This is an article to establish the residency requirement for
the appointed office of Deputy Clerk in the Village.
This article is adopted pursuant to Municipal Home Rule Law
§ 10, Subdivision 1(ii)a(i), that grants to local governments
the authority to enact local laws regarding the qualifications of
local officers, and the provisions of Public Officers Law § 10(1)(e)(3)[1] that grants to villages the power to enact local laws
which may override the provisions of Village Law with regard to governance
matters.

Any prior local law regarding the residency of a Deputy Clerk
for the Village of Walton is hereby repealed.
Hereinafter, the position of Deputy Clerk shall not be required
to be filled only by a resident of the Village of Walton, but such
person may also reside within a ten-mile radius of any boundary line
of the Town of Walton, Delaware County.
If any clause, sentence, paragraph, word, section or part of
this article shall be adjudged by any court of competent jurisdiction
to be unconstitutional, illegal or invalid, such judgment shall not
affect, impair or invalidate the remainder, thereof, but shall be
confined in its operation of the clause, sentence, paragraph, worked
section or part thereof directly involved in the controversy in which
such judgment shall have been rendered.
This article shall take effect upon filing in the office of
the Secretary of State.
