As used herein, the following words will have the definitions
designated:
OPEN BURNING
The burning of combustible material other than indoors.
PERSON
Any individual or corporation.
TOWNSHIP
The Township of Lancaster, County of Butler, Commonwealth
of Pennsylvania.
Whenever the Supervisors of the Township determine after consulting
with the Chief of the Fire Company serving the Township that an emergency
condition exists due to unusual weather conditions which have created
an unreasonable risk of fire within the Township, they shall issue
a declaration of emergency which shall specifically prohibit open
burning within the Township until such time as the Township Supervisors,
in consultation with the Chief of the Fire Company serving the Township,
determine that the unreasonable risk has been substantially alleviated.
After issuance of a declaration of emergency pursuant to this
chapter, the Supervisors shall forthwith communicate the same to the
public through all means available to them, including but not limited
to radio, television, newspaper, United States mail and posting in
a conspicuous site place at the Township Building.

Any person starting or tending open burning during a period
of declared emergency pursuant to the terms hereof who has knowledge
of the declaration of emergency shall, upon conviction in a summary
proceeding brought before a Magisterial District Judge under the Pennsylvania
Rules of Criminal Procedure, be guilty of a summary offense and shall
be punishable by a fine of not more than $1,000, plus costs of prosecution.
In default of payment thereof, the defendant may be sentenced to imprisonment
for a term not exceeding 90 days. Each day or portion thereof that
such violation continues or is permitted to continue shall constitute
a separate offense, and each section of this chapter that is violated
shall also constitute a separate offense.
