There shall be and there is hereby established rates and charges
for the use of and for the services supplied by the Village's water
system as currently established or as hereafter adopted by resolution
of the Village Council from time to time.

(a) Bills for the rates and charges are herein established by the Village and shall be sent monthly. All bills shall be paid in full on or before the due date, and shall be paid at the office of the Village Treasurer. If any charge for services of the system shall not be paid when due, a delayed payments charge of 10% of the amount of the bill shall be added thereto and collected therewith. If any bills for the service of the system shall remain unpaid after 30 days following the due date of the bill, the water supply for the lot, parcel of land, or premises affected, shall be turned off at a cost of $25 and shall not be turned on again except on payment in full of all delinquent or other charges in addition to the payment of the $25 charge to reestablish service pursuant to §
32-82(c).
(b) Renter's meter deposits. There is hereby established a meter deposit
in the amount of $50, which deposit shall be required to be made to
the water department by any person requesting water service where
the applicant for water service is not the title owner of record of
the premises to be served. Such deposits will be held in trust for
the depositors by the water department, which shall not be required
to pay interest thereon. In the event that the depositor ceases to
rent the premises, the deposit shall be returned after deducting any
unpaid charges.
(c) Water tap installation fees. The indirect connection fee can be established
by determining the percentage of the estimated total water system
cost that can be attributed to transmission costs and multiplying
this value by the established direct connection fee. Transmission
costs consist of the twelve-inch transmission main from Lake Township
to the Village, oversizing the eight-inch main in the Village to twelve-inch
main for transmission purposes, including the associated oversize
cost for gate valves, the water meter in the transmission main, and
the storage tank. The total system cost includes the total estimated
transmission cost plus the cost of the water distribution system in
the Village.
Estimated indirect connection percentage = Transmission cost/system
cost $404,450/$1,005,740 = 0.402%

Therefore indirect connection fee would be 0.402 x the direct
connection fee.

It is hereby made the duty of the Village Clerk to render bills
for service and all other charges in connection therewith and the
Village Treasurer to collect all monies due therefrom.

(a) Water consumption rates. In addition to the operations and maintenance
recovery charge, the actual water consumed will be charged at the
rate of:

Village customers shall pay $4.32 per 1,000 gallons or fraction
thereof.
(2)
Township customers shall pay $5.40 per 1,000 gallons or fraction
thereof.
The owner of each premises or property which is connected to
the system with a service connection ready to be used, shall pay the
water department an operation and maintenance recovery charge for
each such service connection per meter size as follows:

Each new user of the system shall pay a minimum connection charge
for a service stub per line size as follows:

It shall be the duty of the Village to cause inspections to
be made of all property served by the public water supply. The frequency
of inspections and re-inspections are based on potential health hazards
involved and shall be established by the Village and as approved by
the Michigan Department of Health.

All contractors must be approved by the Village department of
public works in writing before application for tap installation is
granted and work begins. After tap is installed, it must be left exposed
for inspection by Village department of public works.

Pursuant to §
14-1 of Article
I, no person shall take any water from any public hydrant except in case of fire without first having obtained written permission from the maintenance supervisor and shall pay for the use of such water such as the filling of pools or for agricultural use or other uses in the amount of $6 per 1,000 gallons or faction thereof.

Any person who violates, disobeys, omits, neglects or refuses
to comply with any provision of this section, or any permit or approval
issued hereunder, or any amendment thereof, or any person who knowingly
or intentionally aids or abets another person in violation of this
section, shall be in violation of this section and shall be responsible
for a civil infraction. The civil fine for a municipal civil infraction
shall be not less than $100 for the first offense and not less than
$200 for subsequent offenses, in the discretion of the court, in addition
to all other costs, damages, expenses and remedies provided by law.
For purposes of this section, "subsequent offense" means a violation
of the provision of this section committed by the same person within
12 months of a previous violation of the same provision of this section
or similar provision of this section for which said person admitted
responsibility or was adjudged to be responsible. Each day during
which any violation continues shall be deemed a separate offense.
