In order to protect the perceived development rights of properties located within the proposed expansion of the Aquifer Protection District, the Board of Health of the Town of Nantucket hereby adopts the below-noted Board of Health regulation in accordance with current nitrogen loading sciences.
A. 
"Exempted properties" shall be defined as undeveloped properties located outside the currently sewered areas, and within the Wellhead Protection District Expansion Area as defined by Article 45 of the 1995 Annual Town Meeting.
B. 
This exemption shall not apply to those lots governed by other private restrictions, or restrictions by a bona fide government authority, which are not immediately evident at this time.
A. 
Lots within the Aquifer Protection District containing less than 30,000 square feet of area shall be entitled to a maximum septic system design capacity of 330 gallons per day.
B. 
Lots within the Aquifer Protection District containing 30,000 square feet or more of area shall be entitled to a septic system design capacity of 110 gallons per 10,000 square feet of property area.
C. 
Areas designated as wetlands shall not be considered when calculating square footage of property areas for lots subject to Subsection B.
