Every owner of property in the Borough of Wrightsville shall be responsible for adhering to the provisions of this Part as to trees growing upon his property or along any portion of any street abutting upon such property.

It shall be unlawful for any person, after the effective date of this Part, to plant any tree anywhere beyond the property line of his property or to permit or allow any part of the trunk or roots of any tree heretofore planted upon or along his property to extend horizontally beyond the right-of-way line of any street.

It shall be the duty of every owner of property in the Borough of Wrightsville to trim and keep trimmed the limbs, branches and/or foliage of all trees growing upon his property or along the street abutting upon his property, so that no portion of any such limbs, branches or foliage shall be lower than 10 feet above the surface of the sidewalk or lower than 14 feet above the surface of the roadway.

In case any tree shall be planted or growing contrary to any provision of §§ 25-103 and 25-104 of this Part, the Borough Council shall notify the owner of the property upon or along which such tree is growing, to trim or remove such tree within 10 days after such notice, so that such violation shall not continue and if any property owner shall fail, neglect or refuse to comply with any such order, within the time stated in such notice, the Borough Council shall cause such work of removal or trimming to be done and the Borough shall collect the cost of such work, with an additional amount of 10% from such property owner in default.

Any person, firm or corporation who shall violate any provision of this Part shall be, upon conviction thereof, sentenced to pay a fine of not more than $600 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Such fine and costs may be in addition to any costs of work and additional amounts imposed under § 25-105 of this Part. Each day that a violation of this Part continues shall constitute a separate offense.
