There is hereby established a Fire Department for the City, which shall consist of a Chief, one (1) Assistant Chief and such organized Volunteer Firefighters as may be enrolled by the Chief with the consent of the Mayor.

The Fire Chief shall be appointed by the Mayor, and with the consent of the Board of Aldermen, at the first regular meeting of the Board of Aldermen in May of 1992, and each year thereafter. The Fire Chief shall be a suitable and qualified person of at least the ages of twenty-one (21) years, who shall serve for a term of one (1) year, unless sooner removed. In the event of a vacancy in the office of Fire Chief, the Assistant Fire Chief shall serve until the next regular meeting of the Board of Aldermen, at which time the vacancy shall be filled as stated above, and the person so selected shall serve the unexpired term.

Immediately upon his/her election, the Fire Chief shall recommend to the Board of Aldermen not more than twenty (20) persons, possessing the general qualifications required for other employees of the City, and between the ages of nineteen (19) and sixty-five (65) years, to serve for one (1) year as members of the Fire Department. The members of the department shall be chosen from among volunteers, and, upon their approval by the Board, shall take office for a term of one (1) year, unless sooner removed. In case of a vacancy in the membership of the department, the vacancy shall be filled for the unexpired term in the same manner as provided for the original appointment.

In the case of a vacancy in the membership of the department, the Fire Chief shall fill the vacancy until the next meeting of the Board of Aldermen, which, at that time, shall approve or disapprove the person so selected by the Fire Chief. In the event the Board disapproves the person so selected, the Fire Chief shall immediately submit another name for consideration by the Board. Upon final approval of the selection, the person so selected shall fill the vacancy for the unexpired term in the same manner as provided for the original appointment.

Every person duly selected as a member of the Fire Department shall be subject to call, at any time of the day or night, to attend any fire within the City; and if any member shall fail, neglect or refuse to attend any fire, without reasonable cause therefor, he/she shall be subject to immediate removal from the department. Members shall be called to attend fires by the sounding of the fire telephone, and upon the sounding thereof they shall assemble, as quickly as possible, at the station house or other place designated by the Fire Chief.

As soon as the department shall be organized, the Fire Chief shall designate some member of the department to act as Assistant Chief; and in the absence of the Chief, the Assistant Chief shall be in full charge and control of the department and exercise all of the powers and duties herein specified for the Chief.

All members of the Fire Department shall perform such duties as may be required of them by the Chief, shall wear such uniforms, badges, caps, and other insignia as the Chief and the Committee on Fire Department may direct, and shall obey such other rules and regulations as may be prescribed by the Board of Aldermen.

The Fire Chief shall be responsible for the discipline, good order and conduct of the department, the enforcement of all laws, ordinances and regulations pertaining thereto, and for the care and condition of the houses, engines, trucks, and all other property of the department. He/she shall have the superintendence, control, and command of all the men and women belonging to the department, all the engine houses and all other houses used for that purpose, and of all engines and fire apparatus belonging to the City. He/she shall likewise have control of all persons present at fires, and to that end shall ex officio have and exercise all of the powers of the Chief of Police thereat. He/she shall have power, if need be, to summon any and all persons present to aid in extinguishing a fire, and any person so summoned and aiding shall be entitled to a reasonable compensation as recommended by the Chief and allowed by the Board of Aldermen. He/she shall, when a fire breaks out, take immediate and proper measures for its extinguishment. He/she shall have the right to remove personal property from any building on fire or in danger thereof, and to guard the same. Any person refusing to obey the commands of the Chief while present at a fire shall be deemed guilty of an ordinance violation. The Chief shall have power to order the cutting down and removing of any building, erection, fence or other thing, if he/she shall deem it necessary for the purpose of checking a fire in its progress. In case of absence of the Chief from any fire, the Assistant Chief shall, for the time, have all the powers of the Chief and perform the duties of that office. The Chief may prescribe limits in the vicinity of a fire within which no person, excepting those who reside therein, members of the Fire or Police Department, and those admitted by order of the Chief or his/her assistant shall be permitted to come.

The Chief and the Board of Aldermen shall adopt and promulgate rules and regulations for the conduct of the Fire Department, and the Chief and the Board of Aldermen shall have authority peremptorily to suspend or discharge any Firefighter for neglect of duty or disobedience of orders.

The Chief shall also keep a record of every fire that may occur, showing what property was destroyed, giving its description, name of owner, and occupant, where situated, its value, and amount of loss and insurance.

The Chief shall also keep a record of false alarms, of the cause of the various fires, of the expense connected with the department, and of such other facts as he/she may deem of value to be preserved, and report the same to the Board of Aldermen at its first meeting in each month.

The Fire Chief, or his/her delegate, shall examine all buildings and places where explosives and inflammable materials are kept in the City and to report their condition at least once a year to the Mayor, and the Fire Chief or his/her delegate is hereby authorized to enter any and all buildings and places for the purpose of inspection.

If there are two (2) serviceable fire trucks with adequate equipment and a request is received for firefighting equipment outside the City limits for mutual aid, the Fire Chief, or Assistant Chief, may determine whether to answer such request depending on the road conditions, water supply and other conditions at the time, and his/her decision shall be final. The decision of the Fire Chief or Assistant Fire Chief shall in no way subject him/her to liability. In the event the Fire Department answers the call, it shall take only one (1) truck and not more than six (6) of the available members of the department. At no time shall both the Chief and the Assistant Chief attend fires outside the City limits.

The City of Milan Fire Department shall cooperate, when possible, with the Sullivan County Rural Fire Department and shall provide not more than two (2) members of the department to answer a rural fire call.

A. 
The Fire Chief shall appoint, with the approval of the Mayor, members of the City of Milan Volunteer Fire Department to serve in incidents of a disaster or emergency nature.
B. 
That said, disaster/emergency Firefighters shall serve without compensation, but shall be provided Workers' Compensation Insurance and medical insurance.
