In the event of accidents (not of the property owner's fault) or natural disaster resulting in the destruction of buildings, structures, site, or area located within a Bath Historic District, the property owner is permitted to make temporary repairs or improvements to protect said property from further exposure to the elements and deterioration. However, all construction, repairs, or improvements of a permanent nature made to said property shall conform with this chapter.
The District Administrator shall serve a notice of violation on the legal entity or individual in violation of any part of this chapter, including but not limited to: failure to apply for a certificate of appropriateness or a building permit required for the erection, reconstruction, alteration, restoration, demolition, demolition by neglect, or razing of any building or structure which can be seen from a public way; and failure to comply with HARB approved work. Such notice shall direct the abatement of said violation.
The District Administrator or his designated representative shall have the power to institute any proceedings at law or in equity necessary for the enforcement of this chapter.

Any individual, corporation, or other legal entity, whether as property owner, occupant or contractor who fails to obtain a building permit or certificate of appropriateness pursuant to this chapter shall be fined, upon conviction therefor, not less than $100 but not more than $300 for each day the violation is unabated. In addition, court costs and reasonable attorney fees incurred by the Borough in enforcement proceedings shall be assessed against violator and awarded to the Borough.
