A.
BUSINESS
PERSON
In this chapter, the following words shall have the meaning hereby
ascribed thereto:
Any enterprise, activity, profession or any other undertaking
conducted in the Borough of Bath for profit or ordinarily conducted
therein for profit, any trade, business, profession, vocation or commercial
activity or for making sales within the Borough of Bath.
Any natural person, partnership, association, firm or corporation
or any profit-making venture conducting business within the Borough
of Bath.
B.
In this chapter, the singular shall include the plural, the plural
shall include the singular and masculine shall include feminine and
the neuter.
A.
In order that the Borough of Bath may best perform services for the
benefit of the community and businesses thereof, a centralized registry
of all business, as defined by this chapter herein, is hereby established.
Every business concern doing business in the Borough of Bath shall
annually, on or before the first day of June, register said business
with the Borough Manager upon a form furnished by the Borough and
pay the registration or reregistration fee as herein provided.
B.
Such fee shall be for the use of the Borough.
C.
There shall be a fee for the first or initial registration, and a
fee for each annual reregistration, provided that any person commencing
to conduct any business in the Borough at any time after the first
day of June, in any year, shall register such business after 30 days
after the commencement and/or establishment of such business and shall
pay the full registration fee. Fees shall be set by resolution of
Council from time to time.

Should any person registered under this chapter, as set forth
herein, change his or her place of business within the Borough, remove
such business to a place outside the Borough or discontinue such business
or transfer the business to another person, he shall furnish the information
of such change, removal or discontinuance, whichever the case may
be, within 10 days after the above, to the Borough Manager, so that
the register of the business can be changed accordingly.
Any change of ownership in any business which shall have been
registered under this chapter, the new owner thereof shall, within
10 days after acquisition thereof furnish information to the Borough
Manager so that the register of the business can be changed accordingly.
A.
Any person who shall violate or fail to conform to any provision
of this chapter shall be guilty of a summary offense and for said
summary offense, upon conviction, shall be sentenced to pay a fine
of not more than $300 and the cost of the prosecution and/or imprisonment
for not more than 10 days.
B.
Each day's continuance of a violation shall constitute a separate
offense.
C.
In addition,
court costs and reasonable attorney fees incurred by the Borough in
enforcement proceedings shall be assessed against violator and awarded
to the Borough.
