The City of Kimmswick establishes the following City properties as municipal parks: Jefferson Square Park and Kimmswick City Hall Park. The City of Kimmswick further establishes that the following City properties shall be subject to the same rules and regulations as those set forth herein for municipal parks; Ross Fields, Fredmar Farms, Kimmswick and Rauschenbach Cemeteries, and Windson Harbor Park (the property south of Happies Marina). City properties that are subsequently designated as municipal parks shall be subject to all provisions of this Chapter as if specifically named herein.

Municipal parks shall be open to the public from sunrise to sunset seven (7) days a week. It shall be unlawful for any person to enter upon or use municipal park property after sunset and before sunrise unless such person obtains a special permit for a specified use. Park hours shall be clearly posted at the main entrance to each property.

It shall be unlawful for any person to enter upon on use any area, facility, or building within municipal park properties that is designated as "reserved" or "restricted" use unless such person on persons obtain a special permit for a specified use. Such designations shall be clearly posted at a conspicuous location on or near the designated area facility, or building.

It shall be unlawful for any person to drive or park on any area within a municipal park that is not a paved or gravel surface unless otherwise directed to do so by an authorized City official. For the purpose of this Chapter, authorized City officials shall be limited to the Public Works Director, Chief of Police, the Mayor or his/her designee. It shall be further unlawful for any person to abandon a motor vehicle on any municipal park property or to park a vehicle anywhere in a municipal park between sunset and sunrise. It shall be further prohibited for any person to operate an unlicensed motorcycle, tri-car, quad-runner or ATV at any location within a municipal park. The use of skateboards or razor-scooters shall be prohibited with the exception of areas designated and marked for such use.

It shall be unlawful for any person to bring a dog, cat, or other pet upon any municipal park property unless such animal is leashed. It shall be further unlawful for the owner of any dog, cat, or pet to allow such animal to stray, roam, or wander onto the property of any municipal park. Any person who brings a dog, cat, or other pet onto park property shall be responsible for "scooping" or otherwise disposing of any feces produced by such animal and failure to do so is hereby prohibited.

Littering, dumping or abandoning refuse within a municipal park shall be prohibited. Any person using park facilities shall be responsible for collecting and disposing of any rubbish or refuse they produce and failure to do so is prohibited.

The Mayor, Public Works Director, or the Chief of Police may issue temporary orders further restricting entry upon or use of municipal parks. Such temporary orders are to be conspicuously posted at or near the affected area. Such orders may restrict the use of alcohol during special events or in specific locations. It shall be unlawful for any person to violate such temporary orders.

It shall be unlawful for any person to ignite an open fire in a municipal park except for campers using designated bonfire areas. Under no circumstances are unattended fires allowed in municipal parks. During posted "no burn orders" issued by Fire Department or City officials, any open fires or bonfires are prohibited.

Special permits may be issued by the City Clerk or Public Works Director for the following uses upon remittance of the listed fees: pavilion rental: twenty-five dollars ($25.00); weddings/receptions: one hundred dollars ($100.00). It shall be unlawful to engage in any of the uses listed in this Section without a permit.

Any person who violates any portion of Sections 240.020 through 240.100 of this Chapter shall be guilty of an ordinance violation punishable by a fine of seventy-five dollars ($75.00) for the first such offense and one-hundred-fifty dollars ($150.00) for any subsequent offense.
