A. It shall be the duty of the Water Superintendent to cause the installation
of a remote water meter including a check valve on meter outlet line
in every building hereafter constructed and every building hereafter,
for the first time, furnished with Borough water.
B. The Water Superintendent is hereby authorized and empowered, with
the consent and approval of Council, to order the installation of
water meters upon the service pipe of any customer, and to furnish
water at meter rates, wherever, in the opinion of the Superintendent,
an excess of Borough water is being used or for any other proper purpose.
In carrying out the program of metering existing buildings presently
furnished with water, the Superintendent shall install such meters
according to the following priority, classification and schedule:
(1) All commercial and industrial premises.
(2) All residential buildings occupied by more than one family.
(3) All residential buildings using automatic laundry and/or dishwashers.
(4) Finally, all single-family residences shall be metered in such order
as may be designated by Council.
All meters shall be installed at the expense of the customer
and maintained at the expense of the Borough, provided that the replacement
or repairing of any meters damaged through other than ordinary wear
and tear, by the negligence and carelessness of any owner or occupier,
shall be made at the sole expense of such owner or occupier of said
premises, including replaced parts, labor and transportation charges.
Each meter shall be read and bills issued quarterly; the quantity
recorded thereon shall represent the amount of water passing through
the meter, and the same shall be conclusive upon the customer and
the Borough, except in the event that any meter shall have been found
to be registering inaccurately or to have ceased to register, the
amount of water used may be determined by the average registration
of such meter when properly functioning, or by the registration of
a corresponding period of time, if the consumption is seasonable,
or by such other method as shall be deemed fair and reasonable, based
upon the best information obtainable.
Council shall, by resolution, from time to time fix and establish
a schedule of rates for the use of Borough water serviced to any real
estate through a meter. The minimum charge for such service shall
be the same as that of other customers, unless otherwise fixed by
resolution. In cases where more than one customer or family receives
water service through a single meter, the minimum charge shall apply
to each such customer or family.
No customer served with metered water shall take or receive,
or permit to be taken or received, any water from the waterworks into
a building for which a meter is installed, except that such water
shall have passed through and been registered by such meter.

A. Upon 30 days' notice by the Superintendent that a meter is to
be installed in a premises, the owner thereof shall, at his own expense,
in accordance with the rules and regulations supplied by the Superintendent,
cause such installation to be made. Upon the neglect of such owner
to comply with said notice, the Borough may cause said installation
to be made at the cost of the owner and may collect the cost, and
an additional $10 service charge.
B. No alteration or disconnection shall be made to the Borough water
system by a private property owner. For any said alteration or disconnection
the property owner shall give 15 days' notice to the Water Superintendent
who shall perform and make any proper alteration or disconnection
and directly supervise the same or cause the same to be supervised
as the Borough Council may deem necessary.
C. The property owner shall be responsible for any fee including time
and material; said fee not to exceed $200. That fee may be changed
from time to time by motion of Borough Council but shall not exceed
the maximum as stated herein except by ordinance.
The Superintendent, any employee of the Borough and any member of the Water Committee shall have the right at any and all hours to enter upon or into any premises to which water is supplied by the Borough, for the purpose of installing any meter, upon failure of the customer to do so, for the purpose of inspecting any pipe or fixture, setting, reading or repairing any meter, turning water off or on and the enforcing of the provisions of this Article
II generally. No person shall deny any such premises to any officer or employee hereby granted such right of entry.

Any person who shall violate any of the restrictions of this Article
II shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 and costs of prosecution for each and every violation, and, in default of payment of such fine and costs, to imprisonment for not more than 30 days. In addition, court costs and reasonable attorney fees incurred by the Borough in enforcement proceedings shall be assessed against violator and awarded to the Borough.
