Subsection (C) below, it shall be unlawful for any person under the age of sixteen (16) years to be in or upon any sidewalk, street, alley or public place in the City between the hours of 10:00 P.M. Sunday through Thursday and 5:00 A.M. of the day immediately following.
C. 
Subsections (A) and (B) shall not apply when any person regulated herein is:
1. 
Accompanied by an adult having the care and custody of such person.
2. 
Attending or returning home from a function of any school or church.
3. 
Attending or returning home from a lawful entertainment, amusement or commercial activity.
4. 
On an emergency errand or specific business or activity directed by a parent, guardian or other adult having custody or care of such person.
5. 
Engaged in legitimate employment which requires such person's presence at the public places described in Subsections (A) and (B) during the prohibited hours.
6. 
On the sidewalk, street or alley directly adjacent to the building in which the person resides.
D. 
Any person who violates this Section, upon conviction, may be punished in accordance with Section 100.220 of this Code.
E. 
Violators will be dealt with as such:
1. 
First (1st) offense. Violator will be taken to the Police Station. Parents will then be notified to pick up the child.
2. 
Second (2nd) offense. Violator will be transported home and juvenile authorities shall be notified in writing.
3. 
Third (3rd) offense. Violator will be taken to the Police Station, parents will then be notified to pick up the child and juvenile authorities shall be contacted immediately.

A. 
A person commits the offense of failing to supervise a minor if the person is the parent, legal guardian or person with legal responsibility for the safety and welfare of a child under seventeen (17) years of age and the child has been found on private property or premises open to the public in violation of any provision of Reeds Spring Municipal Code.
B. 
It shall be a defense of failure to supervise a minor if the violation occurred solely on private property of the custodian. It shall be a further affirmative defense that the person:
1. 
Took reasonable steps to control the conduct of the child at the time the person is alleged to have failed to supervise, and
2. 
Reported the conduct of the child to the appropriate authorities.
C. 
In addition to any fine or penalty imposed pursuant to this Section, the court may order the person to pay any restitution to a victim of the minor's conduct. The amount of restitution ordered pursuant to this Section shall not exceed two thousand five hundred dollars ($2,500.00).
D. 
The first (1st) time a person is convicted of an offense described in Subsection (A) of this Section, the person shall not be required to pay a fine not exceeding one hundred dollars ($100.00) if the person successfully participates and completes a parent effectiveness program to the satisfaction of the court.
E. 
Except as found in Subsection (D) above, the offense described in this Section of failure to supervise a minor is punishable by up to a five hundred dollar ($500.00) fine and/or ninety (90) days in the County Jail, or both by fine and confinement.
