For the purposes of this Part, the following terms shall have
the meanings ascribed to them herein:
AGED WOOD
Natural firewood that has been sized and aged for burning
in a fireplace.
COMPRESSED LOG
Commercial wood products that have been designed for use
in fireplaces.
FUEL LOAD
The height of the combustible material measured from the
base of the burn pan to the highest point of the combustible material.
OUTDOOR FIRE PIT
Freestanding fireplaces or portable devices intended to contain
and control outdoor fires, including fireplaces, chimeneas and fire
pits, constructed of noncombustible materials such as steel, brick
or masonry. An outdoor fire pit does not include charcoal- or gas-powered
grills that are intended to be used for cooking purposes.

1. Permitted Devices:
A. A portable, aboveground, commercially manufactured wood-burning or
propane or natural gas fire pit lined with a noncombustible material.
B. A wood-burning chimenea made of a noncombustible material.
C. A permanently constructed fireplace or fire pit lined with a noncombustible
material such as brick, rock, concrete, or heavy-gauged metal.
2. No permitted device may have a burning area that exceeds seven square
feet or a three-foot diameter circle.
3. The height of the fuel load shall not exceed 18 inches from the base
of the burn pan.
4. Outdoor fire pits shall employ screens and a lid to completely enclose
the fire and burning logs contained therein, or a chimney.

1. Recreational burning must not take place within 15 feet of any structure,
tree (including canopy), vehicle, or building, nor within 10 feet
of any property line.
A. An extinguisher source must be readily available and close by while
any fire is burning (for example, garden hose, ABC fire extinguisher,
water bucket).
B. A responsible adult, over the age of 18, must be present at all times
while any fire is burning.
2. A portable outdoor fireplace must only be placed on a noncombustible
surface.
3. Recreational burning must not be conducted under any roofing, awning,
or similar overhead covering.
4. No burning is allowed on any street, sidewalk, public park, or parking
lot within the Borough.
5. The Fire and Police Departments shall have the authority to require
that burning be extinguished immediately if such usage is not compliant
with this Part or any other applicable ordinance, law or code, or
found to be dangerous or a nuisance.

1. Permitted burning material shall be compressed logs, natural wood,
and other nonputrescible vegetable matter.
2. Fires must comply with Chapter
10, §
10-307, prohibiting the burning of tree branches, leaves, decayed or fallen trees, yard trimmings, paper and other rubbish, garbage, or noxious vegetation. Burning of lumber, pallets, scrap wood, tree trimmings, leaves, yard waste, paper, cardboard, garbage and other similar items is prohibited.
3. No hazardous or otherwise objectionable condition shall be created
by such burning.
4. No fuel such as gasoline, alcohol, diesel fuel, and kerosene may
be used to light or relight fire.
5. No outdoor fire pit shall be permitted to emit offensive or objectionable
smoke or odors or when other circumstances make usage of said outdoor
fire pit hazardous, including, but not limited to, injury or damage
to persons or property.
6. The outdoor fire pit shall be used strictly in adherence with all
manufacturer's guidelines and specifications issued with respect
to the make and model of said outdoor fire pit.
7. Once a fire has been started in an outdoor fire pit, the lid and
side screens shall be secured and shall not be removed until the fire
is out or extinguished, and no object shall be permitted to protrude
outside the lid and screens while a fire is burning within the outdoor
fire pit, provided that recreational fires utilized to cook food shall
be exempt from said requirement during that period when food is being
cooked over the flame.
8. Hours of operation. A person shall not maintain any outdoor burning
between the hours of 12:00 a.m. and 9:00 a.m. unless permitted and
approved by the Fire Marshal.

1. Any person, firm or corporation who shall violate any provision of
this Part, upon conviction thereof, shall be sentenced to pay a fine
of not more than $1,000 plus costs and, in default of payment of said
fine and costs, to a term of imprisonment not to exceed 30 days. Each
day that a violation of this Part continues shall constitute a separate
offense.
2. Enforcement of this section is within the authority of the Borough
Code Officials, the Borough Fire Marshal, and/or Borough Police.
