Editor's Note: This local law was approved by a majority of
the qualified voters at an election held 11-7-2017.
This chapter is adopted pursuant to General Municipal Law Article
9-A of the State of New York and shall be known as "Games of Chance
Local Law of the Tow.n of Albion".
A.
The words and terms used in this chapter shall have the same meanings
as such words and terms and used in Municipal Law Article 9-A are
provided herein unless or unless the context requires a different
meaning.
B.
As used in this chapter, the following terms shall have the meanings
indicated:
- CHIEF LAW ENFORCEMENT OFFICER OF THE COUNTY OF ORLEANS
- The Orleans County Sheriff.
- TOWN OF ALBION
- Everything encompassed within the Town of Albion, County of Orleans, State of New York.
Pursuant to, and in accordance with, General Municipal Law § 188(1)
and other applicable provisions of the Laws of the State of New York,
it shall be lawful for any authorized organization, upon obtaining
a license therefor (as provided in General Municipal Law Article 9-A)
to conduct games of chance within the territorial limits of the Town
of Albion subject to the provisions of this chapter, the provisions
of General Municipal Law Article 9-A and the rules and regulations
set forth by the New York State Racing and Wagering Board. The conduct
of such games of chance shall be subject to the restrictions imposed
by General Municipal Law § 189. However, no games of chance
shall be conducted on Easter Sunday, Christmas Day or New Year's
Eve.
The powers and duties set forth in General Municipal Law § 194(1-2)
shall be exercised by the Chief Law Enforcement Officer of Orleans
County.
