The Honey Brook Borough Council finds and declares that stray
cats within the Borough may pose a danger to the health, safety, and
welfare of the public and may constitute a public nuisance. Accordingly,
it is the intent of this Part a) to ensure that owners shall exercise
proper care and control of their cats to prevent them from straying
and becoming a public nuisance, and b) to provide for penalties as
set forth herein.

An owner shall exercise proper care and control of his or her
cat to prevent it from becoming a public nuisance. It shall be unlawful
for the owner of any cat to permit it to cause annoyance to persons,
including habitually or continually howling or making loud noises,
or damage to persons or property, to trespass upon and litter or defecate
on any premises other than the owner's, or upon any of the sidewalks,
roadways or public grounds in the Borough.

Any person who shall violate any provision of this Part shall,
upon summary conviction before a District Justice, be subject to a
fine for each offense of not less than $100 and not more than $500
and the costs of prosecution and, in default of payment of such fine
and costs of prosecution, shall be sentenced to imprisonment of not
more than 30 days. Each day a violation shall remain shall constitute
a separate violation, and a violation of each section of this Part
shall be considered a separate offense.
