From and after the passage of this chapter it shall be unlawful
for any person, firm or corporation owning or having a present interest
in any real estate in the Borough of Larksville to permit or maintain
on the premises owned by it in the Borough of Larksville, within a
distance of 200 feet from any private dwelling, public building or
highway, any growth of weeds, grass or other rank vegetation to a
greater height than six inches or to permit any accumulation of dead
weeds, grass or brush of like height; provided, however, that this
section shall not apply to any vegetation that is edible or planted
for some useful or ornamental purpose. Any growth or accumulation
permitted contrary to this chapter is hereby declared a nuisance.
All weeds or other vegetation permitted to grow or to remain
contrary to the provisions of this chapter shall be cut and removed
by or under the direction of such person as Council may designate;
and the cost thereof, together with a penalty of 10% and interest,
shall be a lien against the property, which lien shall be filed and
recovery thereon made as provided by law for the collection of municipal
claims or by action of assumpsit; provided, however, that such removal
shall not be made more often than three times in any one year.

Any person, firm or corporation violating any provisions of this chapter shall, upon conviction in a summary proceeding before the Magisterial District Judge, be sentenced to pay a fine of not more than $300 and costs of prosecution and, in default of payment of such fine and costs, to be sentenced to imprisonment for not more than 30 days. For the purpose of this chapter, each day's violation of the provisions thereof, after the warning notice period of five days as set forth in §
139-4, shall be deemed to be a separate offense.
Prior to any action being taken by the Borough of Larksville
under any section of this chapter, a written notice shall be given
warning the person, firm or corporation violating any section of this
chapter to cut or remove such weeds or vegetation within five days
from receipt of said notice.
