There shall be a Department of Human Services, the head of which shall be the Director.
The Department shall survey the quality of human life in the City with particular reference to conditions affecting health, recreation and welfare and the relationship of City services and functions to needs of the community. Within the limits of its legal authority and funds available to it pursuant to law, the Department shall organize and administer programs and activities designed to maintain and improve the quality of human life for those who live, work and visit within the City.
Within the Department there shall be a Council of Social Services.
A.
Composition; term; appointment. The Council shall be composed of not less than nine nor more than 15 members representative of the social agencies in the City, to be appointed by the Mayor. Each member shall serve for a term of two years and until the appointment and qualification of his successor.
B.
Duties. The Council of Social Services shall:
(1)
Study, evaluate and report on the scope, delivery and adequacy of the social services of the City.
(2)
Inventory and evaluate the labor, skills and needs and employment opportunities within the City and develop and recommend appropriate programs in relation thereto.
(3)
Advise and consult with the Mayor, Council and Director, as required, in relation to programs and procedures of the Department and proposed local legislation.
Within the Department there shall be a Division of Health, the head of which shall be the City Health Officer. Under the supervision of the Director, the division shall:
A.
Have all the functions, powers and duties of a local board of health under N.J.S.A. 26:1-1 et seq., except that as required by the Charter, the Council shall have and exercise all local legislative powers under that title.
B.
Plan and administer a comprehensive public health program, including, without limitation thereto, environmental sanitation, communicable disease control, child and adult health and health education, laboratory services, prevention and control of dangerous drug and narcotics abuse and other services as may be authorized by the Charter or ordinance.
C.
Administer and enforce the local health ordinances.
Within the Department there shall be a Health Advisory Council, composed of five member appointed by the Mayor, with the advice and consent of the Council. Each member shall serve for a term of five years, except that of those first appointed one shall be appointed for one year, one for two, one for three and one for four years. The Council shall advise and consult with the Director and Health Officer on matters of public health.

The Division shall survey the quality of human life in the City with particular reference to conditions affecting health, recreation and welfare and the relationship of City services and functions to needs of the community. Within the limits of its legal authority and funds available to it pursuant to law, the Division shall organize and administer programs and activities designed to maintain and improve the quality of human life for those who live, work and visit within the City. The Division shall also include the following functions and responsibilities:
A.
Administer and operate the City's athletic and recreational programs and activities for children and adults;
B.
Use and operate public school property, upon the approval and agreement of the Board of Education, to the extent that such property may be adaptable and available for recreational programs and purposes of the Division; and
C.
Plan and develop public recreation areas and facilities, promote and direct a year-round program of leisure activities for children, youth and adults of the City, stimulate the constructive use of leisure time of residents of the City, working toward the reduction of delinquency and the optimum coordination and development of the public recreational facilities within the City.

There shall be a Division of Cultural and Senior Affairs. The Division shall survey the quality of human life in the City with particular reference to conditions affecting the many cultures within the City of Passaic, as well as the welfare of the City's senior citizen residents and the relationship of City services and functions to needs of the community. Within the limits of its legal authority and funds available to it pursuant to law, the Division shall organize and administer programs and activities designed to maintain and improve the quality of human life for those who live, work and visit within the City. The Division shall also include the following functions and responsibilities:
A.
Sponsor and administer cultural affairs activities in cooperation with other public agencies and organizations;
B.
Sponsor and promote a wide variety of cultural events, including but not limited to concerts, art exhibits, festivals, literary events, historical events, dances, parades and other activities;
C.
Plan and administer a wide variety of culturally diverse events that promote the different cultures within the City of Passaic; and
D.
Work with the Cultural Affairs Advisory Committee to recommend different types of cultural events for the City.

A.
The Division may sponsor, arrange and provide for the giving of indoor and outdoor exhibitions, concerts, games and contests and may use and employ public property for such purposes. The Director shall get approval from the Mayor and other applicable licensing authority for all special events.
B.
The Division may charge and collect for the use of the City a reasonable admission fee for each person entering and using facilities, exhibits, concerts, games or contests provided under this article. The fees for the use of the facilities shall be as follows:

C. ADULTS NONPEAK MONTHS PEAK MONTHS TEENS YOUTHS
Definitions. As used in this section, the following terms shall have the meanings indicated:
For purposes of fees, shall be 18 years or older.
April to October.
November to March.
For the purpose of fees, means 13 through 17 years of age.
For the purposes of fees, means one to 12 years of age.

The Division shall control the use of all public parks, playgrounds and recreation places of the City so as to maintain them in a safe and wholesome condition of use. It may adopt suitable rules, regulations and bylaws for the conduct of all persons while on or using such property. The custodians and assistants supervised by the Superintendent shall, while on duty, preserve order and enforce the observance of the rules and regulations of the Division.

