There is hereby created the Lemoyne Borough Environmental Advisory Council ("EAC," herein), which shall function in accordance with and have the powers and duties conferred upon it by this chapter. The EAC shall exist to advise the Borough Council and all Borough committees, subcommittees, ad hoc committees, commissions, authorities, and other staff and officials on matters concerning the protection, conservation, management, promotion and use of natural resources located within Lemoyne Borough.
A. 
The EAC shall have the power to:
(1) 
Identify environmental problems within Lemoyne Borough and to recommend plans and programs to the appropriate board or commission of the Borough for the promotion and conservation of the natural resources of, and the protection and improvement of the quality of the environment within Lemoyne Borough.
(2) 
Make recommendations with respect to development and as to the possible use of open land areas and other resources situated within Lemoyne Borough.
(3) 
Make recommendations regarding issues with environmental impact, to include matters affecting areas outside of this municipality but influenced by the actions, inactions, or policies of Lemoyne Borough.
(4) 
Promote a community environmental program. Work with schools and environmental groups to enhance community environmental education programs.
(5) 
Advise the Borough Council and the other agencies of Lemoyne Borough with regard to environmental concerns related to the acquisition of property, both real and personal, by gift, purchase, grant, bequest, easement, devise or lease.
(6) 
Undertake such environmental tasks as requested by the Borough Council.
B. 
The EAC shall keep records of its meetings and activities and shall make an annual report, in writing, to the Borough Council, which shall be printed in the annual municipal report (if applicable) or otherwise made known and available. Minutes of each meeting shall be forwarded to the Borough Council.
C. 
The EAC shall serve in an advisory capacity only. Nothing herein grants or conveys to the EAC authority or power to intervene in any matter pending before Borough Council, its committees or subcommittees, or any municipal authority or commission. Furthermore, the EAC shall not have the authority or power to represent, or speak on behalf of, Borough Council, its committees and subcommittees, or any municipal authority or commission, in any matter pending before any local, state, or federal tribunal, agency, commission, or committee. While the EAC is to serve in an advisory capacity only, nothing herein grants or conveys to the EAC the power or authority to delay, postpone, or enjoin any matter pending before Borough Council, its committees and subcommittees, or any municipal authority or commission, including, but not limited to, the review and approval of any proposed private land development plan, any proposed municipal project, any proposed ordinance or regulation, etc.
A. 
The Lemoyne Borough EAC shall be composed of five residents of the Borough appointed by Borough Council, and appointments shall be as follows: EAC members' terms or office shall expire on the first Monday in January following the last year of their term of office. Initially, two members shall serve a term of one year, two members shall serve a term of two years, and one member shall serve a term of three years. Upon expiration of an EAC member's term, Borough Council shall appoint a resident of the Borough to a new three-year term. However, a member may stay in office until a successor is appointed. The Borough Council shall fill all vacancies occurring on the EAC. Whenever possible, one member shall also be a member of the Borough Planning Commission.
B. 
The EAC shall elect its own Chairperson, Secretary, and any other officers deemed necessary, to serve for a period of one year. The Chairperson shall designate such committees, which may include nonmembers, as he or she deems necessary. The EAC shall also have power to adopt rules and regulations for the conduct of all business pending before the EAC. EAC members shall receive no compensation for their services, but may be reimbursed for the expenses actually and necessarily incurred by them in the performance of their duties, as budgeted and approved by Borough Council.
The governing body of this municipality may, from time to time, appropriate funds for the expenses incurred by the EAC.
