As used in this article, the following terms shall have the
meanings indicated:
FIRE OFFICIAL
Includes the Fire Chief, the first truck driver on a scene
for an emergency or any individuals designated by the Chief.
PHYSICALLY CHALLENGED PERSON and/or HANDICAPPED PERSON
A person who qualifies under the Pennsylvania Department
of Motor Vehicle Code definition and who possesses a handicapped person
identification card and a placard (prominently displayed in the front
window dashboard of the vehicle) and/or a handicapped license plate
issued by the Director of the Division of Motor Vehicles or the equivalent
agency in or for other states and federal motor vehicles.
POLICE OFFICER
Includes the contracting police agency, any police officer
from a mutual aid municipality, the Commonwealth of Pennsylvania State
Police and any official Police Department visitor.
PUBLIC OFFICIAL
A person who is a duly elected officer or appointed official
of the Borough of South Waverly, including the members of Council,
the Mayor, the Borough Secretary, the Borough Code Enforcement Officer,
the Borough Zoning Officer, any appointed Emergency Management Agency
official, official Borough visitor and any other authorized Borough
official or employee.
PUBLIC PARKING
Any building, structure, facility or complex used by the
general public, including but not limited to municipal and/or government-owned
buildings, shopping malls, stores, markets, hotels, recreation facilities,
schools, office buildings and public eating places, whether publicly
or privately owned.
Parking spaces for the physically challenged shall be constructed
in accordance with the following guidelines:
A. Handicapped parking spaces will be located in parking areas most
accessible and approximate to the entrance to the building which the
facility serves. The determination of said locations will be made
by the Borough Building Code Enforcement Officer upon recommendation
with the Chief of Police of the contracting police force in conjunction
with and in consultation with the property owner.
B. Each handicapped parking space or group of spaces shall be identified
in accordance with specifications found in the American Disabilities
Act.
C. Each space shall comply with the American Disabilities Act and regulations.
D. All signs and pavement markers required by the Pennsylvania Department
of Transportation shall be maintained in good and proper condition
by the property owner and must remain clearly visible at all times.
Parking spaces for municipal officials and police shall comply
with all of the Borough's Building Codes and Zoning Codes.
Parking for the physically challenged shall be permitted at
the following locations:

It shall be unlawful for any person to stop, park or stand a
motor vehicle in a legally designated handicapped parking space unless
such a person is a Borough official, police official or fire official
or a handicapped person or is transporting a handicapped person and
is using the handicapped parking space for the transportation of said
handicapped person. Any person who shall violate this section shall
be subject to a fine of $10 for the first offense, plus, for subsequent
offenses within a twelve-month period, a fine of at least $50 and
up to 90 days' community service on such terms and in such form
as the court shall deem appropriate, or any combination thereof.
The contracting police force shall have the power and duty to
enforce the provisions of this article.