A. CITY-SPONSORED YOUTH PROGRAMS CRIMINAL HISTORY RECORD BACKGROUND CHECK YOUTH PROGRAMS
Definitions. As used in this section, the following terms shall have the meanings indicated:
Any programs sponsored by the City of Passaic, including any and all leagues, boards and commissions falling within the purview of, or acting for or on behalf of, the City of Passaic and having contact with persons under the age of 18 years.
A determination of whether a person has a criminal record by cross-referencing that person's name and other relevant information with those on file with the Federal Bureau of Investigation. Identification Division, and/or the New Jersey State Bureau of Identification in the Division of State Police.
Any programs that allow for participation in activities by those persons under 18 years of age. Activities may include, but are not limited to, sporting activities, passive recreation groups, clubs or camps and trips or other activities whereby some control and responsibility for children is assigned to some person acting for or on behalf of the City, other than a parent or caregiver.
B.
City-sponsored youth programs; background checks.
(1)
All adults, those persons 18 years of age or older, including but not limited to coaches, assistant coaches, or similar positions involved in educating, directing or supervising youth, and in any way assisting in a City of Passaic sponsored function participated in by children, shall submit sufficient information on forms supplied by the Passaic Superintendent of Recreation, Cultural and Senior Affairs from the New Jersey State Police for the purpose of obtaining a criminal history background check with the State Bureau of Identification in the New Jersey State Police. Applications for background checks shall be forwarded to the state by the City of Passaic Personnel Assistant.
(2)
The individual applying for the background check shall authorize the Passaic Department of Personnel to be the recipient of the affirmative or negative response from the State Police based upon the findings of the background check. Individuals involved in a City of Passaic sponsored youth function, and who are required to undergo background checks based upon this subsection, shall not be responsible for the costs involved with obtaining the criminal background check. The City of Passaic shall bear the costs for the background checks for individuals qualified under this subsection.
(3)
All league officers and/or those individuals in charge of each recreation program are required to ensure compliance with this subsection for that league or program. The president or leader of each recreation program shall file an annual roster of individuals that are required to participate in the background check procedures of this subsection. The roster shall be on forms supplied by the City of Passaic and shall contain a certification as to the accuracy and completeness of the roster and individual names. Any person who knowingly certifies a background check roster that excludes an individual required to be checked shall be in violation of this subsection and laws regarding false swearing. The rosters of coaches and lists of all City-sponsored recreation programs shall be certified by the Superintendent of Recreation, Cultural and Senior Affairs to be accurate and provided to the Personnel Department.
C.
Qualification. Individuals engaged in providing recreation opportunities for, or on behalf of, the City of Passaic shall be issued identification cards with appropriate expirations based upon the date of their individual background check. Individuals issued identification cards are required to display their card while in performance of their duty involving youth programs.
D.
Disqualification.
(1)
Upon receipt of a completed background check conducted by the State Bureau of Identification in the New Jersey State Police and/or the Federal Bureau of Investigation, Identification Division, the Passaic Personnel Department shall notify the applicant and the president or leader of the recreation program of affirmative or negative results. The determination of the Passaic Personnel Department is based upon § 5-113D(2) of this chapter. Details in the background check that result in a negative determination by the State Police are not afforded to the Passaic Personnel Department and are only available to the applicant upon making a formal request to the State Bureau of Investigation.
(2)
Disqualifying crimes or offenses.
(a)
In the event the criminal background check reveals any prior convictions for crimes or offenses which negatively impact the health, safety and welfare of children, said person shall not be qualified to participate in any official capacity in any function for persons under the age of 18 years that are sponsored by the City of Passaic Division of Recreation, Cultural and Senior Affairs. Such offenses shall include, but not be limited, in New Jersey, to any crime or disorderly persons offense:

Involving danger to the person, meaning those crimes and disorderly persons offenses set forth in N.J.S.A. 2C:11-1 et seq., N.J.S.A. 2C:12-1 et seq., N.J.S.A. 2C:13-1 et seq., N.J.S.A. 2C:14-1 et seq. or N.J.S.A. 2C:15-1 et seq.;
[b]
Against the family, children or incompetents, meaning those crimes and disorderly persons offenses set forth in N.J.S.A. 2C:24-1 et seq.;
[c]
Involving theft as set forth in Chapter 20 of Title 2C of the New Jersey Statutes; or
[2]
In any other state or jurisdiction, conduct which, if committed in New Jersey, would constitute any of the crimes or disorderly persons offenses described herein.
(b)
The list of crimes and violations contained herein is for illustrative purposes only and shall not be construed as a limitation on those criminal activities or violations that would be grounds to disqualify a person from assisting with youth-related activities as indicated herein.
(3)
Refusal by individuals required to submit to background checks will result in an immediate dismissal of the individual from any City-sponsored activities requiring background checks.
E.
Frequency of background checks.
(1)
All City-sponsored youth programs that have individuals subject to Subsection D shall direct those individuals to the Passaic Personnel Department for background checks prior to the individual being able to participate at any function sponsored by the City of Passaic. Thereafter, every three years, a new background check shall be submitted to the Passaic Police Department.
(2)
Individuals involved in City-sponsored youth programs who are required to undergo background checks shall be given an interim approval for participation only after submission to the Division of State Police for a background check. Interim approvals shall only be valid for the period of time that it takes to receive background checks results. Such interim approval shall not be valid for a period of time exceeding 90 days. Only one interim approval may be granted per individual.
F.
Privacy. Any and all criminal background checks supplied to the Passaic Personnel Department shall be filed and maintained in a secure and locked cabinet or room and shall not be available to the public. The Passaic Personnel Department shall take appropriate steps to safeguard such records. The records shall be exempt from public disclosure under the common law or the New Jersey Right-to-Know Law.[1] The records shall only be retained for such period of time as is necessary to serve their intended and authorized purpose.

The County of Passaic Board of Social Services has indicated its willingness to assume the functions of the General Assistance Program of the Division of Welfare for the City of Passaic at a substantial cost savings to the City of Passaic, as well as to integrate this program with other assistance programs operated by the Passaic County Board of Social Services.
A.
Abolishment of Local Assistance Board. Pursuant to the New Jersey Administrative Code, N.J.A.C. 10:90-12.9, which provides that a Faulkner Act municipality may abolish the Local Assistance Board by ordinance, the Local Assistance Board, as well as the Division of Welfare, within the Department is hereby abolished.
B.
Provision of services. The Passaic County Board of Social Services is hereby designated as the entity responsible for provision of all services and functions of the now-defunct Local Assistance Board for the City of Passaic in accordance with the statutes and regulations of the State of New Jersey and pursuant to agreement between the County of Passaic and the City of Passaic.
