Pursuant to § 2204 of the Pennsylvania Second Class Township Code, the Nockamixon Township Board of Supervisors ("Board of Supervisors") hereby creates a Recreation Board ("Recreation Board") to supervise and maintain recreation places in Nockamixon Township ("Township").
It is the mission of the Recreation Board to advise the Board of Supervisors in order to foster a meaningful and satisfying program of leisure and recreational activities and events for the residents of this Township, enhancing physical, emotional, mental and social growth.
The Recreation Board shall consist of seven members, all of whom shall be residents of Nockamixon Township. One member of the Recreation Board shall serve as liaison to the Board. All members of the Recreation Board shall serve without compensation. All members of the Recreation Board shall be appointed by the Board of Supervisors.
Upon enactment of this chapter, unless otherwise provided by law, the Board of Supervisors shall appoint the seven initial Recreation Board members, whose terms shall be fixed as follows: one term each of one year, two years, three years, and four years; and three terms of five years, respectively, to establish a series of overlapping terms, with no more than three terms expiring in any year. Thereafter, members shall be appointed by the Board of Supervisors and shall serve no longer than five years. The terms of the members shall always be staggered in such a manner so at least one term expires annually. The Board of Supervisors may appoint any member for less than a five-year term only to ensure staggered terms. Vacancies in the Recreation Board, occurring otherwise than by expiration of term, shall be filled for the unexpired term only in the same manner as the original appointments.
A. 
The members of the Recreation Board shall elect their own Chairperson and Secretary and select all other necessary officers, to serve for a period of one year, and may employ such persons as may be needed, upon express prior authorization by the Board of Supervisors. The Recreation Board shall have power to adopt rules and regulations for the conduct of all Recreation Board meetings, unless otherwise established by the Board of Supervisors.
B. 
The Recreation Board will meet at those times pursuant to public notice as its members shall determine to conduct any business that comes before it.
The Recreation Board shall have the following powers and shall carry out the following duties:
A. 
On or before February 1 of each year, the Recreation Board shall submit an annual report to the Board of Supervisors. The report shall include an analysis of the recreational areas and facilities in the Township. The Recreation Board shall make any other special reports to the Board of Supervisors as requested by the Board of Supervisors.
B. 
All actions of the Recreation Board shall be subject to the review and approval of the Board.
C. 
The Recreation Board shall endeavor to interpret the need for and importance of recreation and park places and services to the residents of and visitors to Nockamixon Township.
D. 
The Recreation Board shall recommend to the Board of Supervisors a budget for equipping, operating and maintaining recreation places and facilities in the Township.
E. 
Within the scope of the budget and programs approved by the Board of Supervisors, the Recreation Board shall equip, operate and maintain recreation places and facilities in the Township.
F. 
The Recreation Board shall have the power to work with any sub-committee of the Recreation Board established by resolution of the Board of Supervisors.
G. 
The Recreation Board shall not have the power to amend, adopt, alter, repeal or change any rules and regulations that govern the use of the parks by the public that have been adopted by the Board. Only the Board of Supervisors shall have the power to adopt rules and regulations for the operation of the parks and recreation places in the Township.
