A. No person shall consume or possess, in any open container, any alcoholic
beverage in or upon any public or quasi-public place, including but
not limited to any public street, alley, sidewalk, mall, park, playground,
public conveyance or parking facility, or in any public building.
B. No person shall consume any alcoholic beverages in or upon any private
vehicle while it is in motion or parked upon any such public or quasi-public
place.
Nothing herein shall be construed to prohibit:
A. The possession or consumption of alcoholic beverages within or upon
premises duly licensed for the consumption of alcoholic beverages;
B. The possession of beer in pitchers or other unsealed containers as
may be lawfully sold by licensed premises while in transit to a lawful
place for consumption;
C. The possession, distribution or consumption of alcoholic beverages
in any public park, recreation area, or public building in connection
with any organized function or social affair for which a permit, issued
by the New Jersey Division of Alcoholic Beverage Control, has been
obtained;
D. The possession, distribution or consumption of alcoholic beverages
in any public park, recreation area, or public building, owned by
the City of Trenton, in connection with any organized function or
social affair for which prior permission has been authorized by resolution
of the City Council;
E. Any underage person from consuming or possessing an alcoholic beverage
in connection with a religious observance, ceremony or rite, while
in the presence of and with permission of a parent, guardian or relative
who has obtained the legal age of 21 years.
Persons found to be in violation of the provisions of this article shall be subject to the general penalty as provided in Chapter I, Article
III, General Penalty.
